RCEP争端解决机制争端解决模式的设计充分考虑到了成员国之间的经济、文化与发展水平间的差异,采用了混合争端解决模式。在设计上,RCEP争端解决机制赋予了成员国选择争端解决程序的自由,但同时也对案件的管辖权做出了规定,以避免管辖权冲突。目前RCEP已经生效,在将来的贸易交往中,中国可以从完善国内规则,引进国际性调解、仲裁机构,建立点对点的涉外法律服务链,提高信息透明度等四个方面对应RCEP争端解决机制。

投资者—国家仲裁机制作为国际投资争端解决的主要途径之一,在TPP协定中具有举足轻重的作用,势必在未来各国愈加频繁的经贸交往中产生重要而深远的影响。其条文本身在2012年美国BIT范本的基础上作了改进,采取多种形式限制仲裁庭管辖权,兼顾发展中国家的利益诉求,试图平衡国家与投资者的利益,同时为投资仲裁裁决执行扫清障碍,从而增强了投资者与国家仲裁的信心。面对TPP投资者—国家争端解决条款的最新规制,除了审视其与中国条约立法实践中的差距与不足之外,中国应继续完善投资争议国内救济手段,尽早颁布中国国家豁免法,采取一系列必要的应对法律措施,以减轻TPP新规则可能对中国带来的影响。

学者们在WTO对人民币汇率争端管辖权的问题上存在较大争议。从WTO争端解决机制的一般管辖权规定看,WTO对人民币汇率争端行使管辖权并不存在实质性障碍,而GATT第15条也无法构成阻碍这种管辖权的有效法律基础。WTO争端解决机构有可能将人民币汇率机制解释为"与贸易有关的外汇措施",而对人民币汇率争端行使管辖权。

文章从CAFTA投资争端解决机制入手,对国际投资争端管辖权冲突的成因进行了分析,认为:当事方在不同条约下享有的投资权益的竞合是管辖权冲突的根本原因;在不同条约下,同一措施导致的当事方投资利益的减损所产生的多重诉由是管辖权冲突的直接原因;当事方根据其享有的争端解决请求权所进行的多重选择是管辖权冲突的关键原因。文章认为,争端解决方式的选择应考虑投资争端解决机制的近期发展及国际投资环境的变化,需经过识别和利益衡量两个主要阶段,并应基于尊重主权,利益最优化,以及立足区域一体化、兼顾全球化、稳固双边投资促进和保护等原则进行利益衡量,以确定具体的方式。
