The health and safety risk faced by individual employees can be treated as an unobservable latent variable which manifests itself at workplace level through reported counts of work‐related injuries and illnesses over a given interval. This paper presents results from count data regressions using data from the 1998 Workplace Employee Relations Survey. The findings strongly support the view that employees in larger establishments have a lower probability of being injured or falling ill. In addition, establishments with a higher proportion of unionized employees, and with health and safety committees, were associated with higher numbers of reported injuries and illnesses.  相似文献

This study examines the role of unions in implementing the Occupational Safety and Health Act (OSHA) by using a data set that provides information on regulatory enforcement. The analysis demonstrates that unionized establishments are more likely to receive safety and health inspections, face greater scrutiny in the course of those inspections, and pay higher penalties for violating health and safety standards than comparable nonunion establishments. Implementation of OSHA therefore seems highly dependent upon the presence of a union at the workplace.  相似文献

Occupational health and safety (OHS) representatives and committees are the principal form of employee participation mandated by legislation in Anglo‐Saxon countries, and therefore have a strong base. However, their existence precedes legislation in some significant cases. This article undertakes a 70‐year historical analysis of the effectiveness and operations of one significant example of pre‐legislative OHS committees in an Australian steelworks. The study finds that effectiveness of the committees as a form of participation depended on a complex complementarity of variables, including relationship with unions, the nature of management commitment, the organizational industrial relations climate and the political and institutional macro environment, consistent with ‘favourable conjunctures’ theory.  相似文献

This study examines the effectiveness of occupational safety and health com-mittees within the public sector of New Jersey. Survey data collected from work-site representatives were matched with state-collected reports of injury and illnesses. While there remain methodological problems with this approach, the results indicate that committee scope and training play a positive role in perceptions of committee effectiveness and that committees with more worker involvement are associated with fewer reported illnesses and injuries.  相似文献

This paper uses data from the Australian Workplace Industrial Relations Survey conducted in 1989–90 to examine the net impact of trade unions on the extent of formal types of employer-provided training. A net positive effect is found, but only where unions are active in the workplace and not merely de jure representatives of the work-force. The results also indicate, with respect to in-house training, that unions shift the emphasis towards work-forces with long tenure, a finding that is consistent with 'union voice' arguments.  相似文献

Drawing on qualitative interviews with disabled employees, union officers and disability‐related organizations, this article examines employee attempts to negotiate workplace adjustments and associated issues of workplace representation. UK employment law utilizes an individual medical model of disability, which conflicts with traditional collective approaches favoured by trade unions, which has implications for disabled employees and union representation. We explore the different strategies available to unions and conclude that, despite the role played by disability‐related organizations in supporting employees, unions are the only workplace actors who are capable of reconfiguring the ‘personal as political’ and integrating disability concerns into wider organizational agendas.  相似文献

Participatory work practices, like teams, quality circles and joint consultative committees (JCCs) can, but do not necessarily, decentralize decision making and increase worker autonomy. We use broad, cross‐sectional establishment data from the European Union and three Commonwealth countries to measure the extent of decision making by workers across these countries, and to analyse how this measure varies with the use of participatory practices. Within Europe, workers in Sweden, Germany, France, the Netherlands and Ireland are most likely to be given the authority to make decisions. In Spain, Portugal and Italy, decentralized decision making is more unusual. While decision making is generally higher in establishments with teams, JCCs and quality circles, this result does not hold across all countries. Even where the relationships are significant, use of participatory practices explains a surprisingly small amount of the overall variation in decision making.  相似文献

Given the disappointing outcomes of private regulation of labour in global supply chains, worker organization is increasingly seen as the key to better working conditions. This article examines the extent to which unions impact different dimensions of labour standard compliance in Cambodia's garment export sector, where unions have grown considerably. Based on unique factory‐level data and field‐based interviews, this study shows that union presence improves factories’ compliance with wage, hours, and leave standards, although the impact is much less significant for health and safety. Moreover, having multiple unions in the workplace does not appear to improve labour conditions.  相似文献

This paper reexamines American experience with company unions (also known as nonunion employee representation plans) before they were banned by the Wagner Act (1935). For the half‐century following the passage of the act, labor historians and industrial relations scholars painted a bleak portrait of company unions as anti‐union sham organizations. Since the 1980s, additional research has documented a more positive side; similarly, concern has grown that the Wagner Act's ban is stifling legitimate employee participation programs. This paper brings new theoretical and empirical evidence to both historical and legal parts of this debate, including examination of company unions through individualist, unitarist, pluralist, and radical frames; demonstration that the pluralists’ view of company unions was more diverse and positive than conventionally portrayed; presentation of new historical evidence and testimony on the company union experience; and a substantially revisionist assessment of the merits of the Wagner Act's ban. In particular, the conclusion is that, given any reasonable weighting of the four frames, the company union ban is overly restrictive and should be modified so companies can implement the positive side of nonunion employee committees but not the negative. The paper ends by noting that the unbalanced and narrowly critical treatment of company unions in the mainline industrial relations tradition is a case study of the field's perhaps fatal post–World War II core intellectual‐normative contradiction—professed inclusiveness of all frames of employment relations but, in practice, attention to and preference for a narrow union‐centric version of one frame.  相似文献

A major focus of the Conservative government's employment policy since 1979 has been the reduction of union power within the labour market, the employment relationship and as representatives of a separate ‘labour interest’ in society ' union exclusion. The principal impact of the legislative changes is to deny workers access to resources of collective power, thereby commensurately increasing employers' discretion to determine the terms of the employment relationship. When forming new subsidiaries and establishments, or purchasing non-union subsidiaries, employers have been able to resist unionization and recognition except on their own terms, but comparatively few have terminated existing union recognition agreements, preferring to marginalize the role of unions through the adoption of partial exclusion policies ' joint consultation, direct communication, performance-related pay, and the fragmentation of common employment and bargaining.  相似文献

This paper provides the first econometric analysis to distinguish between works councils in establishments where managers have a positive or negative view toward employee involvement in decision making. We similarly distinguish between establishments where no council is present in which management supports or does not support worker participation. We stress the potential role of works councils and participation in motivating employees. Our theoretical analysis and empirical results from German manufacturing establishment data show that the structure of the workforce, principal‐agent problems between owners and managers, collective bargaining, direct employee involvement, human resource management practices, and market strategy and innovativeness all play important roles. Some conflicting conclusions in the works council literature may be due to the failure to distinguish among industrial relations participation regimes characterized by cooperative or uncooperative relationships between works councils and management.  相似文献

This article matches establishment-level data on workplace transformation (e.g., quality circles, work teams, and just-in-time production) with measures of cumulative trauma disorders at these same establishments to explore the relationship between "flexible" workplace practices and workplace health and safety. The results reveal a positive, statistically significant, and quantitatively sizable relationship between cumulative trauma disorders and the use of quality circles and just-in-time production.  相似文献

The fall in unionism and the rise in the non-union workplace over the past two decades raises the question as to whether workers now have a reduced capacity to initiate issues and articulate grievances. For some commentators independent unions are the only source of genuine voice. Others have argued that the adoption of the HRM paradigm within an enterprise will provide workers with adequate voice mechanisms. This article analyzes the subsequent unemployment risk of a sample of Swedish employees in 1991. We find that non-European immigrants face an unemployment risk twice as large as the corresponding risk for native workers despite controls for employee characteristics, the 1991 wage rate, and sorting across establishments with varying unemployment risks. Although all employees enjoy higher job security with higher seniority, large differences in unemployment risk by region of birth remain for workers with similar seniority levels. This suggests that labor unions and employers deviate from seniority rules established by the Swedish Security of Employment Act in favor of native workers.  相似文献

This article examines how employee voice arrangements and managerial attitudes to unions shape employees' perceptions of the industrial relations climate, using data from the 2007 Australian Worker Representation and Participation Survey (AWRPS) of 1,022 employees. Controlling for a range of personal, job and workplace characteristics, regression analyses demonstrate that employees' perceptions of the industrial relations climate are more likely to be favourable if they have access to direct‐only voice arrangements. Where management is perceived by employees to oppose unions (in unionized workplaces), the industrial relations climate is more likely to be reported as poor. These findings have theoretical implications, and significant practical implications for employers, employees, unions and the government.  相似文献

This paper is the first study to investigate the impact of workplace representation on plant closings in Germany, using data from a nationally representative establishment panel. Across all establishments in our sample, we find evidence of a positive association between works council presence and plant closings. There is the contrary suggestion that industry‐wide collective bargaining plays a neutral to benign role. As for the interaction between collective bargaining and workplace representation, this appears strongest for establishments with fewer than 50 employees: such plants are much more likely to close if they have a works council and are not covered by a collective agreement.  相似文献

This article compares union density rates in seven Western European countries between 1960 and 1990. In contrast to conventional analyses, the paper argues that, in countries where workplace union organization is well developed, and where unions have managed to turn the official institutions for workers' participation such as works councils into extensions of their operations, they fared better during the 1960s and 1970s than in countries where this was not the case. This difference in the fate of unions was even more pronounced during the 1980s. Unions with strong locals lost few members or actually gained some, while unions without strong local structures saw union density drop by between one-quarter and one-third.  相似文献

The introduction of the European Directive on Information and Consultation and the recent implementation of the Information and Consultation of Employees (ICE) Regulations into United Kingdom (UK) law have increased the focus on workplace representation arrangements. This paper examines the interplay between nonunion and union representative arrangements at Eurotunnel (UK) and assesses their effectiveness in representing the needs of employees over a 5‐year period. Importantly, the paper also examines the opportunities and challenges of both nonunion representation (NER) and union voice arrangements. The findings show that the effectiveness of nonunion structures as bodies representing the interests of employees in filling the lack of representation is questionable. However, union recognition through an employer–union partnership agreement has also raised important issues regarding the effectiveness, impact, and legitimacy of unions at Eurotunnel. The main implication of this research is that the existence of a mechanism—union or nonunion—for communication between management and employees at the workplace may not be a sufficient condition for effective representation of employee interests. In addition, while trade unions may provide greater voice than nonunion arrangements (thus the reluctance of management to accept such voice arrangements), the strength of voice is dependent on the legitimacy and effectiveness of trade unions in representing employees’ interests at the workplace. And that in turn depends on the union being perceived by the workforce as both representative and able to act independently. If the union cannot, it will not meet the needs of either employees or management—and could run the risk of being supplanted under the provisions of the new EU Directive on Information and Consultation with tougher requirements for compliance in terms of procedures for consultation and information disclosure.  相似文献

This paper examines whether there is a link between establishment closure and union presence using data from the 1984–90 panel sample of establishments of the Workplace Industrial Relations Survey. It considers whether the notion that unions damage long term performance and ultimately force uncompetitive establishments to shut down is a reasonable one.
I can find no evidence whatsoever for this hypothesis. There is no evidence that establishment closure and union presence are positively correlated. The relationship is usually negative and sometimes significantly so.
These results are important for at least two reasons: (i) it does not seem that unions have detrimental effects that force establishments to close down in the long run; (ii) the idea that union establishments have been dying at a faster rate forms no part of the explanation of the sharp union decline observed in the 1980s.  相似文献

This paper presents an evaluation of the ideologies and behaviour of the main union groupings in Hong Kong. The CTU's 'adversarial' line and 'inclusive' approach has threatened to break with the traditional industrial pacifism of Hong Kong's unions, while the FTU's recognition of its 'dual functioning' role has been balanced by the need to maintain credibility as an effective representative of workers' interests. The TUC has been passive in recent years, and the independent unions tend to be rather inward-looking. Unions remain weak, particularly at the workplace, and it is uncertain to what extent union autonomy can be sustained.  相似文献
