网络信息风险的刑法应对研究

网络时代科学技术的迅猛发展,人类步入了一个包括生态危机、全球经济危机、跨国恐怖危机以及网络安全危机等在内的全球风险社会。在全球化背景下,中国也无可避免地卷入了各种社会风险。作为现实生活的投射,网络在给人们带来巨大便利的同时,网络信息风险也影响着人们的生活。一些网络犯罪行为严重危害社会公共秩序,影响社会的稳定、有序、和谐发展。为应对网络信息风险,作为公法中最重要社会控制工具,刑法必然要作出回应。本文从网络行为特点、网络犯罪的表现形式入手,借鉴域外的信息风险规制模式,寻求较为合理地,符合法治精神的刑法应措施。     

信息互动关系有助于降低审计费用吗？——来自网络互动平台的经验证据

基于上交所“上证e互动”及深交所“互动易”网络互动平台中问答板块的爬虫数据,以2013—2018年沪深两市上市公司为样本,系统研究了上市公司与投资者信息互动对审计费用的影响。研究发现：网络互动平台上投资者提问次数、公司回答次数越多,公司回复率越高,问答间隔时间越短,上市公司信息披露程度就越高,而信息不对称程度降低,使得审计风险减小进而降低审计费用。结论可为信息互动和审计费用关系提供经验证据,推进网络互动平台信息在审计领域的研究。

近年来,网络互动平台在股票市场中扮演着重要的角色,其独特的信息披露方式,扩大了上市公司信息披露的范围,超越了传统法律强制披露的限制,加强了上市公司与投资者之间的联系,对投资者保护、上市公司发展以及信息披露制度的完善都产生重要影响。然而,在信息披露过程中,网络互动平台仍存在一些不足之处。基于此,梳理搭建和完善网络互动平台的意义,总结网络互动平台存在的不足,并结合时代的要求提出相关的完善建议,以期对后续的研究有所帮助。

针对重庆市缺乏全网联通、 多元互动的精准扶贫网络帮扶平台现状,建议依托重庆"群工系统",整合现有资源,建立重庆市精准扶贫多元互动网络帮扶平台,设置部门帮扶、 驻村帮扶、 信息发布、 群工论坛四大板块,实现"信息管理、 诉求反映、 社会互动"三大功能.     

上市公司积极与投资者互动：诚意还是策略

基于2015～2020年上市公司与投资者网络互动的问答文本展开实证研究，从微观层面探究上市公司积极与投资者进行网络信息互动背后的真实动机。研究发现，融资动机与市值管理动机驱动了上市公司积极与投资者进行网络信息互动，这意味着上市公司积极与投资者互动更偏向于是一种策略性行为，而非出于对投资者的诚意。进一步分析得出，网络媒体负面报道强化了上市公司融资动机与其网络互动积极性之间的关系；将样本按照股票错误定价程度进行分组回归后发现，只有当股票错误定价达到一定程度时，上市公司的市值管理动机才足以驱动其积极与投资者进行网络信息互动；此外，投资者的互动参与也是影响上市公司网络互动积极性的重要因素，具体表现为投资者的互动意愿越强烈，上市公司的互动行为越积极。     

网络环境下信息行为的特点及其失范行为约束策略研究

预防和惩治网络谣言问题的研究

网络谣言的本质是虚假信息,网络谣言的特点决定了其比传统谣言的危害更大,然而我国现行法律在规制网络谣言的问题上还存在着立法不足、惩治不严、控制不到位诸多问题.执法部门应当针对网络谣言的特点,一方面加强自身的日常监管,另一方面通过与立法机关、网络组织以及社会媒体等多方力量强强联手,才能严格长效的消除网络谣言生存的空间.     

The antecedents and consequences of charitable donation heterogeneity on social media

This study claims that donating is a rational behavior that balances altruism and self‐interest; therefore, the frequency and magnitude of donating are picked as crucial criteria to classify different crowdfunders because both of them reflect the rationality of donating. This study identifies 6 clusters of crowdfunders and explores the antecedent variables of the typology based on self‐system theory, as well as reveals the social influence of different types of crowdfunders. Data of the crowdfunders (n = 13,868) were collected from “Micro Philanthropy,” a popular SNS crowdfunding platform for charity in China. Social Network Service (SNS) profile information such as network features, social interaction features, and the identity of users was found to be significantly related to the typology. Active donors and bounteous donors are more influential than other donors in absorbing the attention of SNS users and attracting new donors.

计算机信息网络环境给图书馆信息资源结构、馆藏资源获取方式及质量评价标准、信息资源的保障方式、馆藏文献购置经费等方面带来了深刻的影响。适应网络环境的变化,图书馆在馆藏发展中应该更新传统藏书观念,合理配置馆藏资源和网络资源,加强馆藏资源的特色化建设和分工协调,建立起信息资源的社会保障体系,加大对信息资源建设的投入,并努力提高图书馆工作人员的素质。     

Social Network Analysis and the Sociology of Economics: Filling a Blind Spot with the Idea of Social Embeddedness

Today, social networks analysis has become a cross‐disciplinary subject with applications in diverse fields of social and economic life. Different network designs provide different opportunities to communicate, to receive information, and to create different structures of cultural capital. Network analysis explores modes and contents of exchanges between different agents when symbols, emotions, or goods and services are exchanged. The message of the article is that social network analysis provides a tool to foster the understanding of social dynamics, which enhances recent debate on a micro‐macro gap and on limitations of the cognitive and explanatory potential of economics.     

Understanding information exchange in healthcare operations: Evidence from hospitals and patients

Coordination – or the information exchange among physicians and hospital staff – is necessary for desirable patient outcomes in healthcare delivery. However, coordination is difficult because healthcare delivery processes are information intensive, complex and require interactions of hospitals with autonomous physicians working in multiple operational systems (i.e. multiple hospitals). We examine how three important variables distinctive of the healthcare operations context – use of IT for dissemination of test results (ITDR) (i.e. electronic health records systems) by physicians and hospital staff, social interaction ties among them, and physician employment – influence information exchange and patient perceptions of their care. Drawing from the literature on process inter-dependencies and coordination, vertical integration and social exchange, we develop and test research hypotheses linking ITDR, social interaction ties and physician employment to information exchange relationship, and information exchange relationship to provider–patient communication. Using a paired sample of primary survey data and secondary archival data from CMS HCAHPS for 173 hospitals in the USA, we find that increased information exchange relationship drives provider–patient communication, and increased social interaction ties drives information exchange relationship. Social interaction ties fully mediates the relationship between ITDR and information exchange relationship. Physician employment amplifies the link between ITDR and social interaction ties, but does not have an effect on the link between ITDR and information exchange. We do not find a direct relationship between ITDR, and information exchange relationship or provider–patient communication.

Measuring trustworthiness of information diffusion by risk discovery process in social networking services

Most of current social network services are vulnerable to malicious actions. For example, rumor (e.g., contaminated and distorted information) can be diffused along the social links. In this paper, given a social network service, we design a peer-to-peer (P2P) network, and propose a robust information diffusion model to efficiently detect the malicious peers from which a risk (i.e., rumor) has been generated on the P2P network. Thereby, by aggregating social interactions among users, a set of interaction sequences are obtained. Given a set of interaction sequences, statistical sequence mining method is exploited to discover a certain social position which provides peculiar patterns on the P2P networks. For evaluating the proposed method, we conducted two experimentations with NetLogo simulation platform for risk discovery on social network.     

基于WSN的卧室智能湿度控制系统设计与实现

本文设计并实现了一种基于无线传感器网络技术(WSN)的智能湿度控制系统,系统包含六个模块:WSN子节点模块、人机交互模块、主控模块、加湿干燥模块、GSM通信模块、手机系统终端模块。系统实时采集卧室当前湿度信息,并定时通过WSN子节点模块将某段时间的平均湿度数据传递给主控模块,将该数据与预设湿度值对比,若超过阀阈值则通过主控模块启动加湿干燥模块,并为该系统增加系统终端模块,使用者可以通过手机客户端随时查询当前湿度信息并控制加湿与干燥。     

THE ECONOMICS OF NETWORKS: A SURVEY OF THE EMPIRICAL LITERATURE

Abstract.  Network effects, the increase in value of consuming a product if many other consumers use the same product, are a feature of many markets and in particular of many high-technology products. This paper surveys the burgeoning empirical literature that has developed especially during the last years. After theoretical work dominated the earlier years of research in this area, newer research has combined theoretical models with empirical studies and applied work with direct implications for public policy, marketing and company strategies. Furthermore, insights from the study of social networks have been applied to analyse how consumers interact with each other. The paper argues that a closer analysis of the network structure of consumer interaction promises fruitful future research avenues and advances in our understanding of how network effects operate.
