中国新一轮BIT谈判的核心问题与应对

十八届三中全会通过了中国全面深化改革的战略,提出了“以改革促开放”,“加快同有关国家和地区商签投资协定”,同时明确了双边投资协定（BIT）的谈判是实现“以改革促开放”的重要手段。正是在这个背景下,中国同美国、欧盟积极进行双边投资协定谈判。     

基于FTA视角下中日韩国际贸易探索

2012年由美国主导的跨太平洋关系协议（TPP）谈判以及欧盟和美国之间的自由贸易区谈判已经启动。进入2013年后中日韩在制定FTA合作框架上有了较大进展,2月28日在中国哈尔滨正式启动中日韩自由贸易区谈判。中日韩为实现FTA已经迈开步伐,但三国的国际贸易方面存在一些问题,可以通过三国间最大限度取消关税,对涵盖投资、政府采购、非关税壁垒、知识产权;扩大中国东北地区与日本韩国合作地域;构建东北亚经济共同体来实现优化。     

《中欧双边投资协定》任重道远

《中欧双边投资协定》是在欧盟共同投资政策正在形成期时协商谈判的第一批欧盟层面的双边投资协定之一,也是目前唯一以单独的投资协定形式进行协商谈判的欧盟双边投资协定。对于中国而言,主要的挑战将是如何在吸引外资的同时兼顾保护特殊行业以及如何适应中国对欧盟投资增加的趋势,为中国的海外投资开拓更多的途径、争取更高程度的保护。

仍呈增势--欧盟对华直接投资现状分析

在中国利用外资的国别和地区中,欧盟是仅次于亚洲十国/地区、美国,成为中国利用外资的第三大来源.自1979年以来,截止到2000年底,在中国吸收外商直接投资项目总数(363885个)中,欧盟位居第三,占全部外资项目比重为3.13%,低于亚洲十国/地区81.71%、美国8.60%;在中国吸收外资合同总金额(6760.97亿美元)中,欧盟也位居第三,所占比重为7.46%,低于亚洲十国/地区72.82%、美国10.14%;在中国实际利用外资总金额(3483.46亿美元)中,欧盟仍然位居第三,占全国比重为7.48%,低于亚洲十国/地区75.10%、美国9.29%.但是,自1997年以来,欧盟对华实际投资持续超过美国;2000年欧盟对华合同投资也超过美国,成为中国利用外资第二大来源.     

欧盟国际投资规则的源与流

欧盟在其近年来的国际投资协定谈判中,提出了不少对国际投资规则进行革新的内容。中国为应对将来中欧自由贸易协定谈判,除了分析欧盟国际投资规则本身之外,更应该对欧盟国际投资规则的形成与发展趋势有清晰的把握。欧盟投资规则的形成受到《里斯本条约》的影响,在发展过程中欧盟法院又起到了至关重要的作用。同时,欧盟的国际投资规则发展面临着一致性问题的影响。欧盟如何协调内部投资规则的冲突,如何协调欧盟与欧盟成员在外部的国际投资仲裁中的主体地位等问题都将影响着欧盟国际投资规则的发展,更影响着中国应对中欧双边贸易投资规则的谈判策略。     

建立中国-新西兰自由贸易区的经济效应

在区域经济一体化的背景下,中国和新西兰亚启动了建立自由贸易区(FTA)的谈判。如果两国正式建立FTA,将会进一步提升两国经贸关系。中新两国的经济具有互补性特征,FTA的建立对两国的货物贸易、服务贸易和投资都将产生正面效应。     

韩国与欧盟已草签FTA,生效后双边贸易将增20%

韩国和欧盟（EU）于2009年10月15日草签了自由贸易协定（FTA）。韩国外交通商部通商交涉本部部长金宗埙和欧盟贸易委员会委员凯瑟琳·阿斯顿当天上午在比利时布鲁塞尔草签了韩欧盟自由贸易协定。草签是确定自由贸易协定谈判内容的阶段，意味着今后协议文本不会有改变。此协议的达成，意味着韩国已成为第一个与欧盟签署FTA的亚洲国家。     

《中欧全面投资协定》ISDS机制：欧盟方案与中国选择

2020年年末，中国和欧盟完成了《中欧全面投资协定》的谈判进程，但投资者与国家争端解决(ISDS)机制还有待后续谈判。欧盟的ISDS机制立场已经十分清晰，即以具有公法化属性的常设性、两审制的投资法庭机制替代传统的国际投资仲裁，旨在保障欧盟及其成员国的规制权与推动ISDS机制的欧洲化改造，最终提升欧盟在国际投资治理领域的话语权。有别于欧盟，中国在ISDS机制上的基本立场应更加侧重于对本国投资者在欧盟投资利益的保护，因此在ISDS机制的具体设计上不宜照搬欧盟的投资法庭机制，一方面应对其部分组成事项进行优化，另一方面也应适当保留国际投资仲裁的部分要素。

China's Auto Industry Steps Forward

Domino Effect on Electricity and Coal Prices

In the middle of last December, the key purchase contracts for coal used in power generation in 2008 were signed, reflecting a demand for more than 1.085 billion tons. It is important to note that the country＇s five biggest power producers, China Huaneng Group, China Guodian Corporation, China Power Investment Corporation, China Huadian Corporation and China Datang Corporation, had settled on the prices on their purchase contracts, and they are expected to consume 290 million tons of coal for generating electricity,
