胡锦涛总书记强调：＂要切实发展和谐劳动关系,建立健全劳动关系协调机制,完善劳动保护机制,让广大劳动群众实现体面劳动。＂温家宝总理在政府工作报告中指出：＂我们所做的一切都是要让人民生活得更加幸福、更有尊严,让社会更加公正、更加和谐。＂两位国家领导人的讲话,既为新形势下的劳动就业工作提出了新思路,更为劳动保障监察工作提出了新要求。作为劳动保障监察工作者,要在维权维稳,推进劳动监察法制化建设的同时,督导各类用人单位加大改善生产环境的力度,为劳动者实现体面劳动奠定基础。     

我国非标准劳动关系问题探讨

本文在阐述标准劳动关系的基础上,分析了非标准劳动关系的若干要素特征,提出了以标准劳动关系为中心的劳动立法模式向以标准劳动关系和非标准劳动关系并重的劳动立法模式演进建议。

非标准劳动关系的管理及风险防范

传统的非标准劳动关系主要包括劳务派遣和非全日制用工两种形式。由于《劳动合同法》对劳务派遣这一用工模式进行了超标准劳动关系的规范,使得用工单位在采用这种用工模式时,存在了巨大的劳动用工风险,承担超标准劳动关系的劳动管理义务。因此、基于对《劳动合同法》对劳务派遣的诸多法律规定的梳理,提出企业在采用这种用工方式时应采取的应对措施,并提出企业应探索采用外包这一新的劳动用工模式。

在一如既往关注充分就业改革的同时,促进体面劳动的一个内容是更多地关注劳动者的社会权利、就业公平、社会保障和社会对话问题。去年“五一”前夕,国家主席胡锦涛发表讲话：“要切实发展和谐劳动关系,建立健全劳动关系协调机制,完善劳动保护机制,让广大劳动群众实现体面劳动。”     

浅谈工会为员工实现体面劳动与尊严生活创造条件

Transitions From School to Work and the Early Labour Market Experience

We consider transitions from school to work and the early market experience. The duration of post-school unemployment, wages, and job duration are estimated simultaneously. We find that individuals with higher levels ofschooling get jobs more quickly and have longer employment durations. Apprentices have shorter unemployment periods and stay longer in their jobs than others at the same educational level. Females have shorter unemployment periods and lower wages, and also stay in the first job longer. The unemployment duration and the accepted wage affect job duration positively, but the estimated covariance terms suggest unobserved factors working in the opposite direction.     

Do Labour Market Programmes Speed up the Return to Work?*

We evaluate the impact of labour market programmes on unemployment durations in Norway, by means of a distribution‐free mixed proportional competing risks hazard rate model. We find that programme participation, once completed, improves employment prospects, but that there is often an opportunity cost in the form of a lock‐in effect during participation. The average net effect of programme participation on the length of the job search period is found to be around zero. For participants with poor employment prospects, the favourable post‐programme effects outweigh the negative lock‐in effects.     

Heterogeneity in Labour Supply Responses: Evidence from a Major Tax Reform

We use a large and rich administrative household panel data set to estimate labour supply responses for a large number of subgroups in the Netherlands. The identification of the parameters benefits from a major tax reform in the data period. We uncover large differences in behavioural responses. In particular, we find differences in labour supply responses between households with and without children that are much bigger than suggested by previous studies that had to pool these household types in the estimation of preferences. An efficient tax‐benefit system should take the substantial heterogeneity in behavioural responses into account.     

Separating the Wheat from the Chaff: Icelandic and Irish Policy Responses to the Banking Crisis

When the stories of the Icelandic and Irish crises are told, they are framed as if one country did everything right to exit recession and the other country everything wrong. This article assesses their recovery policies and finds that the truth lies somewhere in between. By allowing its banking system to suffer substantial losses, Iceland shielded its citizens from the costly debt overhang apparent in Ireland. Ireland's commitment to open capital markets and price deflation has allowed trade flows to remain robust, and relative prices to realign to signal sustainable production plans to entrepreneurs. These responses provide a roadmap for other small open economies with large financial sectors entering similar crises in the future.
