This study argues that where land-use planning of any kind is conducted, it plays a supporting role that enables the property formation process to be effective. It uses evidence from Makongo Juu Settlement (in Tanzania) to reveal that the participation of actors with various levels of tenure awareness is necessary for property formation (land parceling). As the study is case-study focused, it uses data collected through a mix of procedures—including in-depth interviews, survey questionnaires, and documentary processes—analyzed qualitatively. Findings confirm that land-use planning introduces or embeds formal rules and regulations that govern the use of land. Furthermore, the study presents the affected persons’ narratives of their involvement in the property formation process. This medium allowed for an understanding of their perspectives of the property formation in the context of land-use planning. Apart from these empirical revelations (among other findings), the study contributes to land administration and land management literature in three ways. First, it outlines a typical outlook of formal and informal land development processes. Second, it deconstructs property formation in the context of land-use planning in an informal settlement. Thirdly, it presents the typical categories of actors (including their roles and viewpoints) in the participatory property formation process in an informal settlement. The study recommends that cadastral surveying (Property formation) and land-use planning should be better integrated for the formalization of property rights. This recommendation is considered necessary because there is evidence that land-use planning assigns rights (including restrictions and obligations or responsibilities) that owners and users of land have to follow in the property formation process. 相似文献

Insufficient land supply and housing shortage limit the development in Hong Kong. To tackle such obstacles, the Hong Kong government launched a new housing initiative in June 2018, that is, to reallocate private housing sites for public housing in East Kowloon. Yet, the initiative may give rise to two important questions: (1) how does this initiative affect the housing searching behaviour in the housing market; and (2) in what way should the new public housing be developed, if it is to be compatible with the host neighborhood - by the public sector, or with the participation of the private sector. Little is known about the possible impacts of such an initiative.To fill this research gap, this paper adopts an improved spatial econometric model by incorporating spatial and temporal information to explore the above two questions. Our results indicate that (1) the announcement of the initiative leads to a 5% change in time-on-market for private housing in East Kowloon; (2) people in private property prefer more to live near public housing developed by the private sector. These findings somehow echo the invasion theory of urban change: Neighborhood changes in private housing areas will spill-over to adjacent urban areas. 相似文献

Mounting exclusionary forces have made the task of achieving equity in urban land delivery more elusive than it has ever been. Statistics show that, in practice, most land for urban development (especially that occupied by the poor) is supplied outside state regulatory frameworks and there is overwhelming evidence of the importance of secure access to land and housing to the livelihood strategies of poor urban households. This paper, therefore, explores the issue of equity in informal channels of land delivery by drawing from insights gained from a recently concluded DFID-funded research of informal land delivery processes and access to land for the poor in Enugu, Nigeria. It finds that escalating costs and the resistance of pre-capitalist elements (some aspects of traditional culture) have meant that informal channels of land delivery are increasingly failing to meet equity concerns in providing access to land in cities, and that poor city immigrants and other vulnerable groups, especially women, are particularly disadvantaged. 相似文献

Informal development on farmland is not only a major problem facing thousands of people, but also a major challenge to land use planning. In the rapidly growing literature on informal land development in China, most authors claim that ambiguous property rights and the dual land tenure system are the primary factors involved. As a result, existing state-led land use planning responses to informal development are solely focused on strengthening the legal regulation of land development. This paper challenges this approach, on the basis of the theory of urban informality. By examining many illegal gated communities in suburban Beijing, the paper argues that the informal development of farmland on the urban fringe is the result of local grassroots groups spontaneously responding to socioeconomic inequities in the context of transition to a market economy. These inequities mainly concern distributive inequity, procedural inequity and contextual inequity in relation to land use. It appears that the ongoing market-oriented initiatives of the state government could worsen informal land development unless these socioeconomic inequalities at the local level are tackled. The growing civil society is another change to the state's control of informal land development in China's cities. A new land use planning system which has more concern for social inclusion rather than focusing on centralized control is imperative in China. 相似文献

Much of 3D cadastre research and development targets high valued urban land, including condominiums, apartment buildings, and office complexes. The value of the land and the economic activity generated from transactions in this urban space potentially support the cost and time spent on establishing and maintaining a 3D cadastre. Methods for data acquisition and for construction and maintenance of the 3D cadastre are also simpler in the regular and formally planned and surveyed structures of the high value urban environment. Low-income, urban areas of informal tenure and informal development, however, also need and can benefit from a land administration system supported by a 3D cadastre but are neglected in the 3D cadastre research. Mechanisms are required for quick and cost effective construction of a 3D cadastre in this type of area to support land management and regularisation procedures, and to provide security of tenure. Light Detection and Ranging (LiDAR) is one technology that may be examined to differentiate structures in densely occupied environments where limited information and limited resources must be able to be used for managing the land and also protecting informal rights.This paper initially posits the need for 3D cadastres in low-income but densely structured urban settlements. It then tests the ability of an existing LiDAR dataset together with orthoimagery, derived to be low cost so therefore having limited specifications, for capturing sufficient definition of 3D occupation in the low-income, densely structured case study area of Laventille in Trinidad and Tobago.The difficulties of manually or automatically discriminating between close and overlapping structures and boundaries are highlighted and it is found that there is still a need for adjudication and verification of boundaries on the ground, even when physical features can be discerned from the software. 相似文献

Since the housing market reform in 1998, China has experienced a rapid growth. Continuous surges in housing prices have been criticized by the public. In light of deviation of the price from its intrinsic value, the central government implements a series of policies to intervene the housing market, but makes little difference. Little vigorous academic work on the price anomaly and impact of macro-control measures has been conducted for housing markets in urban China. This research employs econometric methodologies to investigate the interactions between housing price and market fundamentals, in order to identify the existence of price anomaly in the housing markets of Beijing and Shanghai during 1998–2012. In addition, we conduct asymmetry analysis based on an advanced econometric model to investigate the impact of macro-control measures on price and volume. Our findings suggest that the market inefficiency is indicated by lack of interaction between housing supply and demand in Beijing and Shanghai. The opposite directions of impulse responses of price to income in the two cities are mainly attributed to the different market structures. While price anomalies are found occasionally, the housing prices are considered reasonable in Beijing and Shanghai for most of the time. Furthermore, the analysis on the role of macro-control policies in Chinese housing markets reveals that government interventions regulate the market ineffectively at the current stage. 相似文献

Though Ethiopia is one of the least urbanized countries of the world, its urban areas are expanding rapidly. Woldia, which is a Zonal town is no exception to this trend and situation. As a result of its rapid horizontal expansion and growth, Woldia is currently confronted with different types of urban problems. The emergence and growth of informal settlements is one of these challenges. To that end, this paper investigates the foremost demographic and socio-economic triggering factors that played key roles for the growth of informal settlements at the peri-urban areas of Woldia. In order to achieve the objective of the study, a questionnaire survey covering a total of 244 sample households was carried out in addition to in-depth interviews, FGDs and key informants. Accordingly, the income disparity; the rise in the lease price of urban land, and the meager compensation paid to peri-urban farmers during their lands expropriation are among the key economic drivers for the growth of informal settlements. Similarly, ever-increasing urban population and inefficient land provision, and lack of housing affordability compounded by the rise in the rental accommodation are the other triggers factors. All these factors, among others, point to the fact that socio-economic and demographic factors are all tied to the immediate growth of such settlements. Thus, lands at the periphery are misused and the situation has greatly contributed to the unlawful and rapid expansion of built-up areas in the city administration. 相似文献

The aim of this article is to analyze the effectiveness of land-use policy in Mexico City in controlling the expansion of informal human settlements in peri-urban zones of high ecological value. It is argued that Mexico City's land-use policy has been reactive and internally inconsistent, failing to take informal settlements into account, has not offered the poor access to housing with adequate services and greater security in terms of land tenure, and lacks the necessary financial resources and institutional capabilities for providing solutions to these problems. Through a case study of informal settlement management policy in the Tlalpan Delegation,1 applied in what has been termed SC or “Conservation Land,”2 we conclude that local government exhibits an inability to confront the new challenge of urban sustainability, that it resorts to conventional solutions which give rise to contradictory situations where political decision-making prevails over ecological considerations, so land-use policy is permissive and does not halt informal urban expansion in areas of high environmental value. 相似文献

Summary Although free enterprise remains the dominant characteristic of the Hong Kong economy, new land supply is controlled largely by the Hong Kong Government. Rather than establish a detailed system of development plans and controls, the Government has been able to achieve substantial decentralization of housing and industry through the location of new land release. The evidence suggests that industrial developers have been willing to build and industrialists to locate in decentralized areas, especially those close to the main urban areas. Furthermore, although vacancy rates are generally higher and rental levels lower in decentralized compared to centralized locations, the extent of the differences over time is not as pronounced as might be expected. Indeed, the overall strength of demand for industrial land, other than in the recent slump, has necessitated special policies to protect land for low‐density industrial users in decentralized locations. As planned decentralization approaches completion, attention is beginning to focus upon redevelopment in the older urban areas and upon the consequences of the Sino‐British Joint Declaration of 1985. Overall, recent land policies in Hong Kong offer the British observer some useful indications of the impact of government intervention in land use on existing property markets. 相似文献

Land distribution is the main core of economic development analysis. The main objectives of land distribution are the improvement of living standards in rural areas, redistribution of land by developing new land registration, redistributing income through job creation, and increasing the productivity of agricultural products. This paper discusses different land distribution programs and outlines the major demands for development theories. It delivers a review of land policies and rigorous case-studies evidence from a global perspective. It also presents a review of historical and sociopolitical literature to evaluate the trend of land distribution, agro-ecological potential of development theories, and various policy debates on land use. In addition, the paper provides a coherent review of case studies to analyze different development theories regarding the concept of land distribution. This paper concludes that development theories support multiple understandings of property rights, including community and policy debates regarding poverty alleviation in poor regions. Moreover, it conceptualized that development theories are urgently needed to prevent people from being driven out of their land. However, it is unlikely that land distribution is the most efficient policy and political framework in contexts. Therefore, traditional land distribution programs need to be revised considering development theories. 相似文献

This paper provides household level evidence of the institutions that are developing to provide security of access to land for housing within the settlements of Port Moresby, the capital of Papua New Guinea. Data collected from a survey of 441 randomly selected households shows that households organise around regional, family, and professional cleavages to provide security to person and property. Further, some households pay rent to landlords and keep evidence of the above to legitimise their claims to the land settled upon. In one case, a community has formed an organisation to mediate between the settlers and the customary landowning group. The above is evidence of the maturation of institutions to provide tenure security. It also provides the opportunity for policymakers to adopt and then adapt (migrate) the existing institutions into the formal system as part of ongoing reforms. 相似文献

This article examines informal housing/non-compliant development and related formalisation practices in Turkey. An in-depth policy analysis is conducted within a historical framework to underline outcomes and policy performance of approaches and formalisation initiatives. The analysis was conducted by taking the earlier studies focusing on the formalisation practices and debates in the international literature into consideration in order to understand how the case of Turkey confirms, contradicts or adds to the existing body of the literature. Formalisation practices in Turkey, especially the recent one implemented in 2018, have been successful to secure land tenure rights to a certain extent. However, these attempts have not addressed the issues such as mitigating hazard risks, enabling public participation, managing the processes transparently and inspecting the non-compliant development put forward by the scholars. The outcomes of the policy analysis are compared with the approaches of transition and developed economies in Mediterranean Basin. As a result of these comparisons, remarkable similarities were found. The findings of the analysis can be a harbinger of the future for other countries on a rapid development path by means of a considerable policy exchange between countries with similar population and GDP. 相似文献

This paper considers rural land use by analysing stakeholder values and perceptions concerning various landscape components. The purpose is to show that landscape content and land cover interactions with societal connections should be a base for land use development. The practical goal is to deliberate research tools to quantify public opinions and attitudes, which could form bases for developing of decision support tools. The main research objectives are: (1) to assess existing opinions concerning land use changes and provide a clearer insight into public attitudes to the role of woodlands for an integrated development of the countryside; (2) to place ecological and socio-economic values on inanimate natural components of landscapes; and (3) to assess values and preferences held by land use policy and management experts regarding multiple landscape components and features to assist in decision-making. Through the different levels of importance (values) accorded by the respondents to the integration of nature components in rural landscapes public priorities were identified. The paper develops an understanding of why certain aspects of land use changes are unfavourably viewed by some people and favourably received by others. It suggests some innovative perspectives on the areas of consensus and conflict between people, providing initial information for the selection and evaluation of land use management decisions. 相似文献

The Special Issue (SI) “Environmental Risk Mitigation for Sustainable Land Use Development” presents seventeen interrelated papers addressing the key concept of environmental risk mitigation and sustainable land use development. The issue argues that risk mitigation depends directly on the risk assessment analysis and the quality of applied measures. Therefore, the more precise are risk assessment conclusions, the better the risk mitigation measures would be. This collection of papers follows the vision of the Sendai Framework for Disaster Risk Reduction 2015–2030 (Sendai Framework) which states that the integration of sustainable development objectives into disaster risk mitigation and adaptation at all levels and at all stages of policy action are of paramount importance for the sustainability of our communities. Extant research on guerilla gardening, defined as the unauthorized cultivation of land belonging to another, has hitherto focused on public space in urban areas, neglecting those that occur in rural settings. This rural land policy study examines a form of guerilla gardening in the countryside in Hong Kong, carried out by specific walker communities who routinely do early morning walks. Most of the gardens they have cultivated have become part of country park protected areas. This study identifies five phases of land use status evolution undergone by these morning walkers’ gardens (MWG), from the time the phenomenon of guerilla gardening in the countryside began in the 1960s to recent times, illustrating the role of land use change in enabling squatters with a degree of property rights by way of informal land resource co-management. Through the three case studies presented in this article, it is argued that MWGs can represent the emergence of incipient forms of natural resource co-management in Hong Kong. This study emphasizes the important role of resource user leadership in enhancing the land use value of land in itself and for the wider community. Impact of formalisation of property rights in informal settlements: Evidence from Dar es Salaam city
This paper aims to study the responsiveness of the informal property market and management systems towards the introduction of land registration for informal settlements in Tanzania. City governments are increasingly recognising the need to strengthen legal rights for the urban poor as a means to bring them more effectively into the urban economy and ensure better provision of water, sanitation and other primary services. The research focuses on Tanzania and in particular two case studies within Dar es Salaam. The findings of the work suggest that the introduction of residential licenses whilst potentially assisting in creating legal certainty has not resulted in the financial sector accepting them as full security against loans. Accessing credit by the poor however has not yet been fully realised resulting in some further hurdles for the financial sector to overcome. Finally, and of some significance is the registration of property in the informal settlements has provided the opportunity of formal property transactions within these settlements. 相似文献

In the context of the peripheral European rural landscapes, the role of the urban population, generally referred to as the ‘outsiders’, has shown to be influential in the dynamics of rural space. This influence occurs namely through the demand for non-productive functions leading to the emergence of new modes of occupancy. In addition, the emerging policy framework concerning policies and planning in rural landscapes call for an improved understanding of the diversified social demands for these landscapes. We argue that a more profound knowledge on the urban demand for rural landscape is needed to better integrate the urban interests into rural policy and planning. The present paper aims to gain greater insight on this demand by identifying landscape preferences of urban users, framed by the multifunctional transition theory, and using a photo-based survey with contrasting land covers derived from CORINE Land Cover classes. Furthermore, the use of land cover classes as the main landscape component, and thereby relating preferences to specific land covers, offers a sound basis for a territorial approach, able to integrate landscape into rural policy and land use planning practice. A case-study in Southern Portugal was developed at the regional scale and results showed different appreciation patterns for rural landscapes varying from humanised and more naturalised landscapes according to the different functions sought by urban users. Another prominent result is that urban demand for rural landscapes, even if driven by consumption, is strongly influenced by both protection and production values. A deeper knowledge on the interests of urban population can be a step forward for rural communities, land managers, and sectoral policy decision-makers to better define investment strategies in rural-urban partnerships facing the growing urban demand over rural space. 相似文献

With growing awareness of fire hazard as an environmental threat within tropical rainforests, the state of Brazil initiated a set of fire control policies aimed at monitoring and ameliorating fire hazard in the Amazon region. These policies were developed in the aftermath of large-scale fire events and reflect a conservationist discourse that responded to internal as well as international environmental concerns. In doing so, the policies have framed the “fire problem” around those who use fire in their land use practices, in particular small-scale agriculturalists. Yet, land policy in general has repeatedly failed to address the institutional arrangements which compel small-scale farmers to use fire in their agricultural practices and the underlying development processes that have made the landscape more vulnerable to accidental spread of fire. Using regional level data on small-scale farmers, I suggest that the conservation oriented approach of fire policy may not be enough to curtail accidental fire events and instead that the fire issue needs to be positioned within rural development as well. 相似文献

研究目的:评析近年房地产调控中的土地政策效果,为提高土地政策宏观调控效果提供政策建议。研究方法:文献资料法、数据统计法、归纳分析法。研究结果:目前的土地政策主要集中在保障用地供应、促进闲置土地开发和完善土地出让方式三方面,土地政策条款重复度高、调控效果不佳。研究结论:为保障土地政策的调控效果,稳定地价和房价,应在加大土地供应总量的前提下调整土地供应结构;加强政策的监管和检查力度,保障政策的执行效力;应从货币、税收、土地供应等手段入手,多管齐下调控地价和房价。 相似文献
