对于新时代的女性,追求与男性平等的享受各种权利已经成为现实。妇女的劳动权利和利益越来越受到社会的关注,不仅仅是广大妇女,包括男性,也从不同的角度关注妇女劳动权益的实现。本文从对妇女劳动权的界定出发,分析了我国目前妇女劳动权益保护的现状以及存在的问题,最后针对这些问题,提出了完善我国妇女劳动权益保护的几点建议。 相似文献

由于实践中存在着大量的事实劳动关系,我国在劳动法颁布不久就对事实劳动关系是否受法律保护作了明确的规定.但事实劳动关系在审理劳动争议案件中有时很难认定,为此2008年的<劳动合同法>对事实劳动关系的保护进行了强化.为保护事实劳动关系中劳动者的权益,应当继续完善有关保护事实劳动关系的法律制度. 相似文献

劳动者权益保护的问题既是重要法律问题,也是重要社会问题。当前,现行《劳动合同法》劳动者权益保护存在缺陷,企业裁员对劳动者权益损害严重,过渡条款适用对劳动者产生不利影响。完善《劳动合同法》对劳动者合法权益保护,应重视农民工权益的保护,提高裁员后对劳动者的经济补偿水平,加强对过渡条款适用范围限制,从劳动合同签订的主体入手,加强其法律意识,从根本上解决法律缺陷对劳动者权益带来损害。 相似文献

Sex-role stereotypes exist as a primary source of gender inequality in employment. This issue becomes even more salient in the social context of China, where the traditional view of female inferiority persists and the legal system provides inadequate protection of equal employment rights. Reporting a content analysis of Chinese recruitment advertisements, this article concludes that gender discrimination is practiced by Chinese employers in recruiting for white-collar positions. It also finds that female applicants are more likely to encounter other forms of discrimination such as age and physical appearance requirements as well. 相似文献

农民工为我国经济发展做出了巨大贡献,但农民工受歧视的问题却非常严重,既损害了农民工的合法权益,也严重影响了经济的健康发展和社会的和谐。农民工在城市中所遭受的歧视主要表现在就业歧视、社会保障歧视、教育歧视,根源在于城乡分割的二元制度。为解决农民工受歧视问题,应从改革户籍制度入手,加快制度创新,创建平等的就业机制,完善社会保障制度。 相似文献

A developing area of interest in ethics and in legal studies is privacy protection. This paper focuses on privacy protection in employment, and examines some of the arguments of commentators who seek to limit the information obtained from job candidates and employees. The ethical underpinnings of these restrictions are discussed in terms of how privacy in employment relations can be understood as functioning to provide a context for the maintenance and development of self-identity, an autonomous self-concept, the practice of meaningful autonomy, and a pluralistic social order. In the second part of the paper the proposed restrictions are examined in terms of their impact on economic welfare. The latter consideration suggests that HRM and allied professional groupings that unilaterally implemented the critics' proposals could be deemed to be paternalistic. The potential relevance of legal regulation to resolve this issue for 'ethical' HRM professional practice and its significance in the area of genetic discrimination are discussed. 相似文献

The ethical issues involved in bankruptcy affect the debtor, the creditor and the society in which they operate. Facing the debtor is his responsibility to pay back the loans and credit extended to him while the creditor has to decide whether or not to press his legal rights, irrespective of the consequences to the debtor. Society will have to determine to what extent, if any, it is prepared or obligated to fund the rehabilitation of the debtor and those employees, whose employment is terminated as a result of the bankruptcy. These issues will be determined according to the value structure of the particular souly in which debtor and creditor operate. This paper views the issues in a Jewish perspective. Debtors are considered to always be liable for their debts and there is a moral shame attached to bankruptcy, except in those cases where it is caused by natural disasters. While creditors are taught and encouraged to voluntarily waive their rights, this is considered charity with all its negative overtones. The courts are obligated to review the debtors assets and sell them, if necessary, to meet the creditors loans, leaving only basic necessities for minimal living of the debtor and his family. Society however, including the creditor, a part of the group, are obligated to fund the rehabilitation of the debtor either through its interest-free loan, charity or the provision of alternative employment. These may be funded out of communal taxes.

It has become increasingly certain that the success of e-commerce in any country depends mainly on the predictability and
suitability of the legal framework and whether such framework copes sensibly with the needs of online consumers. For e-commerce
to reach its full potential, consumers must have effective protection when shopping online, and their primary rights must
be adequately protected. This paper thus explores the way in which the Electronic Transactions Law deals with such rights
and determine whether or not this law gives due attention to consumer protection in an online environment. Furthermore, this
paper encourages debate of what such law should be in order to enhance legal certainty as well as increase trust in e-commerce
in Jordan. This paper, however, is not intended to provide the final answer to all questions and challenges in this regard,
