Consumer policy in the European Community: Before and after Maastricht   总被引:1,自引:0,他引:1  
The purpose of this paper is to examine the extent to which the Treaty on European Union agreed at Maastricht will alter European Community consumer protection law and policy. Two aspects of the Treaty have attracted most interest from the consumer viewpoint: the potential forward impetus resulting from the inclusion in the Treaty of a specific Title devoted to consumer protection and the potential reverse impetus of the principle of subsidiarity. The paper surveys the broad scope of Community consumer protection law and policy and analyses subsidiarity as a means for sharpening the debate about responsibility for regulating the Community, not as a basis for renationalisation of Community competence. The paper attempts to build alongside the process of market integration a set of enforceable consumer rights to market regulation. This, more than the new Title, could give real shape to the notion of consumer rights, which in the earlier development of Community law has arisen only in the context of the consumer as the passive beneficiary of free trade.
Verbraucherpolitik in der europäischen Gemeinschaft: Vor und nach Maastricht
Zusammenfassung Der Beitrag beschäftigt sich mit der Frage, wie stark sich der Unionsvertrag von Maastricht auf Recht und Politik des Verbraucherschutzes der Europäischen Gemeinschaft auswirken wird. Zwei Aspekte des Vertrages haben aus Verbrauchersicht das stärkste Interesse auf sich gezogen: zum einen mögliche förderliche Wirkungen durch die Einbeziehung eines speziellen Titels in den Vertrag, der dem Verbraucherschutz gewidmet ist, und zum anderen mögliche hinderliche Wirkungen durch das Subsidiaritätsprinzip. Der Beitrag bietet einen überblick über die gesamte Bandbreite der Verbraucherschutzgesetzgebung und der Verbraucherpolitik der Gemeinschaft und analysiert Subsidiarität eher als Hilfe zur Schärfung der Debatte über die Verantwortlichkeit für Regulierung und nicht so sehr als Ausgangspunkt für eine Re-Nationalisierung der Zuständigkeiten der Gemeinschaft. Er versucht, entlang des Integrationsprozesses einen Satz von durchsetzbaren Verbraucherrechten in Hinblick auf Marktregulierung zu entwickeln. Dem Konzept der Verbraucherrechte könnte dieser Ansatz besser eine realistische Gestalt geben als der neue Titel im Vertrag.

In recent years significant progress has been made towards European monetary integration. Widespread agreement as to the role of monetary policy has been established and there were no realignments of exchange rates within the European Monetary System between March 1983 and July 1985. This was the longest period without realignment in the EMS and contrasted sharply with the six realignments observed in the four years previously. In the last five years the European Union has developed at a speed unknown since its beginnings in the Fifties. As a result, the EU is participating in the last three reserves of the European nation state's sovereignty: the currency, the judiciary and the military. The remarkable increase in trade flows and in migratory flows of highly educated people are two important features of globalization of the last decades. This paper extends a two-country model of inter- and intra-industry trade to a rich environment featuring technological differences, skill differences and the possibility of international labor mobility. The model is used to explain the patterns of trade and migration as countries remove barriers to trade and to labor mobility. We parameterize the model to match the features of the Western and Eastern European members of the EU and analyze first the effects of the trade liberalization which occurred between 1989 and 2004, and then the gains and losses from migration which are expected to occur if legal barriers to labor mobility are substantially reduced. The lower barriers to migration would result in significant migration of skilled workers from Eastern European countries. Interestingly, this would not only benefit the migrants and most Western European workers but, via trade, it would also benefit the workers remaining in Eastern Europe.  相似文献

Abstract

This article describes how import of ideas and practices influence an industry that is in an early stage of internationalization, as well as part of European integration. By using institutional theory, such a situation is depicted as an expansion of the organizational field, in which international isomorphism between organizations has commenced. Studying Swedish grocery retailing, a new set of ideas was found regarding what constitutes an efficient organization. This included centralization, vertical integration and brand management, and it was strongly influenced by foreign actors and markets. We conclude that isomorphism occurs in a decreasingly national field, although not entirely pan-European in character, and that international diffusion of ideas and practices reshape markets, partly independent of goods and capital flows.  相似文献

From the perspective of regional economic integration we decompose international strategy into regional integration strategy and three types of global strategy (global sales, global production, and pure global integration). Using 1100 firm-year observations we find that 60% of the largest European firms pursue a regional integration strategy. We also find that global strategies vary. We examine the firm specific factors that affect global strategies. In general, R&D capability determines a global production strategy, whereas firm size and managerial capability determine both a global sales strategy and a pure global integration strategy.  相似文献

Although it has been argued that the governmental environment has an important influence on corporate activities, limited systematic and empirical research has been undertaken to study this relationship. This is especially true for regional integration efforts where it is widely assumed that enterprises (and particularly transnational ones) quickly take advantage of new regional opportunities created by government policies. This article examines therefore the question of whether or not integration (more specifically, the European community) affects the behavior of corporate elite members in the Federal Republic of Germany and their enterprises-important nongovernmental actors within the integrating area. First, a theoretical framework is introduced that analytically and phenomenally distinguishes formal governmental and behavioral aspects of integration. Subsequent analysis suggests, among other things, that the strategies of enterprises do not necessarily follow (respond to) governmental integration. The impact of governmental integration on the attitudes and behavior of nongovernmental actors appears to be limited, selective, and uneven in character.  相似文献

To analyze Ukraine's deep and comprehensive integration with the EU, we develop a multi-regional general-equilibrium simulation model incorporating heterogeneous firms and Foreign Direct Investment (FDI) in business services. This allows for consideration of (a) trade growth in new varieties; (b) aggregate productivity changes attributed to reallocation of resources across and within an industry; and (c) productivity growth in manufacturing due to increased access to business services. The results indicate relatively small gains for the EU, whereas Ukraine benefits with a welfare increase of over 8%. The deindustrialization impact, previously found by Olekseyuk and Balistreri (2014 Olekseyuk, Z., and E.J. Balistreri. 2014. “Trade Liberalization Gains under Different Trade Theories: A Case Study for Ukraine.” Working Paper 2014-13. Colorado School of Mines, Division of Economics and Business. Golden. [Google Scholar]) in a comparison of different modeling structures, is supported by our findings. Ukraine's welfare gains are higher under an Armington structure compared to monopolistic competition. This is due to a movement of resources into Ukraine's traditional export sectors producing under constant returns. Implementation of the FDI modeling approach and liberalization of barriers to FDI, however, mitigates the deindustrialization impact as multinational firms enter the Ukrainian market. This increases the number of available varieties and, consequently, induces productivity growth of manufacturing sectors due to improved access to business services as critical inputs.  相似文献
