在国际贸易交往中，交易双方往往是地处不同国家的经济主体。由于目前国际社会尚无统一的立法机构，也就还没有为国际社会普遍承认和接受的统一适用于各类合同的国际合同法。那么，就合同本身而言，究竟应遵循什么法律呢？对此问题，各国的有关国际私法规则均认为：合同当事人可以选择合同的准据法；若当事人未作选择，则可由法院或仲裁机构根据有关法律冲突规则来确定合同的准据法。而这其中解决问题（或纠纷）的方式是选择拆讼还是选择仲裁，也就变得非常重要。

<正> 公共政策作为一个国际私法的概念,经常被用于拒绝有违法院地法律基本原则的外国法的适用或某些判决的执行。在国际商事仲裁中,公共政策与强制性规则对仲裁协议的效力、仲裁程序的合法性、仲裁裁决的有效性等,均有不同程度的影响。国家虽然赋予当事人广泛的仲裁自治权,但法院仍然通过外国仲裁裁决的承认与执行制度,对国际商事仲裁保有最终的审查控制权。     

匈牙利有关管辖权及外国判决承认与执行法律的最新发展

匈牙利有关管辖权及外国判决承认与执行的规则主要见于《1979年匈牙利关于国际私法的第 13号法令》(以下简称1979年法令)中。1979年法令第9章和第11章分别就管辖权及外国判决的承认与执行问题作了规定。考虑到执行外国判决的极大必要性,2000年10月17日匈牙利议会采纳了《2000年匈牙利关于修改有关管辖权及外国判决的承认与执行的法律的某些规则的第110号(NoCX)法令》(以下简称2000年法令),它已于2001年5月1日生效。2000年法令对1979年法令的第9章和第11章以及《匈牙利民事诉讼法典》(1952年第3号法令)有关管辖权的许多条文作了修改。
