中美反家庭暴力法制相关问题比较分析

家庭暴力是我国社会一个普遍而严重的问题,其严重侵害了家庭成员、尤其是妇女的合法权益,我国目前缺乏统一的反家庭暴力的专门法律,涉及家庭暴力问题的法律规范散见于多部单行法律中.虽然已经有多个专门反家庭暴力的地方性法规,但是单行法和地方性法规对预防家庭暴力发生均缺乏效用.在美国法上,以1976年宾夕法尼亚州免于虐待之保护法案为肇端,至1989年所有州都通过引入民事保护令(civil protection order)制度以保护家庭暴力中的受虐妇女.文章通过比较中美反家庭暴力法制相关问题,分析了我国法的不足和缺陷,为建立统一的反家庭暴力法提出了立法建议.     

On the advantages and disadvantages of being the first mover under rules of k names

Rules of k names are methods that allow two potentially conflicting parties to share the power to appoint officers. One of the parties (the proposer) selects k candidates from a larger pool, and then the other party (the chooser) selects the winner from this restricted list. We investigate conditions under which the two parties could agree ex ante on the distributions of roles, one of them preferring to be the chooser and the other preferring to be the proposer. We show that this may not always be possible, and discuss what are the relevant characteristics of the environments where agreement can be reached.     

论当前依法行政的现实制约及改进措施

在阐释依法行政及理论必要性的基础上,分析当前中国还存在的经济社会发展不平衡、社会群体法治观念不强、执法人员素质参差不齐、依法行政体制机制不健全等方面对依法行政的现实制约,并从法制宣传教育、机制理顺和政府职能转变三个方面探寻实现依法行政的针对性措施。     

Convergence Triggers in Africa: Evidence from Convergence Clubs and Panel Models

This paper investigates the formation of convergence clubs and examines the drivers of growth convergence in Africa by accounting for individual heterogenous effects and establishing transitional paths. We particularly employ the sophisticated log t test to identify underlying convergence clubs and use LSDVC as a benchmark model for analysing the drivers of convergence. We also apply the System Generalized method of moments (GMM) model for sensitivity purposes. Our results reveal four core convergence clubs; seemingly characterised by the measures of institutional stability with distinct transitional paths. We consequently highlight the importance of initial conditions, human capital and institutions in the formation of convergence clubs. Thus, the paper provides insights into the adoption of differentiated development policies consistent with the specific conditions of African countries with the integration agenda driven by accelerated levels of human capital development and technological progress.     

Electoral fraud, the rise of Peron and demise of checks and balances in Argentina

The future looked bright for Argentina in the early twentieth century. It had already achieved high levels of income per capita and was moving away from authoritarian government towards a more open democracy. Unfortunately, Argentina never finished the transition. The turning point occurred in the 1930s when to stay in power, the Conservatives in the Pampas resorted to electoral fraud, which neither the legislative, executive, or judicial branches checked. The decade of unchecked electoral fraud led to the support for Juan Peron and subsequently to political and economic instability.

中国法治的路径选择存在着悖论性问题.以一种语境化的分析方法,在对"自治"与"他治"、"政府主导"与"民主参与"、"确定"与"不确定性"三组范畴的比对中,辨析法治路径的悖论性内容,借以补正与完善法治路径选择中的某些理论问题.     

乡村民主建设的文化羁绊及对策

改革开放以来,我国乡村民主建设取得了巨大成绩,但也存在不少问题,诸如民主意识还不够高、程序操作不够规范、法治意识普遍不强、经济管理不够民主等。究其原因,无疑是错综复杂的,而从文化的视角考察,主要有消极＂亚文化＂沉渣泛起、乡民＂原子化＂意识抬头、乡村封建伦理的流毒和影响、村民骨子里的自卑心理等因素的存在和交织。因此,要进一步促进乡村民主政治建设,就必须大力加强社会主义道德观宣传,切实加强乡村法治建设,努力发展乡村教育和福利事业,挖掘、汲取乡村习俗精华,适时转变乡镇政府职能,充分发挥乡村人才的积极作用,等等。     

Kenyan Supermarkets, Emerging Middle-Class Horticultural Farmers, and Employment Impacts on the Rural Poor

Are the rural poor excluded from supermarket channels in developing countries? We analyzed the farm-level impact of supermarket growth on Kenya’s horticulture sector, which is dominated by smallholders. The analysis reveals a threshold capital vector for entrance in the supermarket channel, which hinders small, rainfed farms. Most of the growers participating as direct suppliers to that channel are a new group of medium-sized, fast-growing commercial farms managed by well-educated farmers and focused on the domestic supermarket market. Their heavy reliance on hired workers benefits small farmers via the labor market.     

大学生心理暴力现状调查及应对方式对其影响

目的:探讨应对方式对大学生心理暴力的影响。方法:采用自编的大学生心理暴力问卷和简易应对方式问卷对4所高校随机抽取的481名大学生进行调查,并对大学生应对方式与心理暴力各因子进行描述统计、相关分析和逐步回归分析。结果:大学生的心理暴力中,网络暴力、言语侵犯得分分别为(7.75±1.84)、(5.89±1.66)分,发生频率较高。大学生的应对方式与心理暴力及其各因子均有一定程度的相关(r=-0.14~0.12,P0.05或0.01)。应对方式对大学生心理暴力各因子的回归效应均达到显著(β=-0.176~0.167,P0.05或0.01)。结论:大学生存在心理暴力问题,应对方式对大学生心理暴力有显著的预测作用。     

构建和谐农村视域中的农民法治教育——徐州农民法治意识调查的启示

和谐农村建设要求农民具有相应的法治意识和法律行为模式，但调查结果显示，当前我国农民对法与法治的认知、信任、依赖、尊崇的状况及其行为模式还不符合以法治为内在要求和保障的和谐农村构建的需要。我们必须充分认识农民法治教育的重要性和紧迫性，明确农民法治教育的目标，紧紧围绕社会主义法治国家、和谐社会、新农村建设的要求，坚持以人为本的原则，贴近农村实际、了解农民需要，确定重心、丰富形式、拓宽渠道、健全机制，把法律知识的普及统摄于法治理想及其价值目标的宣扬之下，传播正确的法治理念，帮助农民树立法治意识、养成依法办事的习惯。     

我国球场暴力的现状及其成因研究

研究发现,我国球场安检与管理存在很多问题,球迷乱扔杂物现象严重,足球从业人员暴力行为不断增多.中国球场暴力出现的主要原因是裁判的执法水平和职业道德水平不高,球迷观众的心理倾向性受挫,球员自身的文化素养较低,赛场存在管理等方面的问题.应通过建立严密科学的球场管理体系,提高打击力度、球员的文化素养、思想道德素质和裁判的执法水平、职业道德水平等有效措施来减少或消除球场暴力.     

制度供给与中国“三农”问题治理

三农问题的形成有其深刻的历史渊源,但长期以来,广大农民的权利得不到保护无疑是重要的原因,所以如何全面有效地保障农民权利的问题就显得尤为重要。为此,解决三农问题必须从制度的构建入手,通过全面推进农村制度建设,确保农民的基本国民权利实现,从根本上消除权利的贫困,实现农村的富裕提供一个良好的制度环境。     

数字法治视域下政府信息公开机制

随着数字化时代的发展,政府的信息公开透明度和公民参与公共决策的需求不断增加,政府信息公开机制也受到日益严格的要求与审视。从数字法治视角出发,分析了数字法治时代下政府信息公开机制所面临的问题及存在的不足。同时,结合当前社会舆情热点事件,重点分析了政府信息公开存在的滞后性问题和信息公开机制的不完善性,这不仅容易助长公众的猜疑和不信任,这也可能妨碍政府信息公开工作的有效实施。为此,提出了优化政府信息公开机制的相应建议,包括加强对公民信息安全的保障,以信息技术手段提高政府信息公开效率,促进其规范化和专业化,以期对改进现有政府信息公开机制和推进数字法治进程提供借鉴。
