论登记对抗主义在物权变动中形成的利益冲突

物权变动登记时抗主义试图结合公示的公信力,让物权变动昭告天下.其本质上是意思主义.这就使得对抗主义在努力兼得意思主义和公示实质主义两种模式之优点的同时,也带来了两种模式联体作用所产生的矛盾效果:有对抗力的物权与无对抗力的物权同时存在于同一物.两个物权皆系依法取得,都是适格法权,理应受同等保护,然而基于标的物的不可分割性,两个物权必然相克,损害物权的静态安全和动态安全,并实际上对恶意串通予以不当激励,形成尖锐的利益冲突.应当理顺我国物权变动制度的逻辑体系,统一采用登记生效主义.

The Relative Effectiveness of Three Methods of Teaching Principles of Economics

Research on the impact of learning style preferences is very rare in economic education. This article reports the results of a project in which the student's preferred learning style and the instructor's teaching style were included as variables in a regression model. Those favoring independent styles achieved significantly more than students favoring dependent styles. Changes in student attitudes towards economics were also taken into account. The researchers assert that the addition of these variables also “greatly increases the power of the model to explain variation in student achievement and attitudes concerning economics.”

构建我国财务会计概念框架的设想

自美国FASB发布其首份财务会计概念公告之后,一些国家和国际组织等都纷纷效尤,建立起了各自的概念框架体系。我国迄今为止真正意义的财务会计概念框架尚未建立,修订后的《企业会计准则—基本准则》虽然具有财务会计概念框架的雏形,但当作我国的财务会计概念框架还不成熟。对我国基本准则与财务会计概念框架进行了比较分析,并在此基础上提出了构建我国财务会计概念框架的总体设想。

本文通过深入分析制造系统的发展变迁过程及其特点，指出目前制造系统正在向绿色化转向，并通过介绍制造系统绿色化转向的国内外情况，认为目前制造业难于发展是因为存在的认识论和市场的根源，并认为要摆脱这一困境就必须实行绿色制造。同时，还分析了目前企业生存环境的变化。最后，介绍了一些国内外著名企业绿色制造的实践情况。     

董事会的性质与国企董事会的出路

公司是企业演变的一个更高级形态。现代意义上的董事会具有一定程度的内生性,董事会一方面是股东力量互相抗衡的场所,另一方面是联结各利益相关者的中枢机构,具体而言应具有战略性、调和性、独立性、问责性。国企董事会尚存在政企不分、职责定位不清、独立董事功能有限等问题,政府应首先让董事会独立行事,然后对其问责,同时寻求高素质的董事,促使独立董事主动为小股东利益代言。

土地利用的生态安全性评价方法研究

本文针对土地利用类型和利用方式对生态环境产生的影响,提出了土地利用的生态安全性观点和评价方法。文章首先分析、总结了目前土地利用生态不安全性表现,从利用驱动力和利用方式两方面分析了产生不安全现象的原因,用适宜性评价模型评价土地利用方式或类型,用生态足迹模型评价土地利用结果的安全性评价方法,并提出了生态安全友好型土地利用的观点。     

Peaking of fiscal sizes of government

Transfers, spending, and tax revenue peaked as percentages of the gross national product (GNP) in most OECD countries during 1972–1992. The evidence suggests that a number of countries pushed transfers close to or perhaps beyond sustainable limits imposed by the Laffer curve. Namely: (i) stylized calculations of Laffer limits suggest peak fiscal sizes in the range of observed peaks in the countries with the greatest peak sizes; and (ii) the countries with the greatest peak sizes had the greatest declines in fiscal sizes from peaks until 1992.     

Effects of announcements of reorganization outcome

Less is known about whether the market perceives the final resolution of post-reorganization filing to be idiosyncratic or to carry endemic implications for the corresponding industries. This study observes the presence of intra-industry information transfers; the magnitude and direction of the reactions in response to three separate resolution outcome differs in a systematic way across industry portfolios. Specifically, portfolio rivals that are affected by competitive realignments in the industry experience stock price reactions in the opposite manner to those of the distressed firms, thus suggesting dominant competitive effects. In addition, this study reveals that the discriminatory power and forecast performance of three hybrid neuro-fuzzy models are stable and unimpaired across time and are generally superior in classifying Rival Cumulative Prediction Error (RCPE ^?) candidates.

A Test of Political Control of the Bureaucracy: The Case of Mergers

This paper tests a model of political control of the bureaucracy using a data set of mergers evaluated by the Federal Trade Commission between 1983 and 2000. The results support a sophisticated control model in which the President sets the agenda within the scope of policies acceptable to Congress. Changes in Presidential administration and in the composition of Congress can, but do not necessarily, affect merger policy. Instead, the shift in policy depends on how the institutions of the Presidency and Congress interact both in the previous and current periods.     

Sources of changes in factor intensity of trade

The factor proportions hypothesis of trade theory has been the subject of a large number of empirical tests but few of them have analyzed the changes in the factor content of trade in a country over time or across countries. This study analyzes the changes in factor intensity of trade in Mexico, Japan, Korea, Taiwan and Israel during the 1960s. It traces back the changes in capital-labor ratios in the production of exports and import substitutes to variations in the sectoral composition of trade, changes in factor-output ratios (labor and capital), and changes in input-output coefficients.     

Regulation of the evolution of the architecture of a network by tensors operating on coalitions of actors

Socio-economic networks, neural networks and genetic networks describe collective phenomena through constraints relating actions of several actors, coalitions of these actors and multilinear connectionist operators acting on the set of actions of each coalition. We provide a class of control systems governing the evolution of actions, coalitions and multilinear connectionist operators under which the architecture of the network remains viable. The controls are the “viability multipliers” of the “resource space” in which the constraints are defined. They are involved as “tensor products” of the actions of the coalitions and the viability multiplier, allowing us to encapsulate in this dynamical and multilinear framework the concept of Hebbian learning rules in neural networks in the form of “multi-Hebbian” dynamics in the evolution of connectionist operators. They are also involved in the evolution of coalitions through the “cost” of the constraints under the viability multiplier regarded as a price.

随着经济全球化的快速发展,国家之间的竞争日益体现为以自主创新能力为核心的综合国力的竞争,越来越多的国家将创新人才培养提升为一项国家战略,作为国家竞争力的主要内容。我国在人才发展总体水平上与世界先进水平相比还有较大差距,主要表现在高层次创新人才匮乏、人才创新能力不强、人才资源开发投入不足等方面。因此,应根据创新人才培养的不同阶段,通过优化课程设置、提高国际化程度、加大科研经费投入、加强培养团队建设、合理设置科研支撑计划项目等途径提升创新人才培养质量。     

多任务委托工程监理激励机制设计

工程监理制度下的业主与工程监理之间的关系属于多任务的委托-代理关系。根据多任务委托-代理博弈分析，由于工程监理承担任务间努力成本的替代性，多任务委托-代理情况下的工程监理具有不同于单一任务委托-代理情况下的激励机制；为防止对工程监理激励效能的弱化，工程监理激励报酬制度应以客观绩效评价为主，并辅以主观绩效评价机制。
