基于工作进度的水利工程项目群进度延误经济惩罚模型

水利工程各项工作进度的实时控制是水利工程项目群进度管理的主要任务,而如何借助经济奖惩措施有效地控制项目群中各项工作进度是水利工程项目群进度管理的关键。根据水利工程各项工作进度延误对项目群的影响范围和影响程度,构建了水利工程项目群的子网络。重点研究了水利工程各项工作对本合同项目、项目群各子网络和项目群等工期的影响机理,构建了相应的经济惩罚函数,据此确定了水利工程各项工作和各个合同项目的经济惩罚金额。结合案例分析,阐述了经济惩罚模型的应用机理和方法。基于工作的水利工程项目群进度延误经济惩罚模型能够为科学、合理地确定合同项目各项工作以及各个合同项目的经济惩罚金额提供依据,同时为业主确定水利工程项目群中进度控制的关键合同项目、关键工作等奠定基础。

用房地产抵押借款应办理抵押登记

最近,笔者在审理某些银行起诉的房地产抵押借款合同纠纷案件中发现,银行对房地产抵押借款,都没有依法到县级以上土地管理部门和房产管理部门办理抵押登记,领取房屋他项权证,以致使房地产抵押借款合同无效,国家信贷资金无法得到法律保障。因此,笔者撰此小文,谈点看法。以引起金融部门的领导和同志们的重视。 《中华人民共和国民法通则》第八十五条规定:“合同是当事人之间设立、变更、终止民事关系的协议。依法成立的合同,受法律保护。”《中华人民共和国经济合同法》第六条规定:“经济合同依法成立,即具有法律约束力……。”可见,经济合同必须是依法成立的,才具有法律约束

谈主合同仲裁条款对从合同的适用逻辑

主合同中所约定的仲裁条款效力是否及于从合同始终是司法实践中的认定难题,与之相关的内容散见于我国法律体系不同层级的规范之中.尽管《中华人民共和国仲裁法(修订)(征求意见稿》中新增的第24条对该问题进行了回应,但仍然面临着与现行规范不融贯的困境.在实务工作中,应当区分后续合同与从合同的概念,针对具体情况明确其适用逻辑.

Land and contract farming: Changes in the distribution and meanings of land in Kilombero,Tanzania

In the context of contract farming of sugarcane in an outgrower scheme in Tanzania, this paper explores how the scheme has fundamentally altered people's relationships with the land over the last 50 years, in particular, since 1999, when, after three decades, the sugar parastatal was privatized. The paper reviews the literature on the mutual relationship between contract farming and land ownership and examines the scheme with a focus on long-term changes in the forms of land acquisitions and land use. We argue that the meaning and importance of landownership in contract farming schemes needs to be reassessed if participation in contract farming entails a departure from previous forms of acquiring land, generates new spatial patterns of agricultural production, and necessitates additional economic and social resources in order to transform land into an economic asset.

Market power and rents in global supply chains

Market power and competition policy in food supply chains has emerged as an important economic issue in economics, and a highly sensitive item on the policy agenda. Consolidation is taking place in the food industry, both in high‐income countries and in emerging economies, but the impact of concentration in global food chains on efficiency and rent distribution is more nuanced and complex than often claimed. We review the literature and extend it by developing a model which explicitly takes into account market imperfections and contract enforcement problems in supply chains. Increased competition benefits farms by improving contract conditions, but contract enforcement becomes more complicated.

探索一个适合我国国情的矿业合同管理制度,是在市场经济条件下,综合运用经济、法律和必要的行政手段加强矿业权管理的体现,也是对我国当前矿业管理制度改革创新的一个有益尝试。通过对国外矿业合同管理法律制度进行比较研究,文章根据我国矿业管理和法治实践的时代需要,从矿业合同的法律依据、合同主体、合同形式、违约的处理、合同内容等几个方面,对适合我国国情的矿业合同管理制度进行了探索。     

Contract Structure and Design in Identity-Preserved Soybean Production

This paper provides a survey of contract design structures in identity-preserved soybean production. Drawing from economic theories of contract and organizational design, we document the allocation of value and decision rights associated with the transaction and the resulting allocation of risk associated with various sources of uncertainty for a sample of contracts for identity-preserved (or segregated) soybeans. We also list several hypotheses and avenues for future research suggested by the contract terms discussed in the paper.     

The Optimal Length of an Agricultural Carbon Contract

In this paper, we present the economic determinants of the optimal length of a carbon offset contract. We find that because of a declining capacity of the soil to sequester carbon, the optimal length of the carbon contract is finite (the marginal benefit of remaining in the contract is declining over time, whereas marginal opportunity cost is rising). We also explore the effect of varying key parameter values on the optimal length in the contract. If the contract requires the farmer to sequester at a higher rate, the farmer chooses the contract for a shorter length of time, and this may decrease rather than increase social welfare. If society places a higher value on carbon accumulation, the contract is chosen for a longer length of time. Finally, if both the farmer and society have a higher discount rate, the model provides a somewhat surprising result. The overall time in the contract, and benefits from carbon accumulation are higher when the common discount rate is higher.

Contract theory and agricultural policy analysis: a discussion and survey of recent developments*

This paper surveys some recent developments in contract theory and illustrates how this theory might be useful for conceptualising policy issues related to vertical coordination and contracting in the agro‐food industry. The article begins by surveying contract theory to identify key economic distortions that can potentially justify government involvement. Next, the general ingredients of agricultural contracts that are most likely to create inefficiencies are discussed. Finally, controversial aspects of real‐world agricultural contracts are highlighted and lessons from the theory are used to determine whether government intervention is justified. Actual legislation that has been proposed in the USA is analysed where appropriate and topics that await further research are also discussed.
