集体谈判与集体协商是处理集体劳动关系的两种模式,在中国当前的劳动关系发展模式下,运用集体协商模式处理集体劳动关系已逐步被明确,在这种三方机制下,政府作为"守夜人"的角色,权利的界定却始终无法得以明确,甚至因过去政府过度干预造成的负面影响,使得政府干预集体劳动关系的权利也受到质疑,但明确政府的权利界限事关集体协商的制度发展,引入"斡旋权"的法律权利能够使政府干预集体劳动关系的角色更为清晰,从而促进劳动关系的和谐发展。     

我国碳排放权交易问题及对策研究

目前,我国碳排放权交易市场已经初步建成,但还很不完善,存在气体排放权初始分配制度缺失、碳排放源难于监测、政府监督管理碳排放力度不足、碳排放权交易定价不合理、产权法律界定不清、排污收费标准较低等问题。面对这些问题,应采取完善碳排放权初始分配制度、建立严密灵活的碳排放权监管体制、发挥市场价格机制的有效配置、界定碳排放权的权利属性、完善我国碳排放的法律法规及管理体制等措施来实现我国的碳排放权交易机制的顺利进行。
