The RMB Exchange Rate Keeps Increasing

In July 2005, the People's Bank of China officially announced that it would adopt a manageable floating exchange rate, adjusted according to a basket of currencies based on market supply and demand. On that day, the exchange rate of the RMB to the U.S. Dollar increased by 21 percent, and since then the RMB exchange rate has gradually turned to a more flexible exchange rate convention, rather than focusing on the Dollar only.     

Yuan Appreciation——At the 7-Yuan Mark

On April 10,China＇s currency,the Yuan,opened at 6.9920 against the U.S. Dollar,compared to an exchange rate of 7.0017-to-1 on the previous day,breaking the 7-yuan mark for the first time since the government un-pegged it from the Dollar in 2005,according to the China Foreign Exchange Trading System.Since the start of 2008,it has appreciated more than 18 percent;the breakthrough was an indication of the country＇s efforts to shift away from a heavy reliance on exports and foreign investment,in order to establish a more balanced trade structure.     

RMB's Exchange Rate Policy Shift Creates Opportunity for Neighboring Countries

The Chinese Yuan showed a trend to rise against the U.S. Dollar after the announcement of the People's Bank of China, Chinas central bank, to proceed further with the reform of the Yuan's exchange rate regime. Other Asian currencies followed the upward move.

With the deepening of China＇s financial reform, economic development and the enforcement of market roles, the RMB exchange rate needs to become more flexible and become a more sensitive reflection of the changes in market supply and demand. Under such circumstances, on July 21, the People＇s Bank of China announced that the previous system where China＇s RMB was pegged to the U.S. Dollar would be changed to include a basket of foreign currencies, shifting China＇s exchange rate system into a managed floating exchange rate regime based on market supply and demand.

Dispute over Capital Contribution in A Joint Venture

In November 1994, the Claimant and the Respondent signed an agreement to establish a limited liability entertainment company （the joint venture）. The contract required both parties to contribute capital, including a one-time payment of registered capital made within five months of acquiring the necessary license to conduct business. The joint venture obtained a copy of this license on November 30, 1994. The Claimant argued that it provided capital in full within the time limit specified by the contract and alleged that the Respondent was unable to fulfill its obligations because the property it intended to provide as capital had already been mortgaged to another party. Negotiations conducted by the parties concerning this dispute failed to produce a result. In 1996, according to the terms of the contract, the Claimant referred the matter to CIETAC for arbitration.

Going green across the World

Concern for environmental damage caused by industries' pollution has reached fever pitch globally.Proactive waste management systems practiced today are still in the“end-of-the-pipe”phase.They need to move beyond recycling to work at minimizing waste generation.This can be done by revisiting the entire production processes of different industries.Worldwide, companies are waking up to the fact that the only sustainable path to the future is the observance of the zero emissions doctrine. As a new paradigm,zero waste has to be embraced with a zeal that goes beyond recycling waste.At the basic level,it would mean that the manufacturer takes back some part of the product for reuse. The significant barriers to zero-waste drive are evident.If there was resistance to setting up effluent treatment plants in the early 1990s,radical shifts in today's production process are bound to face stronger resistance. The only answer to all this is that polluting industries are inefficient,as research will show.These industries have a short lease on life if they continue down this path.Consumers are already bearing the costs of pollution;they just might be willing to share the price of protection. Governments could subsidize this,but at a cost to the company in terms of higher taxes.And most of all,zero emission would allow companies the opportunity to save costs in the long term.
