2011年5月1日,经十一届全国人大常委会第十九次会议表决通过的 《中华人民共和国刑法修正案(八)》 和 《全国人民代表大会常务委员会关于修改 〈中华人民共和国道路交通安全法〉 的决定》 正式实施,掀起一股打击"酒驾"的高潮.虽然 《刑法》 修正案(八)规定了"醉驾"行为是犯罪行为,2013年12月18日,两高一部出台 《关于办理醉酒驾驶机动车刑事案件适用法律若干问题的意见》 细化了酒驾案件的办理,但酒驾的案件仍然在不断的发生,2011年5月至2017年6月,我院共受理危险驾驶案件多达192件.现就富顺县"酒驾"案件的现状、 原因、 对策、 适用法律的困难进行分析.  相似文献

In iron and steelmaking industry, iron ore pellet qualities are crucial to end-product properties, manufacturing costs and waste emissions. Uniform pellet pavements on the grate machine are a fundamental prerequisite to ensure even heat-transfer and pellet induration successively influences performance of the following metallurgical processes. This article presents an automatic control system for uniformly paving green pellets on the grate, via a mechanism mainly constituted of a mechanical linkage, a swinging belt, a conveyance belt and a grate. Mechanism analysis illustrates that uniform pellet pavements demand the frontend of the swinging belt oscillate at a constant angular velocity. Subsequently, kinetic models are formulated to relate oscillatory movements of the swinging belt’s frontend to rotations of a crank link driven by a motor. On basis of kinetic analysis of the pellet feeding mechanism, a cubic B-spline model is built for numerically computing discrete frequencies to be modulated during a motor rotation. Subsequently, the pellet feeding control system is presented in terms of compositional hardware and software components, and their functional relationships. Finally, pellet feeding experiments are carried out to demonstrate that the control system is effective, reliable and superior to conventional methods.  相似文献

This paper examines the extent of the inadequacy of standard cross-sectional models of US labor force behavior and considers the abilities of alternative models to capture the observed continuity in the hours of work and earnings of individuals as well as in their employment histories. Both of the alternatives to the standard cross-sectional model considered in this study incorporate limited amounts of information about past work behavior that could easily be collected as part of a national population census. Using a population of 21 to 64 year old married working women taken from a 1969 through 1978 Michigan Panel Study of Income Dynamics, the variables included in the Z vector age: 1) age of the wife; 2) education of the wife; 3) state average hourly wage in manufacturing measured in 1967 dollars; and 4) unemployment rate for the state in which the wife lives. Results show that by using information about a women's hours of work and wage rate in the previous year, it may be feasible to improve on forecasts of a woman's employment and earnings behavior. For each model a separate estimate is made for wives aged 21 through 46, and for those aged 47 through 64. The dummy and difference models perform much better than the standard model, with the dummy model having the higher pseudo-chi-square statistic. These models show that systematic errors made in determining which individuals work, what they earn per hour, or how many hours they work, should result in prediction errors of the same sort year after year in the computation of annual earnings. These findings with respect to years of work and nonwork, years of part time versus full time work, and cumulative earnings over a 10 year period, confirm and extend Heckman's findings; thus, forecasting models of the work behavior of individuals should not be estimated using pure cross-sectional data. It would be important if researchers could identify what observable factors, if any, increase the likelihood that wives will alter their work behavior from what it has been in the immediate past, even if they are not able to fully understand or explain this previous work behavior.  相似文献

Many companies set performance targets for their divisions to decentralize the decision‐making process and communicate with outside investors. This paper analyzes the effects of performance targets on the decision‐making behavior of the divisions. We introduce the notion of an ‘effective utility function’—a function that a division should use in its selection of projects if it wishes to maximize the probability of achieving its targets. We show that many target‐based incentives induce S‐shaped utility functions and discuss the organizational problems they may pose. 近年,假冒伪劣商品的泛滥不仅损害着消费者的健康和财产利益,还扰乱了市场经济秩序,自《消费者权益保护法》实施以来,旨在打假的"知假买假"现象在日益发展的市场经济社会中可谓屡见不鲜,我们称之为"王海现象"。然而"知假买假"者是不是消费者、受不受《消费者权益保护法》的保护、能否适用《消费者权益保护法》第四十九条的规定等问题引起了社会各界的广泛争议。要整治假冒伪劣行为,仅靠几个职能部门来打假治劣是远远不够的,必须发动更多的群众和职业打假者来依法监督生产经营者。应该本着对知假买假者打假行为认可和鼓励的态度使之适用于《消费者权益保护法》。  相似文献

摘要:状态数据采集平台全面展现了各高等职业院校人才培养水平和办学特色。如何有效地对平台中的大批量数据进行深入分析、研究和应用,高等职业教育领域的许多专家进行了较多的探索。传统数据分析方法耗时多、效率低,严重制约了平台功能的有效发挥。为了解决这一问题,有必要开发一种智能化动态分析软件,快捷、准确、形象、多维地对状态数据进行全面分析。本文通过分析不同对象的应用要求,开发了以高职状态数据采集平台为数据源的动态仪表盘软件,既有利于各级教育主管部门的科学决策,又有利于学生、教师、家长、用人单位和社会对高职教育的全面认识。  相似文献

Traditional human capital theory based on the work by Gary Becker shows that firms do not invest in general human capital but offer firm‐specific training that is only useful for the training firm. I extend the traditional approach by adding two natural assumptions—workers cannot be forced to acquire new knowledge, and they exert unobservable effort to produce valuable output for their employer. I show under which conditions firms do not offer firm‐specific training but invest in general human capital, which increases the workers' outside option. This investment behavior is well in line with the documented prevalence of industry‐specific and occupation‐specific human capital over firm‐specific human capital.  相似文献

我国已颁布实施了16年的《消费者权益保护法》,对保护消费者权益无疑发挥了巨大作用。但随着经济和社会的发展,新型消费关系、消费形式不断涌现,消费者权益受到侵害的情况日益严重,特别是近几年食品、药品行业接连发生的群体伤害案件,逐渐暴露出我国消费者权益保护法律制度上存在的不足与缺陷,消费者权益难以得到充分而有效的保护。因此,对消费者权益保护法律制度的完善需要进一步探讨和研究。  相似文献
