A policy capturing analysis of 206 federal district and appellate sexual harassment cases showed that federal judges were moderately consistent in their judgments, with 29% of the variance in case outcomes accounted for by the regression model. Judges used Victim's Reaction, Form of Harassment, and Coercion, to make their ruling, and these three cues accounted for 20% of the variance in judgments. Appellate judges were slightly less consistent than district judges, and there were differences in judgment policy between appellate and district level cases. These findings are consistent with key aspects of the EEOC's Guidelines on Sexual Harassment and suggest that federal judges use the Guidelines to make their judgments. The model could be used by potential plaintiffs or defendants in sexual harassment cases to generate a prediction of the likely outcome of their case, to decide whether to pursue the case in court or seek a settlement.  相似文献

We follow the framework in Arya and Mittendorf's 2011 Rand Journal of Economics paper but extend their analysis by investigating supplier(s)' equilibrium choices of disclosure or confidentiality regarding their contract terms with the downstream retailers. In the case of a common supplier, we find that the unique subgame perfect Nash equilibrium (SPNE) is for the supplier to choose disclosure. This private incentive is opposite to social incentive, which calls for the regulator to choose confidentiality. In the case of dedicated suppliers, however, there are multiple SPNE due to coordination issues between the suppliers. The case which maximizes social surplus – disclosure – can be supported as a SPNE, together with the case of confidentiality, which maximizes supplier profits at the cost of everyone else. In response to pressures from governments, investors, non‐governmental organizations and other stakeholders, many large corporations have adopted a variety of carbon and energy management practices, taken action to reduce their emissions and set targets to reduce their greenhouse gas emissions. Using the case of international retailers, this article examines whether, and under what conditions, non‐state actors might be capable of assuming the governance roles that have historically been played by national governments. This article concludes that external governance pressures can, if they are aligned, robust and of sufficient duration, have a significant influence on internal governance processes and on corporate strategies and actions. However, the specific actions that are taken by companies – in particular those that require significant capital investments – are constrained by the ‘business case’. That is, companies will generally only invest capital in situations when there is a clear financial case (i.e. where the benefits outweigh the costs, when the rate of return meets or exceeds company targets) for action. That is, the extent to which external governance pressures can force companies to take action, in particular challenging or transformative actions that go beyond the boundaries of the business case, is not at all clear. This is particularly the case if the business case weakens, or if the opportunities for incremental change are exhausted. In that context, the power of non‐state actors to force them to consider radical changes in their business processes and their use of energy therefore seems to be very limited. This paper studies corporate risk management in a context of financial constraints and imperfect competition in the product market. The paper shows that interactions between firms affect their hedging strategies. As a general rule, firms’ hedging demands decrease with the correlation between their internal funds and investment opportunities. Moreover, when a firm’s hedging demand is high in the case where investments are strategic substitutes, its hedging demand is low in the case where investments are strategic complements and vice versa.  相似文献

Even though union membership has declined steadily over the last 20 years, unions are dramatically increasing their efforts to organize the workplace. As a consequence, union solicitation drives are on the rise. While the case law in this area is relatively settled, many managers in nonunion environments are generally unfamiliar with the federal case governing union solicitations. This article examines the federal case law surrounding union solicitation and provides some practical guidelines for managerial conduct for dealing with union solicitation drives. Five case studies have been conducted: four in Canada and one in Germany. The authors of this article were particularly interested in understanding the value of values and meaning in the context of project management implementation and project environments. The article first summarizes the authors' particular approach. It then discusses the five case studies and their findings. These findings will be grouped around the concepts of value of project management and meaningful work. A framework characterizing high-risk psychiatric patients by their probability of hospitalization and lengthy stay is introduced. Risk curves are then developed for each patient showing the potential impact of mental health case management on patient risk. Preliminary empirical analysis reveals that although most patients benefit from the case management intervention, some 30% of the client population may face an increase in risk of hospitalization and lengthy stay.  相似文献

Recent management research on improvisation has sought to identify ways that unplanned change and structure are linked when novel solutions appear and develop during action. This article examines an improvised learning approach to the traditional case study method, in which Master of Business Administration (MBA) students learn through preparing and delivering their own case studies. The process of improvised learning is explained within the context of teaching international human resource management/organizational behaviour and analysed by applying Bourdieu's theory of practice which understands the participants' learning to be situated within a competitive social field.

It is concluded that MBA students learn from this improvised approach provided that the professor's role accommodates being a case study expert with the roles of teaching and learning consultant. The concept of competitive field is recommended as a tool for management educators' reflection upon enabling MBA students to develop their capabilities in designing and delivering management learning sessions.  相似文献

abstract    This paper analyses how three distinct cohorts of workers in a recently merged UK-based College of Further Education understood their group and their organization's identities. We focus in particular, but not exclusively on how the groups' shared understandings of 'place' informed their identity accounts. Identities are theorized as being constituted within discursive regimes, and place treated as a discursive resource on which individuals and groups may draw in their attempts to author versions of their selves. In our case, understandings of place were also a resource on which some people drew in nostalgic reminiscence, and others used to fantasize about their preferred futures for the college. Framed by our intention to identify plurivocal native interpretations of place and identity in ways that promote the reading of polysemy back into case research, the contribution this paper makes is threefold. First, it adds to efforts to theorize organizations and identities as unstable social constructions constituted through acts of languaging. Second, it illustrates how different groups of local actors with distinct histories and value preferences may draw on their place of work in order to author contrasting versions of their organization's identity. Finally, our paper analyses the attempts made by senior managers and groups of other staff to define their organization in particular ways, as hegemonic 'moves' in an ongoing struggle for control over the organization as a discursive space.  相似文献

Based on detailed case histories of South Asian workers and their co-ethnic employers in the West Midlands clothing and catering industries, this paper examines the use of illegal immigrant labour in small ethnic minority firms and attempts to tease out its implications for the migrants themselves, their employers and the broader national interest. To establish a proper context, we begin with a review of the recent literature on the structural changes – principally the confluence of globalization and post-industrialism – which have generated a seemingly unstoppable flow of labour migration; and the official state policies that have forced much of it underground. Our own case histories are seen as one of countless local expressions of this clash between economic and political imperatives, a clash which effectively criminalizes employers and workers for providing a positive economic and social contribution to the wider good. In the present case, it is only by employing immigrant labour that struggling entrepreneurs can survive in hyper-competitive sectors of the economy and the stark choice is between official tolerance of law-breaking or driving many of these enterprises to the wall.  相似文献
