In this paper, we are going to present a method for detecting the risks of patent infringement by evaluating similarities between patent documents on the basis of semantic patent analysis. This approach enables the user to visualize similarities in the contents on a semantic patent map by means of multi‐dimensional scaling. The effectiveness of the semantic patent map has already been demonstrated by Dressler (2006) with regard to patents of seal technology, in which documents are commonly kept short and the extracted contents are concise. This paper will open out to the field of biotechnology, where patents can easily comprise several hundreds of pages. The method presented here conveys an interdisciplinary approach and combines computer‐aided natural language processing with domain‐specific expertise of biochemical processes. This is illustrated by an authentic case of infringement involving two manufacturers of DNA chips. Our experiment will show how the infringement case is visualized on a patent map based on semantic patent analysis. This experiment can be compared with the search for a needle in a haystack, the two competitive patents representing significantly conflicting ‘needles.’ From an approximate number of 4,000 patents in the current US Class 435/6, a set of patents was selected that included the ‘needles’ mentioned. This paper will point out how such mutual interference can be detected by way of semantic patent analysis, and what advice may be given to R&D managers who are faced with the risk of patent infringement.  相似文献

In an era where tourism is dominated by requests for tailored experiences, SMEs play a key role in providing adequate products and services to tourists by responding to their most specific requirements.This paper uses network and clusters as a framework providing SMEs with innovative opportunities to operate in a competitive tourism environment. A review of relevant literature on clusters, networks and tourism business innovation is undertaken, then focusing on the specific issues of Healthy Lifestyle Tourism.The UK ‘Healthy Lifestyle Tourism Cluster’ experience is employed to discuss the process and the implication of network and cluster development in tourism. However, the development of clusters should not be seen as a simple and spontaneous process due to the nature of businesses involved, but as a very complex process linked to strong stakeholder collaboration.  相似文献

By observing the last 10 years of power market reform in Germany, this paper challenges the public view that the first Energiewirtschaftsgesetz (EnWG) from 1998 had less impact on market liberalization than the second EnWG from 2005. According to the author, the opposite is true, at least in the power sector, if traditional competition indicators such as efficiency of the sector, institutional changes and electricity prices are taken as reference. While the first EnWG had changed much in the direction of liberalization and competition, progress since 2005 is rather slow — with the exception of the number of supplier shifts on the retail level and the installation of a regulation authority. The discrepancies between reality and public perception claim for a sound theoretical analysis, from which conclusions can be drawn concerning the further direction of the electricity market regulation.  相似文献

How impartial are managerial decisions? This question is particularly concerning when it comes to making green investment decisions in the face of stakeholder pressures. When managers respond to stakeholder pressures, their personal cognition, judgment, and past experiences play a role in determining their responses. The salience of particular stakeholder claims may be determined by deeply rooted individual preferences. This research investigates how a manager’s past experiences can influence green investments. Data are gathered from 247 managers about their past experience and their employer’s performance data. These data are combined with managerial responses to a vignette-based experiment, which required managers to make green investments based on a decision scenario where they are exposed to different types and strength of stakeholder pressure (from consumers and the community). Results suggest that managers’ years of experience, their employers’ financial performance, and their employers’ market performance influence investment decisions even when making decisions under new and different set of circumstances. While the employers’ financial performance influences managers to invest more, the employers’ market performance only influences managers’ investment in the presence of either high consumer or high community pressure. Compared to less-experienced managers, experienced managers invest more in response to consumer pressure but less in response to community pressure. Practical and theoretical implications of these findings in green management are explored.  相似文献

This paper addresses the question of how the current growth paradigm perpetuates existing gender and environmental injustices and investigates whether these can be mitigated through a degrowth work-sharing proposal. It uses an adapted framework of the “ICE model” to illustrate how ecological processes and caring activities are structurally devalued by the monetized economy in a growth paradigm. On the one hand, this paradigm perpetuates gender injustices by reinforcing dualisms and devaluing care. On the other hand, environmental injustices are perpetuated since “green growth” does not succeed in dematerializing production processes. In its critique of the growth imperative, degrowth not only promotes the alleviation of environmental injustices but also calls for a recentering of society around care. This paper concludes that, if designed in a gender-sensitive way, a degrowth work-sharing proposal as part of a broader value transformation has the potential to address both gender and environmental injustices.  相似文献
