Consultations and the ECB as prudential regulator: enhancing legitimacy?

ABSTRACT

This paper examines whether the ECB’s consultations, imposed by the SSM Regulation, enhance legitimacy in terms of openness, transparency, inclusiveness, efficacy and judicial accountability. The paper argues that the ECB has, in general, established a solid consultation practice. However, although there is a need for efficacy, the lack of a profound feedback statement, the low participation rate of groups other than the sector actors, and weak judicial review can be considered to constitute its Achilles’ heel. Thus, while in theory the consultation obligation leads to more throughput legitimacy, reality has turned out to be far more complex.     

Management of environmental and social risks and topics in the banking sector - An empirical investigation

This paper investigates how environmental and social (E&S) risks and topics (i. e. E&S issues that are important in terms of adaptation to a changing business environment) are integrated in the banking sector. Despite banks’ key role in steering financial flows towards sustainable development, little is currently known as to whether and how banks integrate E&S aspects into their management control systems and whether this integration translates into E&S performance. Building on prior studies in the environmental management control literature, we design a conceptual model in which we link contextual factors, a proactive strategy approach, E&S management controls, and E&S performance. Following common practice in the banking sector, we differentiate between two paths of E&S management controls: risk management (value protection) and topic management (value creation). Based on survey data for a small sample of 50 European banks, we find evidence that contextual factors, reflected in the perceived power and legitimacy of clients, voluntary standard setters and NGOs, are positively related to a proactive strategy approach. This proactive strategy translates into both topic and risk management. Yet, in the next step, only topic management is positively related to the E&S performance of a bank, but not risk management.     

The work of local culture: Wendell Berry and communities as the source of farming knowledge

When Wendell Berry and others criticize contemporary agriculture, their arguments are often dismissed as naive and grounded in longstanding agrarian myth, rather than engagement with contemporary problems. But Berry's proposals developed in response to a series of learning methods he encountered, and options for advocacy he explored, during the 1960s and 1970s. Agricultural institutions sought to assign more power to institutionalized scientific knowledge, shrinking the role of farmers. Berry sought an alternative definition of knowledge, drawing upon his training as a writer, as well as his experiences with manual farm work and the methods of environmentalist organic growers. He eventually concluded that only a community of farmers could produce and store effective knowledge and insisted that knowledge must be tacit -- largely situated in locality, skills, and culture. His ideas had little influence on most people employed in contemporary agriculture. However, those ideas profoundly shape the work of sustainable food advocates, such as Michael Pollan, who like Berry fear reductionism and celebrate the values of traditions.
