Access to justice remains a major challenge in EU consumer law, which has become more pressing with growing cross-border purchases, negatively affecting the common market. Moreover, a recent surge in supranational mass damages cases has highlighted market failures and the need for collective procedures. Under the Lisbon Treaty, new opportunities have arisen to close this civil justice gap. This article analyzes how the wider competences of the EU on access to justice can facilitate consumer redress, by putting special emphasis on the issue of the affordability of litigation, which has been so far underexplored. This work argues that collective procedures, combined with coherent out-of-court mechanisms and funding schemes, are key elements of an effective consumer dispute resolution system. In particular, specific cases and financing models are assessed, which have the potential to foster judicial protection of consumers. 相似文献
This paper aims at measuring the impact of information and communication technology use on the efficiency of the Tunisian manufacturing sector at the firm level within a simple theoretical framework. We are using a firm-level panel data for the manufacturing sector in Tunisia to investigate whether adoption of ICT influences efficiency in factor use. The analysis is conducted through the use of a parametric method to measure technical efficiency. We estimate a stochastic production frontier and the relationship aims to explain technical efficiency differentials in a single stage as suggested by Battese and Coelli [Battesse, G.E, Coelli, T.J. (1995). A model for technical inefficiency in a stochastic frontier production function for panel data. Empirical Economics, 20, 325–332].The results have confirmed the presence of positive returns to ICT capital. We have found that the impact of ICT on efficiency is strong. Our results also suggest that it is important to carefully control for human capital related characteristics of employment when studying the effect of ICT. The evidence shows that achieving benefits from investment in ICT requires complementary investments and changes in human capital. This means that the combined use of ICT and human capital in a firm would enhance its efficiency beyond the direct effects of these factors taken alone. 相似文献
Previous studies have shown that the pattern of first day returns to initialpublic offerings is consistent with the hypotheses
of underpricing and price support. We examine two different periods, 1975–1984 and 1996–2002, and find that in each case the
measures of price support and underpricing are substantially affected by the initial public offerings' beginning price. During
the period 1975–1984, the mean and standard deviation of returns to the price supported group are nearly always zero regardless
of price, whileg the mean of the returns to the underpriced group is smile-shaped: high for low-priced and high-priced stocks
but lower for stocks offered at intermediate prices. The patterns are different in the most recent data: the mean and standard
deviation of both the price supported and underpriced groups are smile-shaped. For the lowest priced stocks, the measures
in the later period mirror those for the 1975–1984 period, but for more expensive stocks the measures are substantially higher.
The results apply to the first day returns of both firm commitment and best efforts offerings. Once price is taken into account,
other than the difference in the probability of price support, the differences among offering types seem to be of secondary
importance in explaining first day returns.

Optimizing harvesting decisions has been a matter of concern in the forestry literature for centuries. However, in some tropical countries, growth models for fast-growing tree species have been developed only recently. Additionally, environmental services of forests gain importance and should be integrated in forest management decisions. We determine the impact of a joint production of timber and carbon sequestration on the optimal rotation of a fast-growing species in north-western Ecuador, comparing different optimization approaches and taking the latest developments of the Kyoto Protocol into account. We find that payments for carbon sequestration have substantial impact on the rotation length: in contrast to an optimum of 15 years when focusing on timber production only, joint production leads to a doubling of the rotation length, which means that timber harvest should be postponed until the end of the carbon project. 相似文献
