This paper provides a historical overview of the interrelationship between the use of nonunion employment arbitration and the ethics of employee organizational due process. Key research questions to be explored include the following, among others: Why are expectations about due process in organizations increasing? How are these expectations being exhibited? What is the nature of fair treatment of employees in relation to nonunion employment arbitration? Should arbitration in the nonunion employment relationship be nurtured? A final objective of this paper is to study some of the current initiatives that neutral agencies have adopted to ensure that nonunion arbitration is fair, just, and equitable for a firm's employees.  相似文献

This article introduces a logic-based approach for structuring and representing negotiation problems and for supporting negotiators. It is argued that rule-based formalism allows for integrating decision-making aspects unique and specific to negotiations with general reasoning mechanisms based on rationality postulates. The discussion of the rule-based systems and its application to negotiation modeling and support is preceded by an outline of qualitative and quantitative approaches to problem representation and reasoning, and an overview of predicate calculus. The advantages and disadvantages of rule-based systems and their ability to capture complex negotiation decision processes and reasoning are also given.  相似文献

The purpose of this paper is to provide an overview of the most recent public policy and ethical issues as they relate to the growing usage of nonunion employment arbitration particularly in relation to financial services firms and professional firms. In this era of increasing employment-related litigation, it is wise from an employer’s point of view to find alternative procedures that offer assurances of fairness yet provide expeditious means for resolving disputes. From an employee’s vantage point, however, it is essential that the fundamental issue of procedural and substantive due process be maintained and guaranteed. Therefore, a number of strategic ethical issues arise: How should employment arbitration procedures be designed following the Due Process Protocol of the Task Force on Alternative Dispute Resolution in Employment? How should arbitration procedures follow the national rules for the resolution of employment disputes of the American Arbitration Association? Do recent court decisions shed light on these issues? What ethical principles can be gleaned from these public policy pronouncements? A final objective of this paper is to study some of the current initiatives on this topic.  相似文献

Recent research in social tourism notes possible links between tourism participation and improvements in health. However, there is a lack of quantitative evidence concerning the potential links between tourism participation and self‐reported health amongst older people. An ageing society requires measures to promote independent living and enhance older people's quality of life. This paper provides evidence that older tourists are more active and healthy than non‐tourists, from a study comparing health perceptions amongst Spanish older people. The results provide tentative conclusions of causal relationships between tourism and dimensions of physical and mental health through a Structural Equation Model. Over the period 1994–2003, 80% of targets and 37% of acquirers obtain a third-party assessment of the fairness of a merger or acquisition. These fairness opinions do not affect deal outcomes when used by targets, but they affect deal outcomes when used by acquirers. The deal premium is lower in transactions if the acquirer obtains a fairness opinion, and is further reduced if multiple advisors provide an opinion. However, the acquirer's announcement-period return is 2.3% lower if the acquirer has a fairness opinion, especially if the acquirer pays a high premium, indicating that investors are skeptical of these transactions.  相似文献

Portfolio theory shows that diversification can enhance the risk-return trade-off. This study uses the absolute location of commercial real estate property along with spatial statistics to address the inherent problem of determining geographical diversification based upon a set of economic and property-specific attributes, some of which are unobservable or must be proxied with noise. We find that commercial real estate portfolios exhibit statistically significant spatial correlation at distances ranging from adjacent zip codes to neighboring metropolitan areas. Given the common structure of dependence found in the data series, we discuss feasible strategies for obtaining diversification within direct-investment real estate portfolios.  相似文献
