This article argues that the moral right to be discharged only for good cause and like rights can be contracted away by employees in appropriate circumstances. It maintains that the rights in question are not inalienable, and that there is nothing irrational about an employee's wishing to deal them away. It also maintains that inequalities in bargaining power between employers and employees are insufficiently pervasive to justify a flat ban on the alienation of these rights. For a waiver of such rights to be valid, however, employees must have full knowledge of its terms.The question addressed here bears on several legal and policy issues affecting termination of the employment relation. If employees can contract away their right to a goodcause discharge, the American doctrine of employment at willmight find justification in the face of that right. In addition, the alienability of such discharge rights may be necessary to justify express disclaimers of wrongful discharge liability and the waiver provision of the new U.S. Draft Uniform Employment-Termination Act.Michael J. This article estimates economies of scale for a sample of five cellular telephony firms in the United States. We reject constant returns to scale for all but the smallest firm studied; the remaining firms exhibit decreasing returns to scale. This finding suggests that scale economies cannot be used to justify the current regulated duopoly structure of United States cellular markets.  相似文献

An increasingly important fraction of contemporary economic activity is devoted to the production of cultural outputs, i.e. goods and services with high levels of aesthetic or semiotic content. This kind of economic activity is especially, and increasingly, associated with a number of large cities scattered over the globe. A conceptual account of this phenomenon is provided on the basis of an exploration of the character of place-specific forms of culture generation and the agglomerative tendencies of many kinds of cultural products industries. The empirical cases of Los Angeles and Paris are briefly discussed. The dynamics of production, distribution and location of major cultural products industries are also examined. The paper ends with a brief allusion to the modalities of spatial differentiation of culture in contemporary capitalism and to a prospective cultural politics.  相似文献

Summary A sequential testing procedure called 2-SPRT for the meanμ of the negative binomial distribution with known exponentk is presented. For any fixedμ 0(μ 1<μ 0<μ 2), the 2-SPRT provides an asymptotic solution to the modified Kiefer-Weiss problem. Determination ofμ 0 such that the test provides an approximate solution to the Kiefer-Weiss problem is described. The behavior of the 2-SPRT and the Sequential Probability Ratio Test is investigated using Monte Carlo methods. The error probabilities and the average sample numbers are compared. A growing awareness of workplace hazards and identification of airborne contaminants, coupled with a changing safety and health regulatory environment, created an unexpected demand for new and innovative respirators in the early 1980s. 3M's Occupational Health and Environmental Safety Division broke new ground by taking the team concept further than ever before in the company. Atlanta has the reputation of being a city of opportunity for blacks. However, in Atlanta, as well as in other cities across the nation, the nexus of racism and economic discrimination has resulted in disparities between the housing status of blacks and whites. This article examines racial disparities in the Atlanta housing market. It begins by tracing recent trends in the Atlanta-area economy and by providing background information on the local housing market. It then discusses the roles of the federal Home Mortgage Disclosure Act of 1975 and Community Reinvestment Act of 1977 in the efforts of local groups to reduce racial disparities in the housing market. The final section discusses recent local developments that might lead to improvements in the housing status of black Atlantans.  相似文献

Prior studies show that the beta coefficient of a security changes systematically as the length of measurement interval is varied. This phenomenon, which is called the intervalling effect bias in beta, has been attributed to the friction in the trading system that causes the delays in the price-adjustment process. This study shows that option listing is associated with a decline in the beta intervalling effect bias. The decline is most pronounced for small firms. We also find that our sample firms grow significantly after option listing. Since prior research indicates that market value is a major determinant of the magnitude of the intervalling effect, we re-examine our results using a subsample that controls for market value. The results indicate that the decline in the beta bias from the pre-listing to post-listing period is still prevalent after we control for the change in firm size. Overall, the evidence is consistent with the notion that option trading reduces the delays in the price-adjustment process, which in turn reduces the intervalling effect bias in beta.  相似文献
