The second Consumer Action Programme of the European Community (1981) has introduced the idea of a dialogue between producers and consumers, leading to voluntary agreements or codes of conduct. Today, several types of codes exist within the area of the European Community. They differ in their geographic origin, their adoption procedure and their modus operandi. Many codes are good examples of a new type of rule-making in European consumer affairs, namely sponsored regulation. In between the public and the private normative order, a grey area of paralegal norms is existing and developing steadily. The EC authorities often prefer to provide the conditions for rule-making by private parties instead of producing norms themselves. In those cases, codes of conduct may replace the law, substitute it, or add to it. Codes of conduct are not the only possible output of the dialogue between producers and consumers, nor are they the only example of sponsored regulation. Others are model contracts, complaint boards, and standardization institutes.
Der Dialog zwischen Verbrauchern und Anbietern mit Hilfe von Verhaltenskodices in der Europäischen Gemeinschaft
Zusammenfassung Das zweite Verbraucheraktionsprogramm der Europäischen Gemeinschaft aus dem Jahr 1981 führt die Idee eines Dialoges zwischen Produzenten und Konsumenten ein. Dieser Dialog soll zu freiwilligen Vereinbargungen über Verhaltensrichtlinien führen. Der Beitrag gibt zunächst einen Überblick über die recht unterschiedlichen Formen solcher Kodices im Bereich der Europäischen Gemeinschaft. Unter geographischem Gesichtspunkt werden nationale, internationale und übernationale Kodices unterschieden, unter dem Gesichtspunkt des Vereinbarungsverfahrens unilaterale, bilaterale und trilaterale Kodices, und schließlich unter dem des modus operandi ursprüngliche, gemeinschaftliche und administrierte Kodices.Zahlreiche Kodizes sind ein Beispiel für einen neuen Typ von Regulierung im Bereich europäischer Verbraucherangelegenheiten, nämlich geförderte Regulierung. Diese Form der Regulierung entwickelt sich zwischen den klassischen Formen, nämlich dem staatlich geschaffenen Recht einerseits und der privat geschaffenen Selbstregulierung andererseits. Dazwischen wächst eine Grauzone mit rechtsähnlichen Regelungen. Statt selbst Normen zu schaffen, regen die EC-Behörden die beteiligten Parteien verstärkt an, sich ihre Normen zu schaffen, indem sie ihnen die formellen und inhaltlichen Bedingungen dafür zur Verfügung stellen. Kodices sind ein Beispiel für solche geförderte Regulierung, aber nicht das einzige. Die Beziehung zwischen Kodices und Gesetzgebung ist oft komplex. Kodices können rechtliche Vorschriften ersetzen (aktive Deregulierung), anstelle von Gesetzgebung treten (vorbeugende Regulierung) oder zur Gesetzgebung hinzutreten.Schließlich sind Verhaltenskodices nicht das einzige Ergebnis des Dialoges zwischen Produzenten und Konsumenten. Andere sind Musterverträge, die von den beteiligten Seiten ausgehandelt werden, ferner Beschwerdestellen zur Behandlung von Verbruaucherbeschwerden, sowie Standardisierungseinrichtungen, die seit der neuen Politik der Kommission neue Bedeutung gewinnen.

This paper presents a model of a multinational firm's optimal debt policy that incorporates international taxation factors. The model yields the prediction that a multinational firm's indebtedness in a country depends on a weighted average of national tax rates and differences between national and foreign tax rates. These differences matter as multinationals have an incentive to shift debt to high-tax countries. The predictions of the model are tested using a novel firm-level dataset for European multinationals and their subsidiaries, combined with newly collected data on the international tax treatment of dividend and interest streams. Our empirical results show that a foreign subsidiary's capital structure reflects local corporate tax rates as well as tax rate differences vis-à-vis the parent firm and other foreign subsidiaries, although the overall economic effect of taxes on leverage appears to be small. Ignoring the international debt shifting arising from differences in national tax rates would understate the impact of national taxes on debt policies by about 25%.  相似文献

A set of outcomes for a transferable utility game in characteristic function form is dominant if it is, with respect to an outsider-independent dominance relation, accessible and closed. This outsider-independent dominance relation is restrictive in the sense that a deviating coalition cannot determine the payoffs of those coalitions that are not involved in the deviation. Each game generates a unique minimal (for inclusion) dominant set. This minimal dominant set is non-empty and returns the coalition structure core in case this core is non-empty. In countries with more secure property rights, firms might allocate resources better and consequentially grow faster as the returns on different types of assets are more protected against competitors' actions. Using data on sectoral value added for a large number of countries, we find evidence consistent with better property rights leading to higher growth through improved asset allocation. Quantitatively, the growth effect is as large as that of improved access to financing due to greater financial development. Our results are robust using various samples and specifications, including controlling for growth opportunities.  相似文献

In the valuation of the effect of improved air quality through the estimation of hedonic models of house prices, the potential “errors in variables” aspect of the interpolated air pollution measures is often ignored. In this paper, we assess the extent to which this may affect the resulting empirical estimates for marginal willingness to pay (MWTP), using an extensive sample of over 100,000 individual house sales for 1999 in the South Coast Air Quality Management District of Southern California. We take an explicit spatial econometric perspective and account for spatial dependence and endogeneity using recently developed Spatial 2SLS estimation methods. We also account for both spatial autocorrelation and heteroskedasticity in the error terms, using the Kelejian–Prucha HAC estimator. Our results are consistent across different spatial weights matrices and different kernel functions and suggest that the bias from ignoring the endogeneity in interpolated values may be substantial. We study the effects of an economic policy in an endogenous growth general equilibrium framework where production of consumption goods requires two resource inputs: a polluting non-renewable resource and a non-polluting labour resource. The use of the former contributes to the accumulation of pollution in the atmosphere, which affects welfare. There is a specific research sector associated with each of those resources. We provide a full welfare analysis, and we describe the equilibrium paths in a decentralized economy. We go on to study the effects of three associated economic policy tools: a tax on the polluting resource, and two research subsidies. We show that the optimal environmental policy has two main effects; it delays the extraction of the resource and with it the level of polluting emissions and it reallocates research efforts, decreasing the amount put into “grey” research to the benefit of “green” research. We also show that the environmental policy is grey-biased in the short-term, and green-biased in the long-term. Finally, we compute the optimal values for these tools.   相似文献

Over the past 20 years business ethics in Europe witnessed a remarkable growth. Today business ethics is faced with two challenges. The first comes from the social sciences and consultants who have both reclaimed the topics of business ethics, regretfully often at the loss of the proper ethical perspective. The second comes from the remarkable rise of corporate social responsibility which has pushed aside the mainstream business ethics methodology with its emphasis on moral deliberation by the individual. These challenges can be tackled by an institutional transformation in business ethics that links up to the long-standing European tradition of institutional analysis of the market. The second remedy is an enlargement of the research agenda in business ethics by coming closer to other parts of applied ethics where the business ethics view is at this moment grossly neglected.  相似文献

In this study we analyse the role of the storageregulation in a fishery's production process when theresource exploited and the market to which theproduction is exported are characterized by seasonaldephased oscillations. For this purpose we built up adynamic model drawn from the French Guyana shrimpfishery example. The underlying objective of the modelis not the maximisation of a given criterion (as wouldbe in the optimal control approach), but merely themaintenance of the fishery's economical viability. Thefundamental principle is here to try to preserve asmany as possible viable control options. Theconditions to achieve and maintain this viability arecaptured in a certain number of constraints. Theanalysis points out periods and situations within theseason where the fishermen must anticipate theevolution of their storage to avoid violating thoseviability constraints. The study also indicates howthe fishery's viability can be ensured even if theexploitation costs exceed the commercial value of thelandings for a finite part of the year. However, whenthe resource's and/or market's oscillations are toolarge, the fishery may be not viable any longer and itappears that the crisis can not be removed byinvesting in larger storage capacities.  相似文献

To be creative and make change happen, leaders must do more than simply ‘think outside the box’, as the traditional business manuals suggest, using the popular American expression. After all, the space outside the box is infinitely expansive. Moreover, there can be no guarantee that a solution to the problem will be found. The answer: ‘Think in new boxes.’ This requires developing the right new box; in other words, useful new models, a helpful new approach to a problem. That is the real art of practical creativity. This short article outlines the approach (Thinking in New Boxes) and its application to classic scenario planning with a few examples. The authors also present the ‘Expressway to Scenarios’, an approach that wins in impact and practicality what it loses in deep analysis, by having top executives involved in key steps.  相似文献
