中国区际法律冲突现状及解决途径浅析

随着一国两制的提出与港澳相继回归中国，中国国内的区际法律冲突及其解决途径已作为一个重要的课题摆在中国法学界面前。中国区际法律冲突不仅是不同法系间不同法域的法律冲突，也是不同社会制度下不同法域的法律冲突，还是在国内没有统一的最高司法机关加以协调的法律冲突。解决中国区际法律冲突有立法、司法，沿用国际私法以及国际条约，平等协商签订区际法律协议等途径。     

品牌与善因的匹配对善因营销的影响研究

通过文献回顾分析了企业与善因的匹配对善因营销效果的影响,结果发现,这种匹配对善因营销效果的影响不仅与消费者感知的匹配程度有关,同时还取决于消费者感知到的匹配类型(形象匹配与功能性匹配),以及许多调节变量(产品类型、购买情境、消费者对企业和善因的涉入及熟悉程度等)的影响。进而总结了目前研究的空白和不足,为未来的研究提出了建议。

Pricing multi-class network services using the Shapley Value

This paper investigates pricing issues in class-based networks. Classes of packets having lower impatience and longer average delay receive monetary compensations. The inter-class price differential is determined by the inter-class compensations. The paper also presents rules for allocating network resource to each class. The corresponding payoff (disutility share) for each class is driven by the Shapley Value of the associated cooperative game.     

Exploring the Influence of Organizational Ethical Climate on Knowledge Management

In recent years, knowledge management has been utilized as an essential strategy to foster the creation of organizational intellectual capital. Organizational intellectual capital can be derived both individually and collectively in the process to create, store, share, acquire, and apply personal and organizational knowledge. However, some organizations only focus on the development of public good, despite the concerns arising from individuals’ self-interest or possible risks. The different concern of individual and collective perspectives toward knowledge management inevitably leads to ethical conflicts and ethical culture in the organization (Jarvenpaa et al., J Manage Inf Syst 14(4):29–64, 1998; Ruppel and Harrington, IEEE Trans Prof Commun 44(1):37–52, 2000). The purpose of this study is to examine the ethical climate within the organization and its possible influence on members’ evaluation, satisfaction, engagement, and job performance with respect to knowledge management practice. The research results reveal that several types of organizational ethical climate coexist in the organization and have different degrees of influence on employees’ attitude as well as participation in knowledge management activities. In this article, we argue the importance of organizational ethical climate and highlight the implications of such a climate for facilitating knowledge management.     

最优存款保险设计——国际经验与理论分析

本文结合国际经验和理论分析,探讨最优存款保险机制设计。首先,本文通过德国、巴西、俄罗斯等国典型经验,分析建立激励相容存款保险制度以及金融安全网成员协调合作的经验和教训。其次,在此基础上,本文针对信息不对称导致的问题,设计了成本最小化的激励相容存款保险合约。本文证明给定适当补贴,满足"参与约束",并同时规避"逆向选择"和"道德风险"的存款保险合约存在且不唯一,并且这些合约是针对不同类型银行自我选择的动态合约组合。最后,本文对建立中国存款保险制度提出政策建议。
