操纵证券交易价格行为的刑法研究——兼论前置法律责任的构建与完善

操纵证券交易价格达到一定程度会造成社会危害,为了抑制操纵证券交易价格行为的频繁发生,刑法的干预是必要的,并须彰显其及时性、确定性与严厉性。但是,囿于刑法的补充性,对证券犯罪的惩治方式必须多元化,单纯依靠刑事处罚或者行政处罚,都不可能有效惩治和预防证券操纵犯罪,应该使刑法与民法、行政法等配套协调,组成有机的犯罪预防和惩罚体系,共同消除证券操纵行为的危害。     

High Mountain Adventure Tourism: Trekkers’ Perceptions of Risk and Death in Mt. Everest Region,Nepal

This study examines trekkers' perceptions of risk and death associated with high mountain adventure tourism based on their actual experience during the trek to the Everest Base Camp. The study is based on the authors' fieldwork conducted during April to May 2014. Interview questions focused on trekkers' perceptions of risks associated with their own activities, and the risks taken by professional mountaineers and Sherpa guides. Results show that trekkers realized the differences in risks associated with climbing and trekking, and celebrated the accounts of risk taken by the mountaineers. But when risk was self-experienced during the trek, celebration turned into fear and emotional distress. Trekkers generally held foreign mountaineers with much higher reverence than Sherpa climbers. The study concludes with the suggestion that more research is needed to examine the dynamic emotional state of adventure tourists, commodification of high mountain adventure, and understanding local perspectives of adventure tourists.     

An Empirical Assessment of Customer Satisfaction in Tourism

The goal of this project is to find out if Spain is undergoing a disinvestment process in foreign service companies which might be leading to offshoring. To achieve this – after tackling conceptual and methodological aspects – a company's total disinvestment has been estimated. Subsequently, its ratio to gross investment has been evaluated for the whole sector and for all the activities the company performed in the 1993–2004 period. The result does not show a worrying disinvestment process. Over the last year in the study, though, a significant change has been seen, which might suggest the beginning of a disinvestment process in some activities – as is happening worldwide.     

网络经济环境下的西部经济发展研究

近十年来我国网络经济得到了蓬勃高速发展,但西部地区的网络经济发展水平与东部地区相比有较大的差距。本文用网络经济、区域经济、产业经济等理论,分析西部地区发展网络经济的区位条件、布局以及挑战与机遇,提出利用西部中心城市发展优势带动与辐射整个西部地区,促进西部地区网络经济发展,并提出了发展西部发展网络经济的几条建议。     

新老定额下某一教学楼工程造价的计算与对比

为对比新老定额下工程造价的差别,本文以一座中学教学楼为例,进行了新老定额下工程造价的计算与对比,结果显示新定额并没有使工程的总体造价涨幅,可见,房屋的涨价并非是房屋本身的费用增加所导致的,新定额的计算是更合理的。     

基于系统动力学的物流金融协同运作研究

物流金融的有序运作可以在一定程度上降低整个系统的风险水平。在对国内外研究现状进行分析的基础上,利用系统动力学方法对物流金融的运作过程建立了相应的模型,通过仿真模拟物流金融内部各企业之间的博弈过程,得出质押率、赎货资金比例、中小企业实时的现金存量水平与系统内部协同运作的密切关系。     

Sustainable Development and the Financial System: Society's Perceptions About Socially Responsible Investing

The debate surrounding the financial needs of investors and the impact on society of investment is considered to be an important research topic due to the growth of socially responsible financial markets. The main objective of this research is to study society's perception about socially responsible investing (SRI) and to identify investor's preferences regarding environmental, social and governance criteria, their real‐life investment needs and the most relevant sustainable financial products. To examine society's perception of SRI, we conducted a field survey among Spanish investors. The results show that SRI is at an early stage and Spanish investors need more exact information regarding social, environmental, and governance criteria in order to invest in socially responsible companies and products. This paper offers some guidelines that could be used by Spanish institutions, managers and investors and by foreign managers when approaching the Spanish market, in order to promote the growth of socially responsible financial products.
