This article integrates the literatures on judicial compliance,panel decision making, and case selection in the federal judiciaryhierarchy. Many studies have speculated that "panel effects"thephenomena under which an individual judge's vote may dependon her colleagues on a three-judge panelcan be tied toa "whistleblower effect," through which a lower court judgecan constrain a panel majority from disobeying with SupremeCourt precedent by threatening to dissent. However, no studyhas systematically found such a relationship. I present a game-theoreticmodel of circuit court-Supreme Court interaction that demonstrateshow panel composition might affect the likelihood of lower courtcompliance to Supreme Court doctrine. The model illustrateshow three-judge panels, while not inducing perfect doctrinalcontrol of lower courts by the Supreme Court, significantlyincreases the latter's ability to see its preferred doctrinecarried out by its subordinates in the judicial hierarchy. 相似文献

We model the invention of new technologies and their diffusion across countries. In our model all countries grow at the same steady-state rate, with each country's productivity ranking determined by how rapidly it adopts ideas. Research effort is determined by how much ideas earn at home and abroad. Patents affect the return to ideas. We relate the decision to patent an invention internationally to the cost of patenting in a country and to the expected value of patent protection in that country. We can thus infer the direction and magnitude of the international diffusion of technology from data on international patenting, productivity, and research. We fit the model to data from the five leading research economies. A rough summary of our findings is that the world lies about two-thirds of the way from an extreme of technological autarky to an extreme of free trade in ideas. Research performed abroad is about two-thirds as potent as domestic research. Together the United States and Japan drive at least two-thirds of the growth in each of the countries in our sample. 相似文献

Covariate Measurement Error in Quadratic Regression 总被引:3,自引:0,他引:3
We consider quadratic regression models where the explanatory variable is measured with error. The effect of classical measurement error is to flatten the curvature of the estimated function. The effect on the observed turning point depends on the location of the true turning point relative to the population mean of the true predictor. Two methods for adjusting parameter estimates for the measurement error are compared. First, two versions of regression calibration estimation are considered. This approximates the model between the observed variables using the moments of the true explanatory variable given its surrogate measurement. For certain models an expanded regression calibration approximation is exact. The second approach uses moment-based methods which require no assumptions about the distribution of the covariates measured with error. The estimates are compared in a simulation study, and used to examine the sensitivity to measurement error in models relating income inequality to the level of economic development. The simulations indicate that the expanded regression calibration estimator dominates the other estimators when its distributional assumptions are satisfied. When they fail, a small-sample modification of the method-of-moments estimator performs best. Both estimators are sensitive to misspecification of the measurement error model. 相似文献

Government advertising in Canada has a long history and has been an important adjunct in fostering values of national unity. This paper examines several significant campaigns: early 20th century immigration advertising, patriation of the Canadian constitution in the 1980s and, more recently, Olympic advertising in 1998. It attempts to demonstrate that the use of state advertising in Canada is unique in helping foster a view of Canadian citizenship and the development of national myths. ABSTRACTIn this paper, we examine how entrepreneurs living in communities under continuous threat prepare themselves to continue with their enterprising activities or engage in new ones after the expected crisis occurs. Most of the crisis literature on disasters and entrepreneurship focuses on aftermath responses, but the antecedents of such entrepreneurial behaviour and its connection to past and future crises remains largely unexplored. Based on a two-stage exploratory study pre and post the Calbuco Volcano eruptions in 2015 and 2016 in Chile, we introduce the notion of entrepreneurial preparedness in a context of continuous threat and elaborate on its four central attributes: anchored reflectiveness, situated experience, breaking through, and reaching out. Subsequently, our work develops a refined understanding of pre and post-disaster entrepreneurship and offers a novel base for theorizing on the relationship between entrepreneurial preparedness in contexts of continuous threat. 相似文献

The Israeli social workers' campaign of 2011 enjoyed widespread support, a groundswell of rank‐and‐file participation, and democratic representation through new organisations pushing for a protracted struggle, yet the collective agreement seemingly imposed by the Histadrut fell far short of expectations. This article explains this discrepancy by asserting that the new organisations' ‘radical’ organising approach threatened the labour federation's long history of social partnership and its main strategies for retaining its hegemony. Thus incompatibility between the social partnership approach and the more radical ‘organising’ approach may explain the failure of a collective campaign and shed light on cases where the union appears to be suppressing or neutralising the aspirations of the workers it claims to represent. 相似文献

This paper looks at the channels through which intangible assets affect productivity growth. The econometric analysis exploits a new data set on intangible investment (INTAN‐Invest) in conjunction with EUKLEMS productivity estimates for 10 EU member states from 1998 to 2007. We find that (a) the output elasticity of intangible capital depends upon ICT intensity, consistent with complementarities between ICT and intangible capital; (b) non‐R&D intangible capital has a higher estimated output elasticity than its factor share, as does (c) an index of labour composition. The last two findings are consistent with growth spillovers from investments in knowledge‐based/intangible capital and skills. 相似文献

abstract Corporate social responsibility (CSR) is an increasingly pervasive phenomenon on the European and North American economic and political landscape. In this paper, we extend neo-institutional and stakeholder theory to show how differences in the institutional environments of Europe and the United States affect expectations about corporate responsibilities to society. We focus on how these differences are manifested in government policy, corporate strategy, and non-governmental organization (NGO) activism towards specific issues involving the social responsibilities of corporations. Drawing from recent theoretical and empirical research, and analysis of three case studies (global warming, trade in genetically modified organisms, and pricing of anti-viral pharmaceuticals in developing countries), we find that different institutional structures and political legacies in the US and EU are important factors in explaining how governments, NGOs, and the broader polity determine and implement preferences regarding CSR in these two important world regions. 相似文献

In this paper, we construct a framework for modeling teams of agents who apply techniques or procedures (tools) to solve problems. In our framework, tools differ in their likelihood of solving the problem at hand; agents, who may be of different types, vary in their skill at using tools. We establish baseline hiring rules when a manager can dictate tool choice and then derive results for strategic tool choice by team members. We highlight three main findings: First, that cognitively diverse teams are more likely to solve problems in both settings. Second, that teams consisting of types that master diverse tools have an indirect strategic advantage because tool diversity facilitates coordination. Third, that strategic tool choice creates counterintuitive optimal hiring practices. For example, optimal teams may exclude the highest ability types and can include dominated types. In addition, optimal groups need not increase setwise. Our framework extends to cover teamwork on decomposable problems, to cases where individuals apply multiple tools, and to teams facing a flow or set of problems. 相似文献

Abstract Social welfare programs in the USA are designed to serve as safety nets for people in hard times, in contrast with the universal approach found in many other developed western nations. In a survey of cliometric studies of social welfare programs in the USA, we examine the variation in the safety net in the USA across states in the 20th century, the determinants of the variation and its impact on socioeconomic outcomes. The USA has always displayed substantial variation in the extent of the safety net because the features of most public social welfare programs have been and currently are determined by local and state governments, even after the federal government became involved in the 1930s. Differences across states persist strongly for typically a decade, although the persistence weakens with time, and there are some periods when federal intervention led to a re‐ordering. The rankings of state benefits differ from program to program, and economic and political factors have different weights in determining benefit levels in panel data estimation of their effects. Variation in benefits across programs during the early 1900s had significant impact on labour markets, economic activity, family formation, death rates and crime. 相似文献
