The enactment of bankruptcy laws by the People's Republic of China (PRC or China) in 2006 was a necessary step in the development of its economy. This law represented a significant modernisation of the insolvency framework, supporting the transforming economy, but it was also a law of political expediency, for the enhancement of external relations. One aspect of the enhancement of external relations was the provision of cross‐border insolvency rules. However, this complex area of law was addressed in only one article, which was only a starting point, leaving many details unaddressed, and further reforms are required. In particular, it is desirable that the law provides a greater level of predictability as to the likely outcomes of cross‐border insolvencies, to encourage inward trade and investment, as well as encourage external trade. Both inbound and outbound business dealings are important to China's continued economic development. It is clear also, however, that insolvency law and practice is still a developing area for China. The establishment of a modern and unified system of insolvency laws was a big step for China, representing a sacrifice of tight controls on insolvencies, but the impact of this law in practice is only recently developing, with a loosening of state controls, after a very slow start. 1 The establishment of a cross‐border insolvency framework represents a further challenge; one that is likely to beset with considerable difficulties, as any further development of this law would potentially entail some further loss of control over proceedings, not least in outbound cases, and resistance may be anticipated. In keeping with China's historical approach to lawmaking in the area of bankruptcy law, it is likely that the cross‐border insolvency framework will develop gradually and with caution. This article assesses the way forward in respect of cross‐border insolvency laws, contending that an incremental approach over a period of years, in three broad stages, is required, with more developed and country‐specific approaches providing a link, or interim stage, between the clarification of the Article 5 and the formal adoption of the United Nations Commission on International Trade Law Model Law on Cross‐Border Insolvency Proceedings 1997 (Model Law) in China. Advances in genomic technologies and a growing trend towards stratified and preventive approaches to medicine mean that increasing numbers of individuals may have access to information about their genetic makeup, and their risk of developing diseases. This is likely to impact on healthcare professionals involved in the delivery of genetic tests, or in supporting patients who are affected by a disease with a genetic risk factor. It is therefore important to understand healthcare professionals’ perceptions about providing these services, and how they feel about communicating information about genetic risk to patients. This paper provides a systematic review and metasynthesis of qualitative research exploring healthcare professionals’ perceptions of genetic risk in the context of predictive genetic testing for chronic disease. Healthcare professionals expressed a range of reservations about the utility of predictive testing in this context. Professionals judged patients’ understanding of risk information to be limited and subject to bias and a range of sociocultural influences. Concerns about the psychosocial impact of genetic risk information were frequently cited, both in relation to individual patients and the wider impact on their families and communities. The need for provision of multidisciplinary support was described. The concept of responsibility was also an important theme. Healthcare professionals recognized the responsibility that accompanies risk knowledge, and that ultimately this responsibility lies with the patient, not the provider. Our analysis suggests that professionals’ evaluation of the utility of predictive genetic testing is influenced not only by resource deficits, but may also be interpreted as a response to challenging ethical and social issues associated with genetic risk, that are not well aligned with current medical practice.  相似文献

At the turn of the twentieth century, New Zealand was one of the wealthiest nations in the world on a per capita basis. We examine the role of innovation in explaining New Zealand's economic performance. Using a new dataset on patent applications for the period 1880–95, we consider whether the geographical concentration of innovative activity influenced economic activity. We find relationships between agricultural and pastoral output indices and inventiveness and between different regions and related industries. The results, however, are relatively weak. We conclude that tests of agglomeration effects in New Zealand during this period deserve further attention.  相似文献

Globally, the potential for small and medium‐sized enterprises (SMEs) to collectively impact negatively on the environment is great. Therefore, the adoption, and maintenance, of environmentally responsible practices by this group of firms is especially critical. Studies of environmental practices successfully implemented by small firms have revealed that relationships with other firms, or other organizations, can contribute to greater awareness of the benefits of such activities and, therefore, enhance the possibility of environmental engagement. Collaborative relationships may provide opportunities for SMEs to overcome some of the barriers to implementing environmental initiatives associated with their size, and/or associated characteristics. This paper focuses on attitudes of SME owner‐managers to a variety of environmental issues (including regulation and voluntary standards), and to collaborating with other firms (in either a formal or informal sense). Understanding how people construe and act upon cancer risk is important for efforts to target risk-increasing health behaviors. Importantly, research participants are often asked to estimate their risk for cancer (in general), which could mask the fact that cancer represents a range of diseases, and that different cancer types can have distinct risk factors. It is unclear whether individuals perceive general cancer risk as being comprised of an aggregation of risk for specific cancer sites, or whether general cancer risk perceptions reflect the specific type of cancer most salient to them. In this study, general cancer risk perceptions were regressed on specific risk perceptions for colon, lung, prostate (men only), and breast (women only), using data from a nationally representative sample. We found that among men and women, all forms of cancer predicted independent variance in estimates of general cancer risk. There were also stronger relationships between general risk perceptions and each specific risk perception than between any two specific risk perceptions, suggesting that individuals differentiate between specific cancers and general cancer risk. These findings offer some confidence that people’s estimates of general cancer risk take multiple cancer types into account.  相似文献

In many surveys, imputation procedures are used to account for non‐response bias induced by either unit non‐response or item non‐response. Such procedures are optimised (in terms of reducing non‐response bias) when the models include covariates that are highly predictive of both response and outcome variables. To achieve this, we propose a method for selecting sets of covariates used in regression imputation models or to determine imputation cells for one or more outcome variables, using the fraction of missing information (FMI) as obtained via a proxy pattern‐mixture (PMM) model as the key metric. In our variable selection approach, we use the PPM model to obtain a maximum likelihood estimate of the FMI for separate sets of candidate imputation models and look for the point at which changes in the FMI level off and further auxiliary variables do not improve the imputation model. We illustrate our proposed approach using empirical data from the Ohio Medicaid Assessment Survey and from the Service Annual Survey.  相似文献

Research into the impact of government ownership on the financial performance of listed companies typically assumes the government to be a monolithic entity and fails to consider that government ownership rights are administered by different types of government organizations. Exploring the financial performance of government controlled listed companies we find that in Malaysia the impact of government ownership varies depending on the type of organization which manages the government's ownership stakes. Taking into account golden Share provisions as well as the presence of senior civil servants and of politicians on boards of Directors, we find that firms controlled by investment organizations under federal government control tend to outperform firms controlled by regional governments’ investment organizations.  相似文献

The increase in ‘atypical’ or precarious forms of work, including part‐time, temporary or agency, contracted‐out, posted, dependent self‐employed and undocumented work, has created one of the major challenges facing trade unions in Europe today. Indeed, the ‘atypical’ has become more and more ‘typical’ in a number of European countries, particularly among women and younger workers. The rise in atypical forms of work calls for changes in the way trade unions develop strategies, policies and structures and presents a challenge to their traditional ways of thinking and organising. This article begins with the definition of atypical work and a general overview of the literature on the subject before moving on to the nature of the challenge it creates for trade unions in Europe and an overview of their responses, drawing on preliminary findings from a three‐year research project in unions in 10 European countries. The article concludes that while unions have made a great deal of progress in addressing the concerns of atypical workers, they will have to make substantial changes to their structures, thinking and way of operating in order to be fully able to respond to the challenge of this growing form of work.  相似文献
