美国版权产业所取得的巨大成就与其不断完善的版权保护制度密不可分。在众多的版权保护制度中,法律的作用显然最为重要。美国现行版权法赋予了美国海关保护版权的重要职责,但是它只能对进口环节的版权提供海关保护。一般情况下,版权的备案是获得海关保护的必要条件,而在版权侵权认定问题上,美国海关不仅在版权所有人与进口商之间保持着客观中立的地位,还承担着事实认定与法律认定的双重责任。     

论案例教学在金融法教学中的必要性

由于对案例教学的重视程度不够,目前我国金融法教学采取的主要还是以课堂讲授为主的教学方式。为了提高金融法教学质量,必须在金融法教学中大力推广案例教学。     

An Equity-based Redefinition of Underemployment and Unemployment and Some Measurements

An attempt is made in this article to redefine underemployment and unemployment without making reference to an excess supply of labor or any causal mechanism of unemployment. Instead, underemployment and unemployment are defined in terms of equity which draws upon the individual's preferences. A specific proposal is that underemployment be defined by the presence of contribution inequity relative to at least half the persons employed in a field that the underemployed person might prefer to move into. Empirically, most recent survey data on preferences for contingent and other nontraditional employment are used to illustrate the application of the concept. The major finding is that nearly 10 million Americans in the nontraditional workforce are underemployed.     

Addressing the Advertising of Controversial Products in China: An Empirical Approach

China is a country that has undertaken a great transformation since the late 1970’s, and among these changes, has seen a massive growth in the advertising industry with the influx of foreign advertisers, and the development of regional and global media, such as satellite television and the Internet. This has resulted in the Chinese people of all ages having a greater opportunity of exposure to different types of advertising, including the advertising of potentially controversial products, which could clash with traditional Chinese values. Using a stakeholder theory approach, this study analyzes the responses of 630 Chinese respondents to discover who is offended by controversial advertisements and determine ways potentially offensive advertising messages can be reduced, thereby assisting marketers in being more socially responsible in their advertising messages.

投资者情绪与企业经营决策之间的关系,是公司金融领域的一个重要研究问题.以往关于投资者情绪的研究文献简单地将投资者视为股票市场上的交易者,而忽视了其作为公司股东所扮演的公司监督者的角色.文章将投资者对企业的监督行为纳入投资者情绪的研究中,利用我国A股上市公司数据检验发现,投资者情绪高涨会减弱股东对企业的监督,而管理层会利用股东监督的减弱进行更多谋取自身私利的行为.文章的研究揭示了一条新的投资者情绪影响企业委托代理问题和CEO机会主义行为的渠道,对于全面认识资本市场在企业经营中扮演的角色具有一定的借鉴意义.
