网络暴力不仅侵害个人法益,而且破坏健康的网络生态。网络暴力概念的失焦,群体聚合作用下个体责任的模糊,表达自由与网络监管的平衡需要,使得网络暴力的治理面临诸多困难。在网络暴力多元共治的基本前提下,除了个体责任的认定之外,应当重视对网络平台的法律规制。不论是从网络技术和传播学的原理还是从法律责任认定的角度,这都是合理的选择。在当下网络空间违法信息与内容的治理中,突出大型网络平台的守门人角色,已经成为国外代表性法案的做法,这也是我国网络暴力规制的重要制度设计方案。网络平台守门人角色的法理内涵,可以从技术措施和义务承担两个角度来具体展开。网络平台守门人制度应当符合我国网络监管模式的国情,重视民法、行政法、刑法等不同部门法的不同规范目标追求,为其合理构建层级性差异,并通过明确可操作的具体规定来落实。 相似文献

Transferring knowledge to an agent makes him more successful or productive, which is beneficial for the principal. However, knowledge transfer also increases the agent’s outside option. I identify two reasons for withholding knowledge — to reduce labor costs within a principal–agent relationship, and to weaken the agent in case of a separation. Moreover, the role of synergy is discussed both for building up a principal–agent relationship and for transferring knowledge. While synergy is decisive for knowledge transfer, cooperation between the principal and agent may even take place in the absence of synergy. Furthermore, I analyze whether the principal is more likely to transfer knowledge to a more able or to a less able agent. Finally, the advantages and disadvantages of a noncompetition clause are briefly discussed. 相似文献

The purpose of this paper is to analyze suppliers' roles in category management (CM) in the context of Finnish and Swedish supplier–retailer relationships. Using data from a survey of a sample of Finnish and Swedish suppliers, the study shows that the concept of CM is well known among both Finnish and Swedish suppliers, and that most of them have experience of CM as a key operational business process. The study also shows that, in general, larger suppliers in both Finland and Sweden have a relatively strong role in CM collaboration, whereas smaller suppliers (especially in Finland) are more likely to have a lesser role in CM collaboration. Suppliers with a strong role in CM collaboration are generally more capable of influencing individual CM tactics than suppliers with an equal role to competitors or those with no role (both in Finland and in Sweden). The study also finds that the effects of CM are perceived more positively among suppliers who have influence in decision-making regarding CM collaboration than among those who have no role in such decision-making. However, the opinions of suppliers who have no role in CM collaboration are neutral, rather than being especially negative. Qualitative studies, including face-to-face discussions with managers representing manufacturers who are more or less excluded from CM collaboration, might provide a more thorough understanding of CM from their perspective. 相似文献

This study investigates the stock return comovement of dividend-paying and nonpaying firms induced by peer effects of dividend payout policies. We consider peer effect as a channel that links a firm’s dividend initiation to firms that did not change dividend status. Dividend initiation attracts investors to the industry and puts pressure on peer firms to change their dividend policy, which leads to return comovement between nonpaying peers and paying firms. Using matched peer firms that resemble dividend initiators, we find that return comovement can be induced through an indirect channel without changes in style or category. Excess return comovement for firms without dividends is observed with dividend payers of the market and their industries through peer influence. 相似文献

There is the need for comprehensive research on the disruptive effects of COVID-19 on international business (IB) in preparation for future disruption. However, we know little about the causal mechanisms of the phenomenon which impacted IB. Based on a case study of a Japanese automotive firm in Russia, we investigate how firms tackle institutional entrepreneurship with firm-specific advantages to overcome the disruptive effects. Consequently, the pandemic increased institutional costs due to greater uncertainty in Russian regulatory institutions. To manage this, the firm developed new firm-specific advantages to deal with the increasing uncertainty of regulative institutions. The firm united with other firms to motivate public officials to advocate for semi-official debates. Our study contributes to extending intersecting studies on the liability of foreignness and firm-specific advantages through the lens of institutional entrepreneurship. We propose a holistic conceptual process model of the causal mechanisms and a novel construct for new firm-specific advantages. 相似文献

Non-Traditional Expatriates (NTEs) are rapidly increasing in the global talent pool, but remains a ‘black-box’ in the Expatriate Management and Global Mobility literatures. This article advances the conceptualisation of NTEs, due to the nascent research field is lacking construct clarity in terms of the meaning of the term as well as an operationalised conceptual framework. Five underlying assumptions in the scarce extant literature are identified and discussed, as a means to responding to the following research questions: (i) how credible is the NTE term as an expatriation typology?; and (ii) how can the conceptual framework of NTEs be operationalised? If these key issues remain unsolved, there is a risk of establishing flawed research design which can negatively affect researchers’ credibility when providing policy advice on global staffing and talent management to international managers and Multinational Enterprises (MNEs).
