关于西部小城镇控规的若干思考——基于《城乡规划法》的视角

《城乡规划法》的实施对我国城市规划体系产生了很大的影响,尤其是控制性详细规划法律地位的加强和镇一级控规的增加,对于我国今后控规的编制和实施有了更高的要求。立足于西部小城镇的发展现状,从新法对控制性详细规划的要求出发,分析了控规在西部小城镇中实施的不足和难点,认为西部小城镇在规划的编制、管理和控规适应性上都存在一定的困难,其中小城镇纷杂的用地权属、《物权法》的实施对控规编制和实施的适宜性提出了更实际的要求。最后列举了部分实例,总结了西部小城镇控规编制的难点并提出相应的解决建议,使得控规能够作为小城镇建设的指导依据。     

人力资本产权视野下企业剩余索取权的配置分析

人力资本产权理论运用于分配企业剩余索取权,有利于提升人力资本的经济利益,形成对人力资本产权所有者的有效激励和约束。本文运用博弈论方法,以剩余索取权作为研究的切入点,旨在从理论上探寻人力资本所有者分享企业剩余索取权的必要性和可能途径,以及由此给企业带来的相关效应。     

发达国家标准与知识产权战略及其对我国的启示

发达国家在国际标准竞争中除了继续巩固自己在国际标准化组织中的主导地位外,还积极实施标准与知识产权结合的战略,力图通过标准与知识产权结合来主导国际市场。我国也应该制定专门的标准化和知识产权战略,以有效应对国际竞争的变化。     

浅谈保险资金投资REITs

2009年10月1日,新修订的《保险法》允许保险资金可以投资于不动产,房地产作为不动产内容之一,可以成为保险资金投资渠道之一。REITs作为房地产市场股权投资的一种方式,具有非关联性、高流动性和高回报率的特点,这与保险经营具有的强外部性、成本滞后性、资金运转周期长等特点相吻合,为保险资金投资房地产搭建了难得的操作平台。通过分析保险资金投资REITs存在风险,并给出相关建议,对我国保险资金投资REITs发展起到一定的指导作用。     

基于城市生活载体（房屋）提供节能减排服务研究

在我国快速推进城镇化中,城市的能源消耗和污染排放问题不断恶化。要想有效控制和改善这些问题应该从城市生活的主要载体--房屋入手,在房屋的使用过程中加强节能减排工作。而市场化的物业管理是当前房屋管理的主要形式,所以以物业管理项目作为整合载体加强节能减排工作是十分必要和有效的。同时,针对节能减排的公共服务属性,提出了政府调控的措施建议。     

从人行法看中国人民银行独立性

中央银行的独立性是其行使自身权力、自主决策与行动的重要保障。近年来,加强中央银行的独立性已成为全球的共识和趋势。文章将以中国人民银行的独立性为切入点,以《中华人民共和国中国人民银行法》为剖析出发点,通过与西方国家的对比,分析当今我国央行的独立性状况及其存在的问题、产生的影响,并探讨可行的解决办法。     

国有垄断性资源产业与竞争性消费产业企业价值比较

本文构建了股权结构、市场结构和企业价值模型,分析十年横截面数据,证实了我国垄断和竞争两极并存、国有企业向资源产业集中的市场结构特征;得出资源产业的企业价值十年来迅速增加,并超过消费产业;发现股权和企业价值存在理论上的倒U型曲线,但资源产业的股权结构超过理论上的最优企业价值股权区间,而消费产业的股权结构低于最优企业价值区间,市场结构对企业价值存在负影响。本文政策建议是：政府降低对资源产业的垄断程度同时引入竞争机制、加强对消费产业的监管时增加集中度,促使我国的市场结构由垄断与竞争两极并存格局向垄断竞争市场结构转化,为技术创新提供最佳的产业组织形式。     

Pure joint production and international trade: a note

This paper applies the principles of the neo-Ricardian (or Sraffian)theory of international trade to certain joint production systems.It is shown that, in contrast with single-product systems, (i)there is not always a pattern of international specialisation,which would entail the increase of the real wage rate in botheconomies, and (ii) the ‘law of comparative advantage’has no general validity. Furthermore, not only the existenceof such a pattern of specialisation but also the validity ofthis law depend on the values of the variables of distributionof income. The analysis is wholly based on two of the numericalexamples formulated by Bidard in 1997, and further generalisedin an elementary way only when this is considered necessary.     

Casinos,casino size,and crime: A panel data analysis of Michigan counties

Growth in legal gaming in the United States over the past quarter century or so is well-documented. One important factor fueling this growth was the passage of the Indian Gaming Regulatory Act of 1988, which permitted Native American tribes to establish, under agreements or “compacts” with the states in which they are located, casinos offering what is known as Class III gaming: slot machines, blackjack, roulette, and other games. Since the passage of the Act, there have been 21 Native American casinos established in Michigan. Also, three non-Native American casinos opened in Detroit in 1999 and 2000. This growth in the number of casinos has sparked a wide-ranging debate over the social and economic impacts of casino development.The purpose of this research is to focus on the crime issue in the broader casino debate. We investigate the impact of these Michigan casinos on the rates of burglary, robbery, larceny and motor vehicle theft (property crimes) in casino host counties as well as in nearby counties. We employ a panel data set with annual observations on all 83 Michigan counties for the period 1994–2010. The dataset includes crime rates taken from the FBI crime data series, variables for the presence of a casino in a county or in a nearby county, the scale of a casino's operations as measured by revenues, and a variety of control variables suggested by the broader literature investigating the factors that determine crime rates generally.Our results suggest that in most cases the property crime rates studied are not affected by the presence or size of a casino in a county or in a nearby county. The largest such impact, which is negative, is for motor vehicle theft. The size of a casino does have a small positive effect on the motor vehicle theft rate.     

欧盟嵌入式智能系统联合开发的知识产权政策评鉴

在工业化与信息化融合的不断推进中,以信息技术为核心的计算机软硬件飞速发展引发信息产业的飞跃,其中嵌入式智能系统(包括软件和硬件)的产业化将成为实现工业化与信息化融合的重要纽带和突破口。欧盟通过建立"联合创新平台"来推动嵌入式智能系统开发和应用,并对联合创新成果的归属、许可、保护、传播、分配、转让制定专门的知识产权政策,确保项目推进。欧盟的知识产权政策将为我国在新型信息技术领域知识产权战略的确立、知识产权管理机制的创新和知识产权法律制度的完善提供借鉴意义。
