Improving process safety by addressing the human element

Celanese had several process safety incidents and near misses in 1996. Although there were several root causes, this article will address only one of them; human error. The system which was developed by Celanese to improve this human element is the conduct of operations system. The conduct of operations system has improved process safety performance of the human element by focusing on three operational areas: training, procedures, and general operations. Conduct of operations is a proactive approach to improve the current practices, improve the support systems and the behavior of the operator. The benefits include the following:

• Consistent application of training and procedures
• Reduction in human error, and
• Less process safety incidents

Comment on The Microsoft Antitrust Policy Case

This paper both responds to Economides analysis and attempts to address the Microsoft case from a broader than U.S. perspective. The importance of the roles played by disloyalty payments, compatibility requirements, information asymmetry and the rather static nature of market definition, particularly in the context of allegations of tying, in the Microsoft case are highlighted. In contrast to the position in the U.S., the European Commission acts for all EU member states and has its disposal the possibility of imposing large fines. However, structural remedies are not available to the European Commission. Comity procedures, by allowing for the inclusion of foreign surplus in domestic welfare functions, offer a model for international co-operation in the future application of competition laws.

我国行政紧急程序之立法完善

行政机关在应对突发紧急事件的过程中,所采取的行政处理方式有别于常规状态下的法律运作机制,这有利于及时有效恢复社会正常运行状态。但紧急情势下,行政权力的行使也表现出较大的优先性、强制性、紧急性,在缺乏有效约束机制的情况下,权力具有被恣意行使和滥用的可能,从而对公民合法权利产生威胁。我国有必要以行政程序立法的方式设定行政紧急程序有关内容,以实现紧急突发事件中公权力行使与公民权利保护之间的平衡。     

快速城镇化背景下的土地征收程序研究

当前我国城镇化进程迅猛发展,但是我国土地征收程序存在诸多缺陷,如征收前征收目的无具体程序可循,审批机制不健全;征收中,农民的知情权被减化,参与权和话语权被剥夺;征地后,补偿难以实现到位,救济制度滞后。主要原因是“公共利益“的法律界定不明确,政府职能混同,程序违法成本低廉。亟需建立“公共利益”的认定程序,改革审批程序,完善公告制度和听证程序,明确补偿费用的分配程序等。     

Hybridization of valuation procedures as a medicine supporting the real estate market and sustainable land use development during the covid-19 pandemic and afterwards

Currently we are facing the pandemic situation that occur all over the world. Regardless the country or even the region, the negative consequences that are expected could be very big and the level of crisis is not predictable. This situation is the challenge for the real estate market as well. Due to this fact, the authors believe that there is the time when deep transformation of approaches, procedures and awareness related to valuation domain becomes. Today, due to the fact of the global COVID-19 and pandemic restrictions is the best time to implement the automated models and advanced technological solutions to the valuation world.The authors proposed the hybrid approach that is the way to reconcile the participants on the property market. Hybrid approach is understanding as the synergy in combining aspects of new (automated solutions) and traditional components that are developed in the agile mode system creation. The proposed solutions can be treated as a cure for some symptoms of the real estate market infection but also as a vaccine, which should to a large extent prevent restrictions and nuisance in real estate valuation in case of repeated infection.
