Understanding organizational justice and its impact on managing employees: an African perspective

The past decade has witnessed dramatic social and political changes on the African continent. The present article argues that these political and social changes may spill over in the workplace in the form of a quest for justice and empowerment. Based on the organizational justice literature, the article develops a conceptual framework that advocates the integration of justice concepts in managing African organizations. It also explains how African managers can anticipate this trend by developing and implementing fair organizational practices.     

论我国《专利法》第三次修改与TRIPS的衔接

2008年12月27日,我国对《专利法》进行了第三次修改。修改后的《专利法》将于2009年10月1日起实施。此次修改是在基本上没有外界压力的情况下,我国自主进行的,共修改36处。从全球化及TRIPS的视角看,此次修改的意义在于：有关在我国完成的发明创造向国外提出专利申请程序的修改、发明和实用新型的新颖性条件的修改、强制许可规定的完善以及外国人委托代理机构的做法,都已经与国际接轨。这是我国专利制度建设的重大进步,也是我国知识产权法律体系完善的一大举措.     

A sectoral approach to Okun’s Law

The study adds to the existing literature on the relationship between output and unemployment by using a sectoral specification of Okun’s Law to capture the differential sensitivity of the unemployment rate to output developments in the services and manufacturing sectors. Using quarterly data for the period between 2000 and 2012, we show that Malta’s unemployment rate has been more sensitive to output developments in the services sector than to those in the manufacturing sector. We use different equation specifications and the youth unemployment rate to show that the impact resulting from developments in the manufacturing sector occurs mainly via lay-offs while developments in the services sector affect the unemployment rate via the hiring of new entrants into the labour market.     

“Social Freedom” in the Twenty-First Century: Rereading Polanyi

Karl Polanyi’s analysis of the genesis, crises, and institutional transformations of contemporary society is grounded on a theory of the basic features and dynamics of capitalism as a peculiar form of society. This article intends to develop this thesis on the basis of a reading of Polanyi’s The Great Transformation, with references to Polanyi’s preceding and later research. Polanyi’s theoretical and methodological achievements suggest a wide comparative outlook and offer a critique of economics, in addition to being deeply connected with his political philosophy. Polanyi’s approach seems to be nearer to the original institutional thought — from Karl Marx to Thorstein Veblen, from Max Weber to Adolf Löwe and Karl William Kapp — than to current neo-institutional tendencies in economics, sociology, and historiography. The hard problems society presently faces suggest the need to adhere to Polanyi’s radical point of view — that is, to a radical approach to Polanyi’s thought.     

关于制订《经济责任审计条例》的思考

本文通过对新修订的《中华人民共和国审计法》和现有的省级《审计监督条例》中关于经济责任审计规定的比较分析,结合中国审计现实情况,提出国务院制定《经济责任审计条例》应明确的一些问题,并提出现阶段应采取的措施。

China and international market integration: Evidence from the law of one price in the Middle East and Africa

We model market integration in the Middle East and Africa by analyzing price dispersion and testing the law of one price (LOP) on highly-comparable actual local retail prices of 135 goods and services across 23 countries in the region over the period of 1990–2016. Second-generation panel estimators are applied to four price benchmarks: Regional average, South Africa, China, and US prices. Cross-regional price dispersion diminishes considerably over time up to 2008, particularly for non-tradeables around China price. The test of LOP indicates the percentage of convergent prices is highest in China price benchmark, followed by US, South Africa, and regional average benchmarks. Direct estimation of the convergence speed confirms this order. Overall, the results show evidence of increasing market integration in Middle East and Africa but it appears to be driven by global forces and, especially, the rise of China as a new economic power. The results show that some emerging market economies, such as China, can step up and promote integration while traditional economic powerhouses, such as the USA and UK, disengage from international economic relations.     

论垂直价格挤压下的接入定价规制

在自然垄断产业引入竞争的过程中,独占传输网络的纵向一体化垄断厂商可能对下游市场新进入者实施接入价格挤压。接入价格挤压从属于价格歧视。尽管一定条件下的接入价格挤压具有正向的竞争效应,但垄断厂商将具有同等效率或更高效率的独立厂商驱逐出市场则应该受到规制。接入价格规制包括政府直接规制定价和反垄断法间接规制定价。直接规制定价中整体价格上限较为可取,而反垄断法间接规制需要采用基于福利后果分析的合理推定原则,但从短期来看采用直接规制更有效率。最后提出了完善我国自然垄断产业接入定价规制的相关政策建议。     

网络拍卖中后悔权之适用问题研究

我国于2014年3月15日实施的《消费者权益保护法》中增加了网络买卖中买家后悔权的条款,然而网络拍卖中能否适用后悔权的规定则是现实中亟待解决的问题。首先,网络拍卖的形式主要有委托网络拍卖与自主网络拍卖两种,网络拍卖网站主要以采用自主网络拍卖为主。网络拍卖合同与传统买卖合同在意思表示、撤销权的适用等方面存在着较大的区别,在适用买卖合同的规定时需要充分考虑其特殊性。其次,后悔权是形成权,同时具有解除权和撤回权两种特质。最后,通过比较欧盟法以及德国法上关于远距离买卖后悔权的规定,区分委托网络拍卖与自行网络拍卖两种形式来分析后悔权在我国网络拍卖中的适用。     

专利之产业应用性含义的逻辑展开

实用性是专利授权的实质条件之一。我国专利审查指南将实用性定义为产业应用性。产业应用性意味着申请专利保护的发明创造具有直接的实践性,可为商业化经营,可稳定地再现,且具备技术性特征。产业应用性的逻辑含义,是对专利成文法、案例法和专利实践的分析总结,根本上来源于专利制度赖以生存的工商业自身规律性。
