我国《企业破产法》第四十六条第二款规定:"附利息的债权自破产申请受理时起停止计息。"但是该条规定是否及于保证人在实务中存在不同的裁判路径。对不同判决的分析,法院比较偏向于保证从债权的范围不应超过主债权,所以停止计息也应当及于保证人。本文从突破保证责任从属性的角度分析,论证破产止息不及于保证人的合理性,并对现在的破产止息制度进行思考。

BIG QUESTIONS IN AUSTRALIAN ECONOMIC HISTORY: FROM THE OUTSIDE LOOKING IN1

The conventional story of Australian economic history is worth challenging. Rather than just assuming a national economy with conventional turning points such as Federation, economic historians would do well to investigate more complex processes like the interplay between regions, races and development, and the changing patterns of interaction with the outside world. The big question for economic historians is whether in the future they can undertake economic research which informs history and so contributes to the national debate.     

Order preserving functions and generalized convexity

In order to better understand the monotonicity properties which characterize the gradient of pseudoconvex and quasi convex funzions, psedomonotonicity and quasi monotonicity can be introduced. A quite different approach is proposed in this paper, by defining new order relations, whose preservation leads precisely to several kinds of pseudoconvexity and quasi convexity. Some general properties of order preservation are proved; they are useful to state necessary and sufficient conditions of monotonicity for particular orders related with generalized convexity.     

Randomized experiments from non-random selection in U.S. House elections

This paper establishes the relatively weak conditions under which causal inferences from a regression–discontinuity (RD) analysis can be as credible as those from a randomized experiment, and hence under which the validity of the RD design can be tested by examining whether or not there is a discontinuity in any pre-determined (or “baseline”) variables at the RD threshold. Specifically, consider a standard treatment evaluation problem in which treatment is assigned to an individual if and only if V>_v0$V>v_0$, but where _v0$v_0$ is a known threshold, and V is observable. V can depend on the individual's characteristics and choices, but there is also a random chance element: for each individual, there exists a well-defined probability distribution for V  . The density function—allowed to differ arbitrarily across the population—is assumed to be continuous. It is formally established that treatment status here is as good as randomized in a local neighborhood of V=_v0$V=v_0$. These ideas are illustrated in an analysis of U.S. House elections, where the inherent uncertainty in the final vote count is plausible, which would imply that the party that wins is essentially randomized among elections decided by a narrow margin. The evidence is consistent with this prediction, which is then used to generate “near-experimental” causal estimates of the electoral advantage to incumbency.

泉州红色资源分布广泛,数量较多;教育意义典型,示范性强;教育手段可感可知,便于学生接受,非常适合对"90后"大学生进行爱国主义教育。而通过调查显示,泉州在对"90"后大学生进行爱国主义教育时,对红色资源的利用情况并不乐观。为此,应加强泉州红色资源教育技术载体的开发与推广;挖掘泉州红色资源独特的精神内涵,引导学生结合自身实际,将爱国主义精神具体化;结合泉州红色爱国主义教育基地开展第二课堂活动;开展以"爱国主义"为主题的校园文化系列活动。
