Wrongful termination: Balancing employer and employee rights—A summary with recommendations

The employer's right to terminate for any cause has been seriously constrained. Recent court rulings and discrimination legislation make employee termination a hazardous undertaking. The prevailing logic is based on the concept of just cause. This concept attempts to balance employer, employee, and society's rights and fit action to the situation. Recommended management action involves little more than careful management of human resources as practiced by well managed firms for many years.     

The Estimation of the Relationships between Water-Natural Gas Usage and Discharge-Emission Permission by Using Binary Logistic Model for the Industrial Establishments

The Thrace region is one of the most important agricultural and industrial regions in Turkey with its plain, deep and productive soil structure. The most important problem is industrial based water and air pollution in this region. In this study, 90 out of 541 establishments that use industrial water in the region were studied representing approximately 17% of the total population. The relationship between water-natural gas usage and discharge-emission permission is estimated by using the binary logistic model. In addition to the economic and social benefits, there are also economic and social losses due to environmental pollution because of the rapid industrialization in the Thrace Region. For example; the rice producers that use Ergene River for irrigation purposes lose efficiency and quality in various levels due to water pollution. According to the research results, an increase in wastewater is a factor that decreases the probability of obtaining discharge permission. Moreover, excessive use of underground water results in decreases in static and dynamic water levels in the region. Because of this result, it is more advantageous for sustainable water management to be directed to the sectors that do not use water for industrial purposes instead of the sectors that use water in their processes.

我国国家审计对公共财政的建设性作用

我国财政正面临由建设型财政向公共型财政的转型。国家审计作为国家财政的监督者,要在构建公共财政中发挥建设性作用,必须及时调整审计策略,针对公共财政面临的主要问题,明确审计发挥建设性作用的内容,主动实现审计转型与财政转型和政府转型相互协调、相互促进,达到促进建立和完善我国社会主义公共财政的目的。

Quits,recission of quits,and constructive discharge in arbitration

This article explores the arbitral criteria involved in cases when grievants quit or appear to quit their jobs, and then change their minds. It looks at factors that arbitrators take into account in determining when a voluntary resignation has taken place. The principles or guidelines for rescinding a quit are also reviewed. When a quit is forced by some action of the employer, arbitrators generally consider this situation to constitute a constructive discharge, and if such a finding is made, will review the discharge to determine whether it meets just cause standards.Donald J. Petersen is also an arbitrator listed on the panels of the American Arbitration Association, Federal Mediation and Conciliation Service, the Public Employee Panels of the State of Iowa, and the Wisconsin Employment Relations Commission. He is a member of the National Academy of Arbitrators.

排污费和可转让许可证制度是基于市场化环境规制的两种手段,这两种手段从理论上讲均能实现外部成本内部化,但可能在执行过程中带来不同的交易成本,对社会环境福利形成不同的收益。由于在制度设计上要获得厂商的边际收益函数和边际控制成本函数,但这种信息的获得很困难。对边际收益函数和边际控制成本函数的不同估计,造成的社会福利扭曲不同。在制度的实施层面,两种制度设计运作机理的不同,在现实的操作层面也会带来不同的排污结果。     

河北省县域经济增长与环境质量变化的个体固定效应分析

除了人均GDP和规模以上工业发展、第三产业发展状况以外,还有许多其他经济因素与非经济因素影响县域污染物排放,各因素对污染物排放量的影响因县域的不同而存在显著差异。污染物排放量个体固定效应越低,说明县域污染物排放量受人均GDP、规模以上工业发展、第三产业发展因素的影响越大,受其他因素的影响越小,反之亦然。人均GDP个体固定效应越低,说明人均GDP受劳动力投入量、固定资产投资、人力资本存量和环境质量因素的影响越大,受其他因素的影响越小。
