署名权是作者为表明其作者身份,在作品上注明其姓名或名称的权利,它是确认创作人具体身份的重要法律依据。我国学术期刊论文中作者署名侵权的现状比较严重。揭示和分析目前论文署名侵权的种种情况,科学认定署名侵权行为,并提出防范的措施。     

A Portable DRM Scheme Using Smart Cards

The Internet is a relatively friendly and convenient environment for allowing music, audio, video files, and other digital contents to be copied, modified, and distributed easily. Nevertheless, from the point view of content owners, copyrights protection and intellectual property rights are critical issues that involve revenue loss. The current digital rights management (DRM) systems provide an acceptable copyright protection solution. The DRM venders usually provide a function allowing consumers to migrate their authorized license from one device to another. Still, this function is restricted by the device type and network domain, which does not completely satisfy consumers' needs. However, a successful DRM system should make consumers willing to use it. Therefore, improving copyright protection convenience for consumers is a significant issue. In this paper, a portable DRM scheme in which the usage-rights follow the consumer, but not the device, is presented for constructing a flexible DRM system that improves portability, therefore allowing users to have content use rights on any devices. In addition, an awkward storage system for encrypted data does not need to be maintained by the proposed scheme, thereby giving a more secure, cost-effective solution.

Beyond clusters: How regional geographic signature affects firm value and risk

Existing studies examining how geography affects firm outcomes primarily consider how clusters affect performance. We examine how regional geographic signature—industry clusters, regional economic diversity, region size, and regional innovativeness—affects firm value and systematic and unsystematic risk using a sample of publicly traded American bank holding companies. After controlling for endogeneity of clusters, we find that locating in large and innovative regions enhances firm value, while locating in clusters and diversifying into many regions reduces value. Clusters reduce systematic risk and increase unsystematic risk, while economic diversity and innovativeness increase systematic risk. Thus, geographic locales exert multifaceted influences on value and risk, and we need to consider more than industry clusters and geographic diversification when considering geographic influence. 著作权纠纷案件法理评析——就“奥特曼”系列典型案例的分析

从2004年年底开始，日本圃谷制作株式会社以中国京、沪、穗三地的4家商业企业和一家制造企业为被告，以被告制作或销售了标有“（C）”版权标识的奥特曼形象产品，侵犯了原告作为奥特曼影视作品著作权人享有的署名权等权利为由，分别在京、沪、穗三地提起民事诉讼。案件涉及的有关法律问题众说纷纭，莫衷一是。本文结合案情，就下列问题作了分析探究：有关知识产权国际公约在我国的适用，涉外著作权的作者身份和原始版权归属，著作权中的经济权利与精神权利孰轻孰重，《世界版权公约》是否不保护署名权，文字作品与立体作品的署名，销售商的合法来源问题，非著作权人在他人作品版权标记上的署名属于侵权还是不正当竞争等。     

Fair e-lottery system proposal based on anonymous signatures

The games in which large amount of money is involved are always called into question about the existence of the possibility to manipulate the game for an immediate benefit. Lottery system is not an exception in this regard; moreover, it is a subject of rumours that the game is not as fair as it is pretended to be. After studying the advantages and drawbacks of conventional lottery systems, the authors are proposing an e-lottery system based on anonymous signatures. Even though the proposal is using electronic signatures, which imply complex calculus and the possession of digital certificates for each player, the proposed system compensates these drawbacks by increasing trust and confidence of both the players and the lottery organizer. This will lead to more players participating in the lottery, which translates to more revenue for the lottery and larger prizes for the players.
