按照现行法律法规、规章,在集体所有的土地上建设的小产权房是违法的行为,城市居民作为购房人不可以请求债务人履行义务,只能有不当得利的请求权.但法律实证主义绝对化易形成"恶法亦法"现象.所以当恶法影响甚众时,仍以法律实证主义剖析现实问题可能并不妥贴,因此继续完善相关制度以解决小产权房问题.  相似文献

In this paper, we consider a one-sector model of economic growth with several infinitely-lived heterogeneous agents, who are endowed with diverse discount factors as well as preferences over consumption. In line with the classical Ramsey model, agents are not allowed to borrow against future income. Unlike the traditional assumption of ex post wage payment, wages are paid ex ante in our model. We first explain the difference between the assumptions of wages being paid ex ante and wages being paid ex post in the framework of a simple illustrative two-class model. Our main result shows that in contrast to the many-agent Ramsey model with ex post wage payment, the capital stock sequence converges to the steady state stock irrespective of production technology employed by the firms. Further, all impatient agents own zero capital stock, whereas the most patient agent owns the entire capital stock from some time onward. Thus, we have shown that a slight modification in the timing of wage payment in growth models can lead to significant changes in the stability properties of equilibrium dynamics.  相似文献

多元化是现代企业发展战略中的一个重要问题。近年来多元化程度下降成为我国上市公司发展中一个主要特征。以2003-2017年沪深两市上市公司为研究对象,考察经济政策不确定性对上市公司多元化的影响。结果显示:经济政策不确定性与上市公司多元化程度显著负相关;对内生性问题进行处理后,这种负相关性在民营企业、高成长企业、非受保护行业的企业以及在金融危机爆发后更为明显。进一步研究还表明:上市公司经营实力、治理环境和股东监督力度的提高,会使经济政策不确定性对降低公司多元化程度的影响有所减弱。政府减少政策变动,保持政策的长期性和稳定性,并在制定经济政策时充分考虑企业的异质性特征,有利于企业多元化程度选择;另一方面,公司也需不断提高自身的学习能力,优化治理体系,增强抗风险能力。  相似文献

Despite a longstanding debate, at both a theoretical and empirical level, research on the relationship between foreign direct investment (FDI) and intellectual property rights (IPRs) remains scant and ambiguous. As a result, the link between IPR strength and multinational enterprises’ (MNEs) propensity to invest is unproven and seemingly dependent on a number of factors. We critically review the theory and evidence of the influence of IPRs on FDI and MNEs’ investment location (country) decisions both to ‘take stock’ of existing knowledge of this relationship and, by identifying gaps in, and shortcomings of prior work, develop a fruitful research agenda. We find that existing empirical work on the IPR–FDI nexus, though skewed in favour of a positive relationship between IPR protection and FDI, is fragmented, inconclusive and unable to square the conflicting theoretical predictions on how the strength of IPRs can affect MNEs’ FDI location decisions. Several issues and challenges are highlighted to explain the difficulties of the collective body of past empirical work to provide a definite answer to the question of the impact of IPRs on FDI, from which valuable recommendations are proposed to guide future applied research.  相似文献

We expand the scope of the two‐aggregate method by applying it to a situation in which many heterogeneous players are free to contribute to both aggregates. Such situations naturally arise in various resource allocation problems. Hence, our method is useful in many applications. A production–appropriation model is employed to illustrate how the problem of establishing the Nash equilibrium can be reduced from solving n>2 best‐response functions in n unknowns to solving two consistency conditions in two unknowns. We then conduct a comparative static exercise that the conventional approach could not handle easily, if at all, to demonstrate the power of our method.  相似文献

The Books of Moses contained economic precepts that made a twofold impact in the history of economic thought. First, Mosaic precepts shaped Israel's transition from a nomadic to a sedentary economy. This transition as such had parallels in many other societies, but Israel's case was unique in that Moses grounded economic precepts on theology. Second, Moses shaped conceptions of economics by Jews and by non‐Jews, in two ways: first, he laid a path for theologically derived economics that continued in Christianity and in Islam; second, he cast terms of reference for the right to own property that were dominant in Western economic thinking until the Enlightenment.  相似文献
