电子商务案件的管辖权问题研究——以网络诽谤为视角

本文试图以电子商务领域中的“网络诽谤”这个话题来客观评价给出的命题。互联网具有跨国性，因此基于一旦进入网络提供商服务器的信息就会同时被全世界的互联网用户可见的网络原理，网络诽谤会形成无数个侵权行为地，对属地管辖权提出了挑战。但是，电子商务涉及的管辖权问题并不是不可以解决的，例如各国发生的一些网络诽谤案例法院都能很好地解决管辖权问题，国际社会对网络民事案件管辖权问题的解决也达成了很多共识，欧盟对电子商务涉及管辖权问题进行了区域统一立法。对于电子商务涉及的管辖权问题应该在传统规则的基础上进行谨慎改良，并且考虑网络的特点综合多种因素来解决，另外，要加强国际间的合作和交流以在这方面达成共识。     

计算机实训课程教学的探索与实践

实训教学是职业技术教育中具有科学性，系统性，实践性和实用性的教学模式，在教学实践中，计算机教师要有计划、有目的性的把课程内容设计成一系列的实训任务开展教学，用学科理论指导实训工作，并使实训活动成为学生理解学科理论的工具。     

采煤行为与地面设施损坏赔偿纠纷举证责任分配辨析

煤矿采煤行为对地面设施产生影响不可避免,由此引发的纠纷也时有发生,合理分配举证责任是解决此类纠纷的首要问题。这篇文章通过对一起案例的简要分析,梳理了与环境污染侵权纠纷有关的法律条文,对举证责任倒置的含义、适用进行了简要阐释,分析了我国在采煤行为与地面设施损坏赔偿纠纷举证责任制度方面的不足。就与环境有关的纠纷案件举证责任分配进行了探讨,提出了进行行政干预评估、委托环境影响司法鉴定的观点,为审理新型纠纷案件的司法实践提供了新思路。     

我国对外反倾销案件的统计分析与启示

运用描述性统计方法,对我国发起反倾销现状进行了分析,结果显示:我国对外反倾销现状与我国作为进口大国的地位并不匹配,特别是对外反倾销执行率和对称率比较低;反倾销调查的产业结构单一、且基本集中在化工行业及资本密集型产业。为此,从研究反倾销法律适用性、发挥法律刚性效应、提升企业的国际竞争力、创新我国应对反倾销战略等层面提出了相应建议。

刑事冤案产生根源探析

刑事案件的判决结果通常涉及被告人的人身自由甚至是生命。因此,刑事案件一旦错判,后果通常非常严重,这也是刑事冤案一直备受关注的主要原因。刑事冤案产生的根源是很复杂的,既有立法的原因,也有执法和司法的原因。立法方面的原因主要有非法证据排除规则的不完善、发回重审制度存在严重缺陷等,司法方面主要有刑讯逼供、忽视无罪证据、降低起诉和定罪标准等一系列原因。     

A Balanced Scorecard for Maple Leaf Consulting

Maple Leaf Consulting is the disguised name for an actual medium‐sized international engineering and environmental consulting firm. In its 35 years of operations, the firm has grown from a single 10‐person office in Canada to more than 3,000 employees worldwide. Despite the growth from providing only specialized geotechnical engineering to many related technical specializations, the firm retained its nonbureaucratic orientation. Now, while emphasizing innovative world‐class technical knowledge, the fictional firm must resolve a series of organizational transition issues, which the actual firm did through the use of the balanced scorecard. The purpose of this case is for students to develop a preliminary balanced scorecard with appropriate measures.     

On a crossroad of resampling plans: bootstrapping elementary symmetric polynomials

We investigate the validity of the bootstrap method for the elementary symmetric polynomials S ^{( k )} _n =( ⁿ _k )⁻¹Σ_{1≤ i 1}< ... < i _k ≤ n X _{i 1} ... X _{i k} of i.i.d. random variables X ₁, ..., X _n . For both fixed and increasing order k , as n→∞ the cases where μ=E X ₁[moe2]0, the nondegenerate case, and where μ=E X ₁=0, the degenerate case, are considered.     

Gas system failure rate

Gasunie buys and sells gas. This paper is about calculating the failure rate of the gas transport system of Gasunie in the Netherlands. The pipes in the network are connected at certain stations which may operate at degraded levels due to technical problems. The transport system, modelled as an optimization problem, needs to be checked for feasibility for every configuration of the degradation levels at all stations in order to see whether the system fails or not. The discrete probability distributions of the degradation levels at every station in the network are given. The number of possible combinations of degradation levels is huge and the computations for the feasibility of the gas network are computer-intensive. This paper presents a new algorithm for approximating this rate and it is parsimonious in actually checking for feasibility.
