我国法律规定了被告人享有辩护权,并且这种权利的行使可以得到律师的帮助,律师在刑事诉讼中的职责就是依据事实和法律为委托人进行辩护,维护其合法权益。但是从现行制度下被告人和辩护律师所享有的权利来考察,很难说被告人真正地、充分地享有辩护权,因为在刑事诉讼中被告人和辩护律师所享有的权利十分有限,辩护律师在刑事诉讼中也不享有完整的辩护权,同时司法现况与被告人获得律师帮助权的基本要求差距甚大。本文对我国被告人获得律师帮助权制度及其运行进行了考察,并对相关问题进行了分析。 相似文献

我国水库移民补偿分为经济补偿和政策补偿两种。当前尽管移民经济补偿已有较大提高,但依然存在移民补偿费偏低,补偿标准低以及对不同地域和身份的移民补偿标准不同等问题;政策补偿产生的实际效果也非常有限,水库移民补偿大多不符合公平要求。为体现对水库移民补偿的公平性,水库移民立法应当规定以政府作为移民补偿法律关系的主体;确立移民补偿投资法律关系的主体地位;以立法形式保证移民补偿方式的多样化;以法律形式规定给予库区经济结构调整的特别优惠政策等。 相似文献

In 1974, in an effort to stimulate discussion on the role played by the Licensed Residential Establishment and Licensed Restaurant Wages Council, Mitchell and Ashton (1974) posed the following question; ‘Wages councils: do they matter?’ The article below attempts to provide a contemporary answer to this question and to widen the scope of the discussion to include the other wages councils which operate within the hospitality industry. The passage of a decade would appear to mark a suitable point at which to carry out such a review. Furthermore the timing is appropriate in that the imminent expiry of an International Labour Office convention has initiated a debate over the future status of the whole of the wages council system in Britain. Consequently it is interesting to consider how the hospitality industry stands in relation to this debate particularly in view of the recent attempts made by the Employment Minister to influence the latest award made by the L.R.W.C. 相似文献

This paper aims to provide a new and practical approach called ‘Legislation-Check’ to identifying shortcomings in national legislation in terms of how well it implements sustainable development, and ways of improving the legislation. National legislation was chosen as it represents a sort of ‘skeleton of society’ and defines the status quo, as well as setting the main environmental, societal and economic directions of the population covered.The approach presented is based on a new concept called ‘3-D Sustainability’, which focuses on the precautionary principle. 3-D Sustainability provides criteria in a flexible hierarchy for solving conflicts of interest between economic, social and environmental dimensions of sustainability. In this paper, these criteria and dimensions are applied to various sectors of Austrian national environmental legislation to identify the shortcomings of the legislation and ways of addressing these shortcomings.This paper shows, by way of quantitative data, a significant increase in the use of sustainability related terms in generally applicable legal instruments (both federal and provincial) in Austria since 2003. In qualitative terms the results of the paper further indicate, using national environmental legislation, several hierarchical disorders between different legal acts and opportunities for improving them. Furthermore, inadequacies in the way that the legislation handles sustainable development and a total lack of overall objectives and targets in terms of sustainability are highlighted, which can jeopardise sustainable development.The concept of ‘3-D Sustainability’ has not previously focused on national legislation, despite the practical importance of the legal implementation and enforcement on this geographic level. Hence, this paper contributes, through scientifically-based decision support, to practical pathways for the innovation of institutional, procedural and substantive arrangements in existing legislation.The approach presented in this paper is not restricted to environmental issues, but is applicable to all thematic areas. It is also not geographically limited, but could be implemented in any country and also beyond national borders.
