The paper analyses preferences of private owners over the degree of property rights protection. It is shown that inequality in resource ownership and/or relative inefficiency of production technologies could make wealthier agents favour less than full protection of property rights. If such agents control the choice of a property rights regime, fully secured property rights will not emerge from the grassroots. This conclusion is consistent with the failure to create an efficient property rights system in Russia. 相似文献

AbstractThis article looks at the ways in which the global brand par excellence – Mickey Mouse – spread throughout Spain in the early 1930s. In tracing the creative and commercial interplay with the Mickey character we show how the Disney Company failed to obtain any significant intellectual property rights in its own name or obtain a sympathetic hearing by Spanish patent and trademark officials. Yet this was undoubtedly a period of significant global development of the Disney brand. With the attempt to explain such an apparent contradictory situation, this article highlights the importance of the management of particular struggles in the flux of desires, appropriation and investments that contributed to the emergence of the elusive ‘merchandising right’. 相似文献

ABSTRACTThe importance of the fair appropriation of co-created value in business relationships has been widely emphasised in the literature. However, in business relationships, value can be both co-created and co-destructed, but what happens to value appropriation when value is co-destructed? Previous studies have focused on what causes value co-destruction, rather than its effects. The question posed is relevant because some actors experience higher diminutions in value appropriation, generating perceptions of inequities, dissatisfaction, and tensions. By analysing data from 39 qualitative interviews with companies that have experienced value co-destruction, this paper attempts to identify the reasons for the unbalanced relationship between value co-destruction and value appropriation. Two higher-level dimensions – awareness of value and awareness of context – are identified and used to generate four clusters of reasons for disproportionate value co-destruction effects. The paper also pinpoints specific actions for managing unfairness from value co-destruction. 相似文献

In the transition from “made in China” to “invented in China,” what is the motivation of Chinese firms in applying for patents? Why do some firms bypass patents? How is patenting developing within Chinese firms? This paper attempts to answer these questions using data of Chinese firms in the Yangtze River Delta region. Results indicate that, for product innovation, obtaining the lead time for market entry is of top priority in innovation protection, followed by confidentiality and patent protection. As for process innovation, confidentiality ranks first, followed by patent protection and obtaining the lead time. There is a significant and positive relationship between prior experience of patent licensing and possibility of future patent licensing. Firms with painful patent litigation experience tend to avoid it in the future. It is also found that there are great differences in patent behaviors between Chinese enterprises and their foreign counterparts. 相似文献

It is argued in this paper that the solution concept of an evolutionary stable strategy (ESS) is an adequate analysis tool for contest theory. Moreover, it is shown that in a contest ESS always differs from Nash equilibrium, the hitherto dominant solution concept in contest theory. In the contemporary ICT environment, we are confronted with a growing number of failing innovations. New technological innovations often fail because too much attention is still given to (technical) product-related features without taking into account the most important parameters of user acceptance. In addition, suppliers of ICT products often lack accurate insight into the distinguished profiles of their (potential) target audience. In this article theoretical considerations and empirical results on this matter are highlighted. First of all, an approach is proposed in which more traditional and often scattered vision(s) on adoption determinants are broadened into an integrated framework. The approach provides a stronger base for better targeting of (new) users of technologies. Secondly, the authors elaborate on this by rethinking these determinants with regard to later adopters. Later adopters (or even non-adopters/users) are often ignored in technology acceptance research. However, especially for policy purposes, the understanding of why people do not adopt or do not use ICT is strongly relevant in the light of the development of an inclusive information society. Both approaches are illustrated by case studies starting from a common list of nineteen ICT appropriation determinants. This framework enables to better profile both earlier and later adopters as well as it allows to formulate recommendations how to bring innovations in the market. Summarizing, this contribution offers an integrated approach on technology acceptance research by bridging the gap between a market and a policy-oriented point of view. 相似文献

While most insider trading is routine and legal, investors still treat it as new information about the firm's prospects—they assume that trades reflect managers' attempts to profit from their private information. This article explores insider trading as a mechanism to appropriate rent from R&D advances. We analyze stock price reactions to over 134,000 insider‐trading events and find that insider purchases generate larger positive stock price reactions for R&D‐intensive firms. Investors seem to assume that managers use insider trading to appropriate rent from R&D breakthroughs. We discuss how shareholders may prefer this rent appropriation mechanism over other forms of compensation that directly reduce the firm's income. Copyright © 2002 John Wiley & Sons, Ltd. 相似文献

The patent system underpins the business model of some of the fastest-growing companies. Used appropriately, it should support frontier technologies and nurture new firms. Used perniciously, it can stifle innovation and protect established technological behemoths. We analyze patent examination decisions at the American, European, Japanese, Korean, and Chinese patent offices and find evidence that patent attorneys have a surprisingly significant role in the patent system. Our results suggest that some forces within the examination system maintain the uneven playing field by allocating monopoly rights to inventors with better access to influential attorneys, rather than leveling it by favoring inventors with better, nonobvious ideas. Attorney quality is most important, vis-à-vis invention quality, in less codified and more rapidly changing technology areas such as software and ICT. 相似文献

Since the 1960s, lesbian, gay, bisexual, transgender and queer (LGBTQ) culture has developed in big cities and metropolises everywhere (not only in the West, but also in Asia, Latin America and indeed Africa). This essay examines how cities provide the spatial conditions necessary for the formation of such emancipatory movements based on identity politics and strategies which transcend binary gender dualism. The starting point of this investigation is my thesis that only urban life enables LGBTQ individuals to live their lives fully, realize their (sexual) identities, and furthermore organize themselves collectively, become publicly visible, and appropriate urban, societal and political spaces. 相似文献
