合同默示条款法律分析

合同默示条款制度为英美法系所确立,其目的在于体现当事人订立合同时的真实意思表示,以补充合同漏洞。默示条款的产生有理论依据,其效力与明示条款不同。我国合同法规定了实质上的默示条款。

汉语会话中评价的语用特性分析

当前语言学界对评价意义的研究主要是在语义语法层面对评价性语言资源作静态描述,未曾探讨评价意义的语用特征。从语用学的视角来考察汉语会话中评价意义的语言表达,其会话中评价意义中存在多种隐性表达形式,有其固有的语用特性。评价表达是语言使用者在特定语境下为了实现交际意图而选用的语言形式和语用策略,不仅具有语义表达式,还有发挥人际修辞作用的语用表达式。     

Public Debt,Terms of Trade and Welfare: The Role of Capital Production Shares,External Balances,and Dynamic (In)efficiency

In view of still large external imbalances across the world economy and dramatically risen public debts in major advanced economies, this paper reconsiders the relationship between public debt, the terms of trade and welfare in a two-good, two-country overlapping generations model with technological differences across countries. We find that the terms of trade effect of a public debt shock depends only on international differences in capital production shares and the dynamic (in)efficiency of the world economy. As in a model with similar capital production shares, domestic welfare rises and foreign welfare decreases when Home has a positive external balance and the Golden Rule holds. Under dynamic efficiency, welfare decreases in the debt-expanding, net foreign creditor country if she has a relatively smaller capital production share, and if the welfare effect through the accumulation channel is negative. In contrast, under dynamic inefficiency she can increase her welfare by debt expansion.

Fiscal policy independence in a European Monetary Union

Do plans for a monetary union in Europe call for limits on the freedom of the country members of the union to use fiscal policy? In order to provide a tentative answer, we simulate the IMF model MULTIMOD, given various shocks, in the case of a European Monetary Union consisting only of France and Germany. The results clearly indicate the possible value of allowing unfettered use of fiscal policy in both countries. The reasons lie partly in differences in the initial position of the two, partly in differences in their preferences. We also examine the change in the policy significance of the current account in the monetary union. Current account imbalances clearly cease to have the same significance in a monetary union; but they do not therefore become irrelevant.     

Extensions of linear diagonal-parameter symmetry and quasi-symmetry models for cumulative probabilities in square contingency tables

For square contingency tables with ordered categories, CAUSSINUS [Annales de la Faculté des Sciences de l'Université de Toulouse (1965) Vol. 29, pp. 77–182] and AGRESTI [Statistics and Probability Letters (1983) Vol. 1, pp. 313–316] considered the quasi-symmetry and the linear diagonal-parameter symmetry models, respectively, which have multiplicative forms for cell probabilities. This paper proposes two kinds of models that have the similar multiplicative forms for cumulative probabilities that an observation will fall in row (column) category i or below and column (row) category j (> i ) or above. The endometrial cancer data are analyzed using these models.
