论仲裁裁决书的物权变动效力

依据物权变动的发生根据,物权变动可以分为基于法律行为而发生的物权变动以及非基于法律行为而发生的物权变动。非基于法律行为的物权变动也需要满足物权法所规定的公示公信效力,赋予某一项法律文书物权变动的效力,必须考量公示公信原则和法律效力类型两个方面的问题。故因仲裁裁决书未能达到物权变动的公示公信主义要求,《物权法》第28条宜适时作相应限缩修改。     

传统知识分子的现代出版之路——以张元济、陆费逵为案例的研究

近现代出版业的兴盛是传统知识分子在乱世中人生道路选择的结果。作为两个典型案例的商务元老张元济与中华书局的创建者陆费逵,他们始终坚持教育、文化救国的出版理念,在20世纪上半叶的出版舞台上演绎了传统知识分子的忧患意识与务实品格。     

Ownership dynamics and firm performance in an emerging economy: a meta-analysis of the Russian literature

This paper provides a meta-analysis of studies on the effect of ownership on the performance of Russian firms over 20 years of rapid institutional and economic changes. We review 29 studies extracted from the EconLit and Web of Science databases with a total of 877 relevant estimates. We find that the government negatively affects company performance regardless of its administrative level. In contrast, private ownership is positively associated with firm performance. However, the effect size and statistical significance are notably varied among different types of private ownership. While the effect of insider (employee and management) ownership is comparable to that of foreign investors, the effect of domestic outsider investors is considerably smaller. Our assessment of publication selection bias reveals that the existing literature does not contain genuine evidence for a series of ownership types and, therefore, some of the findings have certain limitations.

网络科技论文是一种新兴的学术资源,系统、全面的学术影响力评价能够为科研人员正确选择网络学术资源提供参照标准。本文以知识共享为理论支撑,从知识共享主体的角度,提出了作者权威性、专家评价、读者认同度三个维度,结合网络发表科技论文的特点,通过单样本T检验选取了相关的14个测量指标,并运用层次分析法确定了相关指标的权值,从而构建了网络科技论文学术影响力的评价指标体系。     

出版物转售价格维持的逻辑思辨与适用——基于反垄断法视角

是否维持出版物转售价格,一直是个颇有争议的话题。各国的基本态度是以反垄断法予以规制,赞成出版物转售价格维持者认为它可促进出版物的多样性发展,出版物的多样性必须依靠转售价格维持。虽然出版物转售价格维持在一定程度上有利于保护出版物多样性,但基本原则还必须尊重市场规律,利用竞争促进出版物的多样性。竞争也是最有效的方式,总体上讲,我国出版物转售价格应受我国反垄断法的规制,但在具体规则适用上则应区别对待。对于构成反垄断法中纵向限制竞争的行为,若涉及到国家基础政策且存在公共利益可根据相关法律予以豁免,否则,应坚决予以规制。     

基于开源GIS的城市基准地价信息发布平台的设计与实现

采用开源的Geotools平台和jfreechart软件作为基础,基于Java Applet构建小型城市基准地价信息发布平台.平台的构架设计以定级估价数据库标准为基础,紧密结合城市基准地价信息发布工作流程和数据流程,并且采用Java的远程对象和相关的远程方法调用(RMI)作为权限控制设计的模式,实现了能够执行城市土地级别、基准地价、标定地价等空间信息在多用户条件下的图形显示控制、属性查询统计以及图属互查等复杂操作的基准地价信息发布功能,可以满足目前国内大多数中小城市的基准地价信息发布的需求.     

Research Performance of Turkish Economists and Economics Departments: Another Update and a Review of the 2000s

This article discusses publication performance and patterns of Turkish economists by analyzing changes overtime and comparing results to economists’ performance in some emerging economies. The results indicate that (1) the publication performance of Turkish economists and economics departments has improved rapidly over the years but they are still performing below their potential; (2) there is a remarkable difference in research performance among the institutions, but competition has been increasing; (3) the majority of contributions to research output in Turkey are made by six leading universities, but competitive pressure is coming from other institutions; (4) the faculties of the six leading universities are highly motivated to publish in high-quality journals, while members of the other institutions are also increasingly eager to find themselves a place in these outlets; (5) more than one-third of the articles are published in 10 of the 350 Social Sciences Citation Index (SSCI) Economics Journals, but the concentration ratio is decreasing overtime; (6) publication performance and patterns of Turkish economists are similar to their counterparts in emerging economies, but in some aspects Turkish economists perform better.     

The global permutations of the Western publication regime

This article introduces the concept of the ‘publication regime’ into the current discourse on academia. This allows for a much deeper understanding of how publishing conglomerates and appointment and promotion procedures in Western universities are increasingly interlocked. It then turns to the global permutations of that regime as it is currently disseminated to other parts of the world. Using empirical examples drawn primarily from the field of tourism studies, we examine the problems engendered by the introduction of the regime’s appointment and promotion procedures of early career academic staff in universities in the emerging world regions. We specify the auxiliary mechanisms intended to ameliorate these problems, and draw attention to the neo-colonial implications of the disciplining process which these mechanisms are introducing into the academic life of the universities in the emerging regions. We argue that, as the Western publication regime is becoming increasingly globalized, local intellectual voices tend to be silenced by the regime’s growing hegemony, and call for the integration of non-Western perspectives into the framework of the publication regime.     

关于完善我国上市公司信息披露问题的思考

上市公司信息披露是股票市场的核心问题之一。目前我国上市公司信息披露在及时性、充分性、准确性、公正性等方面存在诸多问题。其原因与我国上市公司体制、法规制度建设、监管、审计执业水平等密切相关。提高上市公司信息披露质量，必须从改善上市公司的治理结构、完善会计审计制度、加强执法力度等方面入手，才能使信息披露向规范有序方向发展，充分发挥其在证券市场中积极有效的作用。
