类型化是立法机关规制公共利益的主要方法,是公共利益多样性、发展性、复杂性的客观要求,也是从立法技术上将公共利益具体化的有效途径之一,其能够为公共利益执法和司法提供操作性较强的制度规范。我国学界对公共利益的分类,并没有区分公共利益在不同学科中的不同意义,也没有区分法律中与日常生活中的不同意义。同时,这些公共利益的类型划分过分抽象和狭隘,缺乏法律上的可操作性。公共利益类型非常丰富,不仅包括经济利益,还包括非经济利益;不仅包括物质形式的公共利益,还包括精神层面的公共利益。 相似文献

Fundraising techniques used by charities can enhance or diminish public trust. The dangers of questionable and over-aggressive fundraising practices are very real. In particular, in the UK, the ‘Olive Cooke affair’ in 2015 triggered a highlevel examination of fairly widespread dubious practices. In this article, the reflections of a key actor on the events surrounding the affair, and subsequent fallout, are examined. It is argued that this whole saga has the potential to encourage the development of a charity sector that is more trusted by the public; a sector that has stepped back from the abyss. 相似文献

Trust is essential for the success of change, but transformational change challenges trust. This paper analyses how trust dynamics develop over time in two Danish manufacturing firms affected by major change programmes. The results show that change creates uncertainty among employees, thereby provoking intense scrutiny of management intentions and a tendency to make interpretations that exaggerate management intentions—with the end result of reduced trust. Management then react similarly with negative interpretations of employee reactions, creating a vicious cycle of reduced trust. The paper proposes a model for how change and trust interact and suggests a managerial strategy for trust repair: Strong management actions that symbolise integrity, competence and benevolence may counteract reduced trust, but if low trust turns into distrust, the result may be a deadlock that both parties find difficult to break. 相似文献

This paper clarifies the nature of nonprofit accountability by distinguishing between the substantive and processual understandings of the public interest. The major theories of the nonprofit sector are shown to imply that this sector's activities correspond to the public interest only in its processual understanding, but not in the substantive one. Our article aims at understanding the determinants of households’ selective waste-sorting behaviours, based on data from an original survey of 694 individuals in the French Provence–Alpes–Côte d’Azur region. The applied literature focuses mainly on countries with high recycling rates. We focus on a region with the lowest recycling rate in France, a country that recycles less than the European country average. We first apply polychoric principal components analysis to reduce the number of explanatory variables to a set of six factors. In a second step, we use a probit model to estimate the probability of waste sorting as a function of these factors. This model tests several hypotheses emerging from the recent literature on behavioural economics applied to households’ selective sorting. This literature pays particular attention to the social influence on recycling behaviour, which has been studied mostly by sociologists and psychologists. The results of our empirical analysis confirm some of the findings in the literature. However, they also highlight some unique features, such as social influences having a negative impact on recycling. This finding contrasts with most of the literature, which finds a positive relationship of social influence on pro-environmental behaviour. 相似文献

The public sector is increasingly turning to social media as a means to communicate and interact with citizens, but little is known about the contribution that these social technologies make to public engagement. This paper used a scoping literature review of studies examining social media in order to develop a framework that measures two Facebook features (popularity and commitment), which was then used to evaluate two different levels of public engagement (public communication and public participation). The framework was validated by applying it to the Facebook pages of several Italian city administrations, and a social media engagement matrix was proposed to interpret the findings. 相似文献

The 2009 Malaysian Government Transformation Programme (GTP) could be useful as a model for reform given its positive impact on improving public services in targeted key result areas. This paper assesses the GTP's approach in the context of the wider debate on whether reforms should be based on best practices or whether they should be diagnostic or problem-solving in approach. The GTP's success was largely the result of blending both approaches. The GTP experience in Malaysia provides a number of insights and lessons for delivering intelligent reforms quickly and effectively. 相似文献
