美国农地征收制度及其对中国的启示

美国的农地征收制度已经有200多年的历史,其在长期的司法实践中积累的法治经验是人类优秀文明共同的成果,对当前中国正在积极推行新一轮的农地征收制度改革具有重大的借鉴意义。文章通过对美国的土地制度、农地征收的宪法准则、农地管制性征收和补偿机制的研究,以发现我国农地征收制度上的不足,并借鉴美国成熟的市场机制和法制框架下的农地征收经验,对中国当前农地征收制度的改革提出一些立法建议。     

传者中心论到受者中心论——从《东方时空》看电视新闻受众观念的变化

在我国传播者的社会角色也经历了从计划经济时代向市场经济时代的转换 ,其强制化、权威化的特点逐渐减弱 ,服务特点逐渐加强 ,走的也是一个从“传者中心”到受者中心的路子 ,到九十年代后 ,大量在传播活动中的经验和教训让人们逐渐认识到受众不仅仅是服务对象 ,它也是接受主体。而且 ,应该是一种传播活动能否实现的最关键的环节。中央电视台《东方时空》节目对此进行了成功地探索     

大陆法系处分原则的发展趋势及对我国民事诉讼的借鉴

处分原则作为我国民事诉讼的一项基本原则，其干预性受到理论界的质疑。然而，纵观德、法大陆法系国家对处分原则的规定，其程序事项的干预性有加强之势。在我国民事诉讼法修订之际，应借鉴德、法两国对程序事项的国家干预，而不是任由当事人随意支配。     

The Risk‐Taking Channel of Monetary Policy in the U.S.: Evidence from Corporate Loan Data

To study the presence of a risk‐taking channel in the U.S., we build a comprehensive data set from the syndicated corporate loan market and measure monetary policy using different measures, most notably Taylor (1993) and Romer and Romer (2004) residuals. We identify a negative relation between monetary policy rates and bank risk‐taking, especially in the run up to the 2007 financial crisis. However, this effect is purely supply‐side driven only when using Taylor residuals and an ex ante measure of bank risk‐taking. Our results highlight the sensitivity of the potency of the risk‐taking channel to the measures of monetary policy innovations.     

企业数字化转型对绿色创新的影响研究

“双碳”目标下,数字技术应用成为企业推动绿色创新的重要途径。本文基于资源基础理论,以2009—2019年中国A股上市公司为样本,探讨企业数字化转型对绿色创新的影响机制。结果表明：企业数字化转型能够正向促进绿色创新;相比民营企业,国有企业数字化转型对绿色创新的促进作用更强;制度环境正向调节了数字化转型与绿色创新之间的关系;而战略风险承担则在数字化转型与绿色创新起负向调节作用。进一步机制分析发现,技术资本和融资约束在企业数字化转型和绿色创新之间发挥了中介效应;异质性分析发现,在我国东部地区,开展创新合作及高管党员比例较高的企业中数字化转型对绿色创新的促进影响更为显著。研究结论对我国企业的数字技术应用、绿色转型具有重要意义。     

温州金融改革对参股银行公司股价的影响——以新潮实业为例

新潮实业作为上海证券交易所A股上市公司,其参股的银行由于参与小额贷款公司业务,在温州金融改革过程中,对新潮实业带来了显著的影响。从定性与定量两个维度的分析表明:金融改革对参股银行公司的股价具有短期的刺激推动效果。其原因,一方面是股民期待金融改革以后未来经济走势向好,认为未来中小企业的迅速发展势必会引包括中小额贷款业务在内的银行业务的繁荣;另一方面是由于我国A股市场存在着高度的投机性,部分股民进行短线投机操作而为。     

Market structure and diversification of mutual funds

This study characterizes a systematic relationship between the diversification incentives and the market structure of the mutual funds industry with investors differentiated by their attitude towards risk. With sufficiently low competition the subgame perfect portfolio equilibrium exhibits maximal risk differentiation. With intensified competition intermediate funds, i.e., those attracting investors with intermediate attitudes towards risk, select diversified portfolios. Finally, we offer a general characterization of how imperfect competition between risk-differentiated funds will generate an equilibrium relationship between risk and expected returns.     

Banks’ Interest Rate Risk and Search for Yield: A Theoretical Rationale and Some Empirical Evidence

We investigate German banks’ exposure to interest rate risk. In finance, higher demand for a risky asset is typically associated with higher expected return. However, employing a utility function which implies both risk‐averse and risk‐seeking behavior depending on the level of profits, we show that this relationship may get weaker and even change its sign at low profit levels. For the period 2005–14, we find not only the common positive relationship of higher expected returns and rising interest rate exposure but also that this relationship does become weaker with falling operative income, its sign eventually changing.
