集资诈骗罪若干认定问题探析

在集资诈骗罪认定方面存在着一些问题,不存在以存单为表现形式的集资诈骗行为;区分本罪既遂与未遂应以行为人是否实际控制集资款为标准;并具体分析了本罪罪数形态中法条竞合与牵连犯的认定,以及共犯中如何确认犯罪数额的问题。

Study on how to elevate the discriminating ability of the discriminating model of the financial statement fraud

By summarizing the factor of the financial statement fraud in existing research outcome, the paper confirms the discriminating characteristic of the financial statement fraud and sets up a theoretic model to discriminate the financial statement fraud. Using radial basis function neural network, regarding to the swatch that the listed company that is punished by the Securities Regulatory Commission or the Ministry of Finance, and according to the clustering elements, validating across by set one aside, the paper verifies respectively the 22 characteristics and 31 characteristics of discriminating model. According to the clustering elements, validating across by set one aside, the paper verifies respectively the 31 characteristics and 8 characteristics selected by Fisher-ratio of discriminating model. The research outcome indicates the discriminating ability of the model including 8 characteristics is better elevated than the traditional model including 31 characteristics by comparing the disciplinary error and the forecast precision.

财务报表分析是现代经济生活中非常重要的一门课程,但也存在着诸多与形势发展不相适应的地方,需要以战略为导向来构建财务报表分析框架和前景分析的路径,着力在课程名称、课程内容、课程教材、课程教法、课程文献等方面加强建设,培养学生运用专业知识的综合能力。     

农村金融联结的风险评价——以山东省大村镇食用菌合作社为例

农村金融联结作为一种解决金融抑制问题的有效途径，已经得到理论证实和实践推广，但对其风险的认识尚处于空白。鉴于农村金融联结涉及多个经济主体的特征及相互利益关系，本文以联结的风险来源为基础，构建了农村金融联结风险的评价体系，对山东省大村镇食用菌合作社联结的风险进行了评价。研究认为，大村镇食用菌合作社农村金融联结风险较低，能够实现农村金融联结的目的。其中有利的自然、政策和产业等外部环境以及龙头企业与合作社形成的稳定联结关系有助于降低联结风险，而参与者间的利益冲突及自身能力约束增加了联结的风险。     

Measuring market distortion: international comparisons,policy and competitiveness

This paper develops a framework to simultaneously estimate production possibility frontiers and measure distortions in factor and product markets. The econometric results, based on a panel of 61 countries over the period 1970 through 1985, reveal very little distortion in factor markets but considerable distortion in product markets. In addition, the distortions tend to vary with the cyclical behaviour of economic activity. Further, the results suggest that in order to improve efficiency, commercial policy should aim at reducing product-market distortions rather than factor-market ones.

A Reconsideration of the Protectionism Debate: Keynes and Import Controls

One of the most important elements of financial crises is the credit restriction that follows and the immediate consequences it has on investment and employment. In the post-Keynesian vision, an exit from economic crises frequently requires increased demand, specifically through public expenditure and employment. Furthermore, it requires the exploration of various policies and institutional reforms that could counteract the credit rationing emerging from the first moments of the financial crisis, particularly in regard to the financing of small business. This is one of the principal lessons this paper explores when studying a sample of Mexican immigrant entrepreneurs in three cities in the United States, and their conditions of survival amid the financial crisis.
