仿冒行为的法律规制

随着日渐激烈的市场竞争,竞争者为了谋取最大利益,取得市场优势,便采取各种不正当竞争行为。仿冒行为便是较为突出的一种。我国《反不正当竞争法》以及相关法律对此已有相关规定,本文通过相关法律对仿冒行为的概念、特征、条件、认定、责任以及其与假冒行为、冒牌行为的区别的探讨,以期加深对仿冒行为的了解。     

Consumption,Resistance and Everyday Life: Ruptures and Continuities

This paper makes the case for regarding political consumption and more generally individual collective action as an instance of “everyday resistance.” In doing so it seeks to make connection with the political case against representative politics, one that stretches back to the origins of “official” politics at the start of the 19th century. Three moments in the history of the idea of everyday resistance are presented: Max Stirner’s egoistic individualism, Leo Tolstoy’s critique of violence, and Agnes Heller’s evocation of the everyday as a site of civic courage. The examples show the longevity and persistence in political thought of the idea of the individual as the locus of social power, one that puts it at odds with the normative assumptions of theories of representation. They also show the dangers of assuming that individual collective action can unproblematically be considered a form of participation in democratic processes as opposed to a resistance against incorporation into mainstream or “official” politics. Rights which are often at the core of efforts of activists become remodelled as a weapon of contingent “everyday” struggles as opposed to a universal or transcendentally posited phenomenon.

补贴是一个相当复杂的议题,其复杂性不仅表现在概念上,也表现在它可能产生的效果上。补贴可能增加也可能降低其受体的利润水平;可能对国际贸易产生扭曲效果,其影响也可能仅限于国内;可能有助于政府实现其意欲达成的目标,也可能背离其初衷;可能增加或降低政府收益,也可能无影响。把补贴宽泛地界定为有可能在短期、中期或长期对其受体的利润水平产生影响的政府作为(或不作为),有助于使决策者把关注重点转向补贴效果,从而有利于其做出应否维持、增加、减少或消除特定补贴的判断。     

The twilight world of British business politics: The Spring Sunningdale conferences since the 1960s

This article explores a previously unknown form of interaction, known as Spring Sunningdale, between the British business elite and its civil servant equivalent in Whitehall. These began in 1963 and were still continuing only a few years ago. The continuity and stability of these meetings stands in contrast to wider changes in the nature of business–government relations in Britain during this period, particularly since the election of the Thatcher government in 1979. The article analyses why there was such continuity and what the senior civil servants and the captains of industry who attended these annual meetings gained from them.     

Unveiling ways to reach organic purchase: Green perceived value,perceived knowledge,attitude, subjective norm,and trust

This paper aims to investigate organic food consumption based on the perspectives of an extended research model by integrating the theory of consumption value (TCV) and the theory of reasoned action (TRA). First, we tried to find out how five consumption values of functional, social, emotional, conditional, and epistemic in classic TCV influence consumption choice especially in the sustainable consumption domain of organic food, interpreted as green perceived value (GPV) in the reflective-reflective second-order latent. Second, as an attempt to extend the classic TRA, this study included trust and perceived knowledge in the research model in addition to the subjective norm, attitude, and behavioral intention. A partial least square structural equation method (PLS-SEM) was adopted to examine our research model with 251 samples. Our results revealed that GPV significantly affects consumer attitudes. Consumer attitudes and subjective norms also have a significantly positive effect on purchase intention. As an extended TRA, GPV has a significantly positive effect on trust while trust significantly impacts purchase intention. Further, perceived knowledge positively influences attitude and trust. By jointly considering TCV and TRA, this study proposes several implications emphasizing how GPV and perceived knowledge affects consumers’ organic food consumption choice based on the role of increased trust.
