Employee and management rights and responsibilities under the Americans with Disabilities Act (ADA): An overview

The Americans With Disabilities Act (ADA) significantly expands the rights of disabled individuals in their access to employment opportunities, services, telecommunications, public accommodations, and transportation. This article provides an overview of the ADA with a particular emphasis on employment issues under Title I of the Act affecting the rights and responsibilities of disabled employees and employers. Permitted and prohibited actions by employers are discussed, as well as factors used to determine the definition and application of key terms under the Act. Some potential impacts of the ADA on the interests of disabled individuals and employers are discussed. Recommendations for effective management policies to comply with the employment provisions of the ADA are also included.     

基于无助理论的残疾人旅游障碍与旅游参与意图关系研究——结构方程式模型的应用

残疾人是社会的重要组成部分,残疾人旅游市场是我国一块有待开发的处女地,开发残疾人旅游市场有利于完善我国的旅游市场。本研究以残疾人为调查对象,利用无助理论对其旅游障碍、旅游参与意图等进行了实证分析。通过结构方式模型发现:残疾人的旅游障碍因子有3项(本能障碍、交流障碍、环境障碍);旅游障碍因子与旅游参与意图之间无直接显著性影响;残疾人旅游障碍因子中除了交流障碍因子外,本能障碍、环境障碍对无助感有正(+)的显著性影响;无助感对旅游参与意图间有反(-)的显著性影响。最后,在分析本研究结论的基础上提出了本研究的不足和未来的研究方向。     

The Structured Interview: Reducing Biases Toward Job Applicants with Physical Disabilities

Research shows that the traditional job interview is a poor indication of a candidate's potential. However, when employers structure the interview process, they are more effective at predicting success, forming consistent evaluations, and reducing discrimination. The current study tested whether the structured interview also serves to reduce biases involved in interviewing applicants who have a physical disability. In the non-structured interview, results showed that there was a leniency bias, where raters evaluated disabled candidates more positively than equally qualified non-disabled candidates. Structured interviews reduced this effect. These findings add to the support for the structured interview as a way of increasing fairness in employee selection.     

Meeting the on‐line needs of disabled tourists: an assessment of UK‐based hotel websites

The easy exchange of rich information between often geographically dispersed parties is an important precursor of successful tourism transactions. Internet‐based technologies, in particular the World Wide Web, offer possibilities to both buyers and sellers to exchange information without the constraints of geography and time diminishing its richness. The disabled, representing a significant part of any marketplace, may, however, have difficulties accessing the content of the Web and therefore sharing the benefits of rich information exchange. This is the principal concern of ‘Web content accessibility’. Focusing on the tourism sector, in particular UK‐based hotels, this paper examines the accessibility of their websites. However, recognising that it is not just access to information that is important for the disabled, but also the quality of that information, the paper also examines the extent to which the information contained on websites serves their particular needs. Utilising the accessibility testing software ‘Bobby’, disappointingly low levels of Web content accessibility were found amongst the sample of websites. Against a framework of information needs developed from criteria provided by disability organisations, the sample also revealed disappointingly low levels of specific (relevant) information for the disabled. 中国残疾人共文化形成的文化价值观维度考量

文化与价值观关系密切，相互影响。对于主流文化中共文化的形成，价值观往往具有重要的作用。利用荷兰学者Geert Hofstede的文化价值观维度理论对中国残疾人共文化的形成进行分析，有利于我们了解残疾人共文化背后的深层文化内涵，为更好地了解残疾人群体及给予残疾人群体更多关怀提供帮助。     

残疾人的社会保障对消费需求的影响探析

残疾人是社会中处于最不利地位的弱势群体,其生存与发展的权利因社会排斥而受到侵害,很难在社会经济生活中享受平等、参与、共享的权利。加强残疾人社会保障体系建设是促进残疾人改善生活、减少贫困的根本途径。构建了残疾人社会保障与消费、收入的误差修正模型,利用2009年残疾人监测数据,探讨了当前社会保障特征对残疾人生活消费的影响,发现目前的社会保障不能减少残疾人不确定性预期。     

In the quest for their trust: the perceptions of families on accessing leisure services for disabled children

This paper is based on the findings of a research project commissioned by a public body in the English Midlands, UK. Telephone surveys, focus groups and individual interviews were the data collection methods. It focuses on the perceptions of 44 families on the barriers to accessing leisure services for disabled children. Although there are numerous advantages for accessing such services, the findings showed that the families had very few successful experiences with the current provision due to a number of structural barriers. Trust was perceived as crucial to access these services.     

中国残疾人社会保障体系框架设计

作为社会弱势群体之一,中国残疾人群的基本生存状况令人担忧,迫切需要健全的残疾人社会保障体系来维护基本权益。利用2006年中国第二次全国残疾人抽样调查数据,描述了残疾人群收入贫困、就业困难、教育、医疗服务、康复等基本需求不能得到满足的生存状况,就此提出建立“多支柱、梯度扶助”式残疾人社会保障体系的框架设计。

非盈利性医疗机构作为社会公益事业的一部份,不但要结合自身工作特点有效开展助残扶残工作,将学科建设发展融入其中,为残疾人事业贡献力量,获得社会与经济效益双丰收,更要体现出医疗机构做好残疾人管理工作的价值。     

论我国残疾人就业的法律保障——长三角地区地方性法规、规章的比较分析

扶持和保障残疾人劳动就业,是解决其生存发展、改善经济状况、实现自身价值和社会价值的根本途径,是保障其就业权乃至其人权的基本体现。从残疾人就业现实状况出发,研究当前扶持残疾人就业的主要模式和长三角地区法规和规章,分析其中存在的问题与缺陷,有针对性地提出完善建议,以期最大限度地保障和扶持残疾人就业。
