Violations of Service Fairness and Legal Ramifications: The Case of the Managed Care Industry

Adapted from Chan's (2000) model depicting success of litigation, this paper argues that with the application of various legislation, health maintenance organizations' (HMOs') violations of service fairness to each group: enrollees, physicians, and hospitals give rise to each group's lawsuits against the HMOs. Various authors (Bowen et al., 1999; Seiders and Berry, 1998) indicate that justice concepts such as distributive, procedural, and interactional justice can be applied to the area of service fairness. The violation of these underlying justice principles with HMOs' service unfairness to enrollees, physicians, and hospitals is examined. A general synopsis of the ethical issues in the managed care industry is provided. The various lawsuits launched by each group: enrollees, physicians, and hospitals together with the key statutes used are discussed. This paper also highlights the provisions and ramifications of the 11 April 2000 landmark agreement that Aetna made with Texas Attorney General John Cornyn to settle the 1998 lawsuit brought against the company. Lastly, the current ethical issues in the managed care industry are further discussed. The value of this paper can be adapted to the study of organizations' service fairness violations in other industries or in the educational, governmental, and not-for-profit sectors both nationally and internationally.     

人的现代性与人的心理健康特征之关系探讨

本文在国内外关于人的现代化研究的大背景下,通过比较“人的现代性”和“人的心理健康”两者概念、内涵与外延、有关标准的异同,认为:(1)人的现代性应具备一定的心理健康要求,提高人的心理健康水平是实现人的现代性的保证。(2)现代人的心理健康问题应置于人的现代化的语境下来思考和发掘。     

Structure of interstitial assemblages in a regulated channel of the river rhine (France)

The interstitial assemblages of the River Rhine were studied in the Rhinau sector (France). The studied area is located in aVegulated channel of the river, controlled by a hydroelectric dam. Twenty stations were sampled in September 1988. Ten litres of interstitial water were pumped at 50 cm depth in each station using the Bou-Rouch technique. Interstitial waters were poorly oxygenated and the hyporheic fauna had three major characteristics: (1) microcrustaceans were dominant, (2) the insects were rare and (3) the stygofauna was absent. The richest stations were well oxygenated and did not correspond to any particular geomorphological features. These findings contrast with the situation observed on other large European rivers (Rhǒne, Danube) where the interstitial assemblages appear to be locally more diversified and rich in stygofauna.

MIKEII 软件系统在穆棱河流域面源污染估算中的应用

穆棱河流域面源污染入河量调查和估算采用了MIKEII软件系统，根据水质、水量实测数据，在参数率定和模型验证的基础上．对穆棱河部分河段的水质进行模拟，拟合出面源入河量和年内分布。经验证计算结果较其他方法更合理可靠。     

依靠弯道控导河势流路

在天然河道中，河势演变虽具有一定的随机性，但仍有一定的规律可循，在一个河段内，一般可归纳出2－3条基本流路，为控制河势变化，需要选择出一条基本流路进行河道整治，当连续发生枯水期或洪水期时，部分河段的河势可能出现大的变化，为防止不利河势向下游传播，可修建较长的龙头弯道工程，利用龙头弯道工程分段调整，控导河势，保持河势稳定。     

长江重要堤防安全监测技术的应用与发展

长江重要堤防安全监测工程中,对主要穿堤建筑物、重要堤段都布置了安全监测设施.两年多来的监测过程中,获得了大量的监测资料和信息,为评价防渗墙的渗控效果及穿堤建筑物的运行状况提供了科学依据.防渗墙是堤防加固和防渗处理的主要工程措施之一,通过监测资料分析,防渗墙的实施有效地改善了堤身、堤基的渗流状态,不同结构形式的防渗墙所起的截渗效果是不一样的.穿堤建筑物内部监测由渗压计、测缝计、位错计和界面土压力计组成,为穿堤建筑物安全运行状况和施工质量评价提供了科学的依据.堤防安全监测新技术的开发与应用研究拓展了传统的安全监测领域,先进的安全监测技术在堤防工程建设中将得到广泛应用.
