美国反洗钱机制及对我国的启示

近年来,我国政府加大了反洗钱工作力度，反洗钱和反恐融资工作逐渐走上正轨，但与该领域的国际标准相比,仍然有较大差距.美国作为全球反洗钱领域的带头羊，其反洗钱的运作和手段确有高明之处。夏我们要善于学习和借鉴国际经验，不断发展与完善具有中国特色的反洗钱机制。     

发展电子商务面临的问题与障碍分析

针对目前电子商务发展过程中出现的问题,笔者提出了要用科学的发展观对待和解决信息时代出现的网络经济新问题。在对我国电子商务发展现状以及问题与障碍进行详细分析的基础上,提出了解决问题的对策与思路。     

Barriers to employee rights: Gender,selection, and the labor process

This article applies a labor process analysis to the issue of employment rights in the particular context of gender inequality and unlawful discrimination in the recruitment process. It criticizes conventional perspectives on employee rights for their failure to examine critically managerial power and prerogative and its implications for gender inequality. The article outlines two particular labor process theories of gender divisions and inequality. In exploring the strengths and weaknesses of these more critical perspectives, the article highlights the analytical significance that they ascribe to power asymmetries in the labor process and labor market. Building on this perspective, the analysis then presents empirical data on gender discrimination in the selection practices of contemporary UK organizations. The research material reveals how gender discrimination can be reproduced, rationalized, and resisted. These empirical findings are theorized through a combined labor process analysis of power, knowledge, and identity in recruitment practices. We conclude that labor process analysis facilitates our understanding of the deep-seated barriers that continue to impede the protection of employee rights in workplace practices.

论我国现行缺陷产品召回制度

我国有关缺陷产品召回制度的法律规范或者原则性较强缺乏可操作性、或者位阶较低不具有广泛性、或者针对特定产品适用面较窄。所以,我们应借鉴发达国家的先进经验制定有关缺陷产品召回制度的基本法律和针对特定行业的特别法律,同时建立明确的缺陷产品召回管理体系,以形成保护消费者、维护市场安全与稳定的健全的法律制度和运行机制。     

论中国承接金融服务离岸外包相关法律问题

吸引金融服务离岸外包已经成为一些发展中国家经济发展的新热点，中国也已将承接包括金融服务外包在内的服务外包作为下一步经济发展的新的增长点。本文从GATS角度探讨了金融服务外包的归类，这一问题涉及确认WTO成员是否在金融服务外包开放上作出承诺。本文建议中国在WTO多哈谈判中可要求有关成员承诺开放包括金融外包在内的服务外包。本文结合金融服务外包方关心的问题，着重探讨了中国承接金融服务离岸外包应注意的法律问题，如金融监管、数据信息保护、知识产权保护和网上商务税收优惠等。     

《旅行社投保旅行社责任保险规定》的弊端及完善

通过分析《旅行社投保旅行社责任保险规定》施行近5年来出现的保险范围不合理,保险金额低,保险费率混乱,责任难认定,理赔程序有弊端及未规定说明义务等问题,提出了统一制订保险范围条款,提高保险金额,规范保险费率,设立仲裁委员会,改革理赔程序及引入说明义务条款等措施,试图为完善旅行社责任保险法规提供借鉴。     

Social housing in France: A permanent and multifaceted challenge for public policies

This paper examines the dynamics of the overwhelmingly generous social housing in France that covers a wide spectrum of recipients. Being influenced by electoral power of rotating ruling parties and social ideals, policy formulations are often reflected by idealistic politics which tends to over-stretch the nation’s budget and restrict its scope in reaching its target groups. From the 1990s, fund availability has been further hit by economic globalization causing falling business profitability and high unemployment rates affecting notably ethnic minorities. Upcoming social crisis has been met with public response via a series of technical-led remedial acts to promote social integration in housing and by identifying social ills and polarization in sensitive and problematic urban quarters. New technical and financial measures in coping with the complexity and magnitude of social housing are expected to remain highly challenging in the French parliamentary politics.     

Usury laws and private credit in Lima,Peru. Evidence from notarized records

I examine the impact of usury laws on the Peruvian credit market between 1825 and 1852. Using a new data set of nearly 2,000 loans from archival sources, I show that the repeal of colonial anti-usury laws in early 1833 had an important effect on the allocation of credit in Lima. It increased interest rates and promoted access to credit. Furthermore, lenders made loans with greater maturities after the repeal of usury laws.     

Marginal Economy: Growth Strategies for Post-Growth Societies

A sharp problem focus sharpens the problem. Sustainably growing bodies of literature on degrowth are not the key to post-growth scenarios because evocations of the limits of growth reinforce rather than transcend the economic principle, which is in the observation of scarcity. Therefore, I focus on alternative forms of growth rather than alternatives to growth. My form-theoretical analysis of growth dismoralizes growth and disembeds it from the economic medium in which it is preferably drawn. I suggest that the key to a post-growth society is in a regrowth of interest in growth in, so far, neglected non-economic function systems.
