浅析部队网络安全保密价值

随着网络技术的普及发展和广泛应用,互联网已经成为大众生活离不开的工具,经济、文化、军事和社会活动都强烈地依赖于网络。网络安全和保密工作已成为事关国家安全、经济发展、社会稳定和军事斗争成败的重大战略性课题。     

关于辩护律师保密权的若干问题研究

世界各国法律几乎都规定辩护律师对其在执业过程中所知悉的秘密负有保密义务,中国也不例外。有些国家在规定辩护律师（下文所称的律师均指辩护律师）保密义务的同时也赋予他们一定的保密权利,而中国法律仅仅强调律师的保密义务而未明确规定律师的保密权。因此,应当具体分析中国存在的有关律师保密问题的立法缺陷,通过学习并借鉴有关国家的先进规定,从而提出完善中国律师保密权制度的建议。

政府在转变保密传统意识中的责任

权利意识作为上层建筑的一个组成部分,虽然受经济基础的决定性制约,但自身具有很强的独立性,一旦塑造成型就很难改变。在公民申请公开行政信息程序中,政府有责任对其行政人员和公民的意识进行转变,让其具有"公开是原则,保密是例外"的观念。     

我国仲裁保密性制度的完善

仲裁作为民商事纠纷的解决方式,其优势主要表现在其自主、保密和管辖的确定上。其中,仲裁的保密性是其区别于诉讼的鲜明特点,以不公开审理为主要原则,我国有关仲裁的保密性的法律规定主要体现在我国《仲裁法》第四十条,该条规定了我国仲裁以不公开审理为原则。除外情形即是当事人申请公开的,可以对案件进行公开审理。正是由于仲裁保密性的特点,使得国际上的许多民商事纠纷的当事人都热衷于该纠纷解决方式。但是,我国仲裁的保密性特点没有相关的具体制度和保障措施,为此,仲裁保密性这一特点其实是名不副实。     

Strategies for measuring risk in public use microdata files

Statistical agencies have the responsibility to design data release strategies which will not violate pledges of nondisclosure either through intent or neglect. In addition to ethical and legal concerns, statistical offices must be mindful that violating pledges of confidentiality may undermine an agency's ability to collect data due to loss of public trust. Statistical organizations also have the obligation to make information available to a variety of individuals and institutions to allow for informed discussion from differing perspectives on a range of issues. However, it is through fine, accurate detail on a file that risks of disclosure arise. In this report we discuss strategies for controlling risk in the release of public use microdata files. The equivalence class structure of a microdata file is defined and we show how the classic entropy function can be employed on the equivalence class structure to provide a measure of relative risk.     

涉密信息化应用系统安全保密功能设计分析

近年来,随着我国各涉密单位的涉密信息化应用系统的逐渐普及,系统中运行的涉密数据规模也在飞速增长,这将容易产生各类泄密隐患,因此针对涉密应用系统的安全保密功能的完善迫在眉睫。本文通过对涉密应用系统安全保密功能设计需求进行分析,提出了符合国家保密局新出台的分级保护测评标准的设计思路,对各涉密机关单位内部和国家层面的涉密领域信息化建设的发展与保密管理水平的提高具有重要意义。     

Skillful hiding: evaluating hedge fund managers’ performance based on what they hide

Mandatory disclosure of hedge fund portfolios has been a hotly debated topic. This article studies asset returns of ‘confidential holdings’ (confidentiality treatment [CT]) or those assets that were not voluntarily disclosed by US-based hedge funds in their original 13F filings to the Securities and Exchange Commission. After analysing returns from 1999 to 2013, we find that in aggregate, the CT position size, ownership share and returns are statistically different to non-CT positions. We provide a mechanism for regulators and investors to rank fund managers based on what they hide in positions.     

Pragmatism,Instrumental Value Theory and Social Economics

In an effort to restore trust in the banking sector, the Advisory Committee on the Future of Banks in the Netherlands made a recommendation, which has since been adopted, that bank executives be required to swear an oath akin to the physician's Hippocratic Oath. This examination of the prospects of the Dutch banker's oath addresses two broad issues. One issue is the efficacy of oaths themselves as instruments for achieving the desired end. A second issue concerns the extent to which this particular oath is a useful guide to ethical banking practice. One conclusion of this study is that it would be difficult for any oath in banking to serve a role that is analogous to the Hippocratic Oath in medicine because of the many dissimilarities involved, most notably the lack in banking of a singular focus on service. Second, the Dutch oath, while admirable in its lofty exhortations, fails to provide a reliable guide through the many difficult judgments that must be made in banking.
