在期货市场上,法律不完备性问题表现得较为突出,法律对于侵害行为的阻吓作用非常有限、期货市场法律的不完备性,主要取决于期货市场的特点和性质。政府采取相关的监管方式管理期货市场非常必要,监管的介入需要满足标准化和损害(外部性)足够高的条件。政府管理期货市场立法和法院执法的作用不可或缺,但更主要的是采用监管的方式。  相似文献

The NSW Government is implementing a financial framework which is designed to encourage government service providers to become more efficient and effective. NSW Treasury is using Data Envelopment Analysis (DEA) to measure the efficiency of major government service providers, such as police, courts and hospitals. This paper outlines the progress in implementing the new financial framework and illustrates the way NSW Treasury will use DEA to help improve the efficiency of government service providers by describing an analysis of the NSW Police Service. The results suggest that NSW police patrols (local police districts) could, on average, reduce input usage by 13.5 percent through better management, and by 6 percent if the patrols could be restructured to achieve the optimal scale. Results also indicate that differences in operating environments, such as location and socioeconomic factors, do not have a significant influence upon the efficiency of police patrols.  相似文献

This paper explores the development of water supplies by private ditch companies during the California Gold Rush. Using data taken from newspaper stories, mining camp by-laws, and state Supreme Court and district court cases, the paper documents the presence of institutional conditions that were unfavorable to support private water investments including property rights uncertainty, imperfect capital markets, and significant contractual enforcement costs that may have provided opportunities for contractual holdup by miners. Some evidence suggests that water development was likely discouraged to some extent. Nevertheless, the larger response was a major expansion in water supplies through an extensive ditch system, suggesting that there were factors that limited the ability of miners to capture rents, including various ditch company strategies to limit their exposure to opportunistic behavior and recognition by miners of their reliance on ditch companies.  相似文献

This research investigates the learning of inter-organizational contract design in greater depth. Two types of learning, i.e. learning from all past partnerships and learning from one specific partner, are distinguished in terms of their influence on the complexity of three different functions of the contract, namely control, coordination, and adaptation. Contract design capability and interorganizational routines are employed as mediators to explain the two types of learning respectively. Empirical tests using data from the Chinese construction industry reveal that there are significant indirect effects between partner-specific experience and contractual coordination, and between general partnership experience and all the three functions of the contract. This research contributes to the literature by providing more nuanced conclusions regarding the contract learning issue.  相似文献

This note shows that according to Lippman and McCall’s (Am Econ Rev 76, 43–55, 1986) operational definition of liquidity, incomplete markets are a necessary condition for illiquidity. 关于创新生态系统参与主体风险冲突及治理的研究,目前只停留在风险产生原因及应对策略方面,主要侧重于静态视角,鲜有文献从创新生态系统演进过程动态视角,并结合创新生态系统驱动主体领导企业考察风险防范和治理问题,而后者对于创新生态系统可持续发展更为重要。构建了领导企业治理的创新生态系统由契约规则到关系规则演化路径分析框架,并以比亚迪新能源汽车创新生态系统为案例进行实证研究。从创新生态系统形成初期领导企业主导的契约治理到成熟阶段关系治理是一个连续不间断的演化过程,基于领导企业治理的创新生态系统演化路径,包含契约规则主导的协同创新到契约规则向关系规则转换的创新网络形成再到由关系规则主导的开放式创新3个阶段,该过程以领导企业借助创新生态系统规范化设计完成整个创新生态系统互动、协同为主要形式。治理重点从企业间契约治理向领导企业主导的对整个创新生态系统关系治理转移,契约治理则转化为由领导企业主导以网络化设计为基础的关系互动和协同治理。  相似文献

我国2001年婚姻法修正案将夫妻约定财产制和法定财产制地位并列,且规定夫妻约定财产制效力高于法定财产制,这进一步完善了我国夫妻财产约定制度,明确夫妻可以约定婚姻关系存续期间所得财产以及婚前财产归各自所有、共同所有或者部分各自所有、部分共同所有,其约定对双方具有约束力。但在夫妻财产约定中,约定一方婚前财产,主要是房产,此类不动产婚后共有或者归对方所有时,是否须要履行物权变动程序,即对方对房产所有权的取得是否必须要办理完过户方能生效,以及出现争议时原所有权人是否可以行使撤销权。这些问题亟待解决。  相似文献
