计算机软件的可专利性探析

如何对计算机软件提供充分而不过度的保护，这是各国立法选择和司法保护上的一个难题，也是一个国际性的问题。通过对计算机软件可专利性理论和实践的分析，可知计算机软件兼有专利权和著作权客体双重属性，并且软件专利保护优于著作权保护。本文从西方国家特别是美国对计算机软件法律保护的发展进程及其不同阶段的分析，提出了我国计算机软件专利保护的对策。     

展会知识产权问题探析

随着国际经济一体化的推进及我国加入世界贸易组织，会展业中的知识产权问题日益突出。由于我国知识产权工作起步较晚，基础较弱，加上利益的驱动、监管不严等原因，在各类展会中，知识产权侵权、假冒和滥用现象时有发生。这不仅给知识产权所有者：和广大消费者造成损害．而且还扰乱了会展行业的正常秩序。因此，规范会展知识产权行为，维护会展市：吻秩序，促进会展业健康发展的工作就显得越来越重要。

本文以2016年《情报科学》刊载文献为数据集,从文献题录信息与引文信息两个角度,运用数理统计方法,评价期刊的质量和学术水平。     

Welfare reducing licensing

In this paper, we characterize situations where licensing a cost reducing innovation to a rival firm using two-part tariff contracts (a fixed fee plus a linear per unit of output royalty) reduces social welfare. We show that it occurs if (i) the firms compete in prices, (ii) the innovation is large enough but not drastic, and (iii) the goods are close enough substitutes. Moreover, we show that, regardless of the type of competition, first, the optimal contract always includes a positive royalty and, second, even drastic innovations are licensed whenever the goods are not homogeneous.

基于交易成本的技术标准联盟形成机理研究

技术标准专利化趋势加速了以技术标准联盟设立技术标准的趋势.从交易成本视角看,市场、科层组织和技术标准联盟在技术标准设立过程中都会产生生产成本、机会主义成本、信息成本以及协调成本,相比之下,技术标准联盟在降低交易费用、提高交易质量方面有明显优势,技术标准联盟形成有其合理性.     

IPO anomalies and innovation capital

Innovation capital are typically expensed and/or unrecognized as assets under current generally accepted accounting principles. This results in accounting-related information asymmetry. This paper examines the association of innovation capital (as measured here by the proxies of R&D expenditures and granted patents) and initial public offerings (IPO) anomalies. These anomalies include initial IPO underpricing, duration of honeymoon (a distinct feature of the Taiwanese IPO environment), and long-term performance. The theoretical model underlying this research is a signaling model. The results indicate that more innovative firms are more likely to be underpriced, and have longer honeymoon periods than less innovative firms. Further, the more innovative firms have positive and growing long-term market-adjusted returns. This stands in contrast to the declining long-term stock performance of initial public offering firms that is evidenced in the literature. We conclude that pre-IPO research and development expenditures disclosed in the IPO prospectus, official monthly reports of newly developed patents released to the public, and the frequency of patent citations significantly signal both underpricing and future market performance of IPO firms in Taiwan.     

Credit Risk Research: Review and Agenda

This article provides a comprehensive review of scholarly research on credit risk measurement during the last 57 years applying bibliometric citation analysis and elaborates an agenda for future research. The bibliography is compiled using the Institute for Scientific Information (ISI) Web of Science (WOS) database and includes all articles with citations over the period 1960–2016. Specifically, the review is carried out using 1695 articles across 72 countries published in 442 journals by 2928 authors. The findings suggest that credit risk research is multifaceted and can be classified into six streams: (1) defaultable security pricing, (2) default intensity modeling, (3) comparative analysis of credit models, (4) comparative analysis of credit markets, (5) credit default swap (CDS) pricing, and (6) loan loss provisions. The article contributes through synthesizing and identifying existing as well as emerging research streams.     

A SURVEY OF THE ECONOMICS OF PATENT SYSTEMS AND PROCEDURES

The last several decades have seen increases in patenting activity worldwide, as well as growing issues related to patent quality. In response to these quality issues a recent patent literature has emerged, that investigates the behavior and incentives of patent examiners, applicants, and third parties. In this paper, we provide an overview of patent procedures, patent systems and a survey of the new economic literature on patent systems. Both theoretical and empirical papers are considered. Policy implications coming from this literature are presented.     

How knowledge flow affects Korean ICT manufacturing firm performance: a focus on open innovation strategy

The paper presents an integrated viewpoint of technological innovation strategy by considering both the firm and industry levels. Further, we provide a new open innovation framework by adopting a knowledge flow perspective using patent citation information. Finally, we consider a firm’s outbound open innovation performance using cites per patent information together with financial performance to look at both the practical and the potential effects of technological innovation strategy. Through these analyses, this study examines determinants of open technology innovation activity in the information and communication technology manufacturing industry in Korea and draws managerial and policy implications for effective industry promotion and improvement of technology innovation capability.
